Motion was made by Ms. Nixon, seconded by Mr. Hogan, to
defer approval of Planning and Zoning Board minutes of
May 13, 1986 to the end of the agenda items. Motion carried
unanimously (7-0).
Chairman Johnson outlined the procedures for conditional uses
advised that anyone adversely affected by a decision of the
Planning and Zoning Board with regard to conditional uses has
weeks from this date in which to file an appeal through the
Clerk's office. Florida Law requires any party appealing a
decision of this Board to have a verbatim record of the
proceedings to support the appeal.

Private Investigator Henry D. Scheid reported an investigation
was held per Statute 493 and he had met with Attorney Jacobs and
the owners in November) 1985. Mr. Scheid commented he had
visited Dock of the Bay on a typical Friday night for a period of
3 - 4 hours and commented the music outside was IInil" with the
installation of the double doors. He noted police cruisers were
in and out of the parking lot the majority of the time and that
security was doing its job as far as the guards were able to
exert their authority.

residents are causing undue complaints.

Hamel) owner of Beach Moorings Motel; Attorney W. Lyman)
representing Herbert Leonhardt; Smith Howard) 35 Hampton Drive;
Ms. Anne Garris) Chairman of the Civil Affairs Committee and
member of the Clearwater Beach Association; Ms. Tony Leonhardt,
706 Bayway Boulevard; George Hoffman) 855 South Bayway Boulevard;
Glenn Nudeck) 570 Gulf Boulevard; and Herbert W. Leonhardt,
706 Bayway Boulevard, They expressed the following concerns:
inadequate parking resulting in blocking of private driveways;
noise generated from the establishment and high-speed cars and
individuals leaving Dock of the Bay during early hours of the
morning resulting in inability to sleep; littering; vandalism of
cars and property; and obscene conduct and verbal abuse.
M. A. Galbraith, Jr. summarized the procedure for conditional
uses and emphasized the item before the Planning and Zoning Board
is whether or not the applicant should have his permit approved.
Ms. Nixon inquired if 40% complaints resulting in arrests is the
"norm" for a restaurant of this classification and received the
reply that "it is no better or worse than the rest; II Le.) 4 or 5
arrests per month.
Chairman Johnson commented the establishment has been operating
in violation of the law and that approval of the request before
the Planning and Zoning Board would permit Dock of the Bay to
operate legally.
Mr. Green felt the applicant has not been operating as a
restaurant and did not meet the following criteria for granting
the request: the operation is not sufficiently distant from the
residences, and the hours of operation are not in conformity with
the use of the surrounding properties.

Discussion ensued concerning placing deed restrictions on

paragraph (g) of the Code describes the process for submission of
conditional use applications to the office of the Code
Administrator. These requests are reviewed and final action is
taken by the Planning and Zoning Board.
The Code as written is not specific regarding the types of
information which should be included with an application for
conditional use request. Due to the lack of such information,
the Planning and Zoning Board has found some difficulty in
