02/04/1986 - MINUTES PLANNING & ZONING BOARD City of Clearwater, Florida February 4, 1986 - 1:30 PM Members present: Chairman Johnson, Mesdames Nash & Nixon, Messrs. Ferrell, Green and Hogan Also present: M. A. Galbraith, Jr., City Attorney (A) On motion by Mr. Hogan, seconded by Ms. Nixon, minutes of January 14, 1986 were approved as amended. Chairman Johnson outlined the procedures for conditional uses and advised that anyone adversely affected by a decision of the Planning and Zoning Board with regard to conditional uses has two weeks from this date in which to file an appeal through the City Clerk's office. Florida Law requires any party appealing a decision of this Board to have a verbatim record of the proceedings to support the appeal. (B) Conditional Uses: 1. Part Mia 44.03, Sec. 6-29-16 (Brandon Nu West Clearwater, Ltd.) CU 86-1 ~ Request - 4COP (Alcoholic Beverage Sales 1. on premises 2. package sales) Zoned (Commercial Center) - CC Above property 1s located at 1730 US 19 N. Attorney Stuart M. Rosenblum represented the applicant. Planning Director Paula Harvey commented Planning staff recommended approval of above request subject to permit being issued within 6 months. She noted the Traffic Engineering and Police Departments had no Objections to above request. . Mr. Green questioned if the applicant would have any objection to excluding package sales from the request and was informed there would be no objection. .~ , ~ No written documents were presented either in support of or in opposition to above request. No citizen appeared either in support of or in opposition to above request. Motion was made by Mr. Green, seconded by Mr. Hogan~ to approve the above request but limit the requested use to on-premise sales only. Motion carried unanimously (6-0). (Little) A 86-l Annexation & Zoning, RS-8 (Single Family Residential) Above property is located on the south side of Ashland Drive approximately 375 feet east of Beecher Road and contains .l9 acres. Request The applicant was not present. Ms. Harvey commented subject property is currently vacant and a single family residence is proposed. Planning staff recommended approval of above request. Chairman Johnson questioned the adequacy of fire protection to subject property and was informed the Fire Department would insure that fire hydrants would be in place in order to guarantee coverage. @D No citizen appeared either in support of or in opposition to above request. Motion was made by Mr. Hogan, seconded by Mrs. Nash, to recommend approval of above request. Motion carried unanimously (6-0). (D) Land Use Plan & Zoning Atlas Amendments: l. Motion carried 5-1, with Ms. Nixon voting "naye." (E) To Consider Development Code Text Amendment: Chapter 135, Sec. l35.l49. Paragraph A to add Public Works projects and Utility substations/ facilities as a permitted use in the Limited Industrial District (City) Ms. Harvey reviewed the background of above request, stating the amendment is proposed to allow public works .projects and utility substations/facilities as a permitted use within the Limited Industrial District. She stated General Telephone Company had looked at other ways to accomplish their objectives without applying to the City of Clearwater for a rezoning. o Ms. Harvey noted public works projects and utility substations/facilities are land uses compatible with those uses currently identified as permitted in the Limited Industrial District. No citizen appeared either in support of or in opposition to above request. Motion was made by Mr. Ferrell, seconded by Mr. Green, to recommend approval of above request. Motion carried unanimously (6-0) . (F) Review and Adoption of By-Laws of the Planning and Zoning Board Planning Director Paula Harvey reviewed for the Board members the' changes made in the various sections of the By-Laws. Motion was made by Mr. Hogan. seconded by Mr. Ferrell, to approve the By-Laws as submitted to the Board. Motion carried unanimously (6~O). Ms. Harvey introduced new Planning staff member Sandra Glatthorn. Development Planner II. Conditional uses were discussed and Ms. Harvey suggested a time stipulation be included in the motions for an applicant to either start erecting his building or procure a license, as the case may be.
