Stephan III, 1540 Walnut Street; and W. A. Zinzow, 2227 Minneola Road. They expressed support of the limitation of size and number of signs and the amortization of signs. Attorney Timothy A. Johnson, Jr., representing Arbor Advertising, Foster and Kleiser and National Advertising, distributed charts to the members of the Board and expressed the opinion that the intent of the proposed Land Development Code is to put the billboard business "out of business" as'property would be taken without compensation. He commented that all sizes of businesses would be affected. He expressed the opinion that all advertisers benefited appreciably from the billboards, stating a petition in opposition to above request had been signed by 534 persons. He noted the life of a billboard to be approximately 15 years. Mr. Johnson suggested a llblue ribbon" task force be formed to further study the proposed Code. Attorney Harry Cline, representing several on-premise sign owners, appeared in objection, stating property will be taken without compensation and will affect all sizes of businesses. Alan Zimmett, Assistant City Attorney, commented the Legal Department is comfortable with the manner in which the Code is presented. Several Board members expressed concern regarding the 5-~ear amortization schedule, feeling 5 years too short a time frame. Other members expressed concern that a court suit might evolve if the 5-year amortization were enforced, with taxpayers incurrin~ substantial legal costs. Board members expressed the opinion that even though the signs could be considered a tax write-off, the property would still be valuable. "grandfathering" of signs was discussed as the maJority signs would appear to be non-conforming. Several Board members felt that by normal attrition, the maJority of signs would eventually be in conformance with the Code. Possible of Mr. Ferrell, stipulation amortization period be extended from 5 to 10 years. If any change in occupancy or sign should take place within that period of time and it becomes a non-conformin~ sign, said sign must conform to the Code.
