PUblic hearing was held for the purpose of considering annexation
and zoning and amendments to the Land Use Plan and Zoning Atlas.

(A> On motion by Mrs. Regulski, seconded by Mrs. Haggitt, the
minutes of June 5, 1984 were approved as written.

At this time, Mrs. Harvey explained to the Board that there was
an error in the advertising of the public hearing items. The
publiC hearing items were advertised to be heard by the Planning
& Zonfng Board on June 19, 1984 and then were advertised a second
time to be heard on July 3, 1984. Since the City Commission will
not be hearing the public hearing items until July 19, 1984, Mrs.
Harvey stated that she will ask at the July 3, 1984 Planning &
Zoning Board meeting if there are any citizens appearing either
in support of or in opposition to the items even though the Board
will have made their recommendations.

City Commission on April 19, 1984 denied staffls request and
directed staff to initiate an application for the zoning designa-
tion to be changed from PS to CG to conform to the Land Use Plan.
Staff recommends denial of the above request and that the
property be designated Residential/Office on the Land Use Plan
and zoned PS (Professional Services).

in support of the application were not present at the public
hearing to voice their support.

informed several of the residents of the need to be present and

has not been developed. On April 19, 1984, the City Commission
denied a Land Dse Plan amendment trom Residential/Office to
Commercial/Tourist Facilities and directed statf to initiate a
re~oning of the property to PS to conform with the present
Residential/Office Land Use Plan designation. She further stated
that there was no opposition from the property owners to this
request.

request that was tbe result of an areawide rezoning on properties
located generally north and south of Drew Street and west of U.S.
19. At tbat time, staff prepared the following alternatives for
consideration by the City Commission: 1) no change to the
present Land Use Plan and Zoning Atlas designations, 2) Land Use
Plan amendment from Commercial/Tourist Facilities to Residential/
Office and Zoning Atlas amendment from CP and CG to PS for M&Bls
44.01, 11.02 and 11.03, or 3) Zoning Atlas amendment from CG to
CP for MaBts 11.02 and 11.03 with a subsequent County Land Use
Plan amendment from General Commercial to Residential/Office/
Retail on MiB's 44.02, 11.02 and 11.03. On May 3, 1984 the City
Commission directed staff to initiate a zoning atlas amendment
from CG (Commercial General) to CP (Commercial Parkway) with a
subsequent County Land Use Plan amendment from General Commercial
to Residential/Office/Retail on MaBls 44.02, 11.02 nnd 11.03 and
that portion of MaB 11.04 abutting on the south side of M&B

recommend approval of the above request. Motion carried
unanimously (6-0).
Motion was then made by Mrs. Haggitt, seconded by Mr. Green,
recommend to the City Commission to consider CP (Commercial
Parkway) zoning on M&B 11-04. Motion carried 4-2 (Free and
Regul ski) .

The Land Use Plan classification is Commercial/Tourist Facilities
with a zoning designation CP (Parkway Business) District.
Mrs. Harvey reviewed the history and background of the proposed
project stating that the property is now developed with a 12,890
square foot shopping center. Plans are to construct a fast food
type restaurant at the eastern edge of the existing parking lot
fronting on U.S. 19. The City Commission on February 16, 1984
authorized review of a final site plan for the proposed Wendy's
Restaurant subject to the submission of a preliminary plat for
the entire K-Mart shopping center site in accordance with the
subdivision regulations. The final site plan for WendY's
International Restaurant will be brought to the City Commission
for final action following approval by the Board of Adjustment
and Appeal on Zoning of variance requests to parking and setback
requirements.
The Resource Development Committee on March 22, 1984 recommended
approval of the preliminary plat subject to a 40 foot right-of-
way easement be given along U.S. 19 for Lot A prior to recording
the final plat and the final plat be recorded within six (6)
months from the date of City Commission approval of the pre-
liminary plat.
Motion was made by Mr. Green, seconded by Mrs. Regulski, to
recommend approval of the above request. Motion carried
unanimously (6-0).
(F) Other Action and/or Review Items

Land Development Code
Mrs. Harvey stated that the time frame for adoption of the
proposed Land Development Code is being delayed until the
comments of various City departments are incorporated into the
document. This will delay receiving the Planning and Zoning
Board's comments until the next regular meeting. She further

asked for input from the Board concerning the possibility of a
workshop between. the City Commission and the Planning and Zoning
Board for review of the Code. The Board members were in favor of
holding a workshop with the City Commission to review the
proposed Land Development Code.
Mrs. Harvey stated that the City Manager has informed her that
the design plan for the waterfront will be reviewed ~y the
various City departments, boards and committees. The Planning
and Zoning Board will have the opportunity to make a formal
recommendation to the City Commission before the plan is
approved.
