Portion of M&B 24-012, Sec. 1-29-15 (Cope/Green) Annex. 84-13 I Request - Annexation & Zoning, PS (Professional Services) The above property Is located on the north side of Sunset Point Road, approximately 180 feet west of Hercules Avenue. The subject area is vacant and contains .09 acres MOL. I a The Land Use Plan classification is Residential/Office. I The parcel of property requested to be annexed is twenty (20) feet in width. This strip of land was inadvertentlY excluded from a previous annexation request in 1973 for the property to the west of the subject area. Staff has determined that, subsequent to a revision in the survey of the property to be annexed in 1973, no revision was made in the ordinance effectuat- ing the annexation, resulting in the omission of the 20 foot strip of land from the area legally annexed. This error was discovered through the process of platting the Sunset Oaks Subdivision approved by the City Commission as a preliminary SUbdivision plat on February 2, 1984. I I I There are no plans for development of the SUbject parcel. However, the annexation must be processesd prior to recording the final plat for Sunset Oaks and prior to completion of the Hercules multi-family development to be constructed to the north of the s~bject parcel. The applicant is requesting a waiver of the fees for processing the annexation as the proper legal description for the property to be annexed in 1973 was provided to the City but was not inclUded by the City in the final draft of the ordinance effectuating the annexation. No citizen appeared either in support of or opposition to the above request.
