':'.~ ~ 'I Minutes of the Planning & Zoning Board - October 18, Page 2 1983 I In order to allow for the possibility of the applicant's appearance, and with the Board members. approval, Chairman Regulski proceeded to consideration of Item (D) on the agenda. (D) To Consider Zoning Ordinance Text Change to: Sec. 131.150 (d) To encourage the am~rtization of prohibited uses in the Downtown Development District I I Mr. Healey informed the Board of the reasons for consideration of the above Zoning Ordinance text change. He stated that selected uses have been determined to be inconsistent and incompatible with the purpose of the Downtown Development District and the City1s redevelopment efforts therein and are expressly pro- hibited. The proposed amendment would expand on the existing language to require the termination of such uses upon the expiration of their current contract, lease or other comparable interest for use of the facility in which they are now located. The purpose of the proposed text change is to place such uses on notice that upon the expiration of their current arrangement they need to contemplate relocation outside of the Downtown DevelopN ment District, thus encouraging non-conforming uses to expire at some definite point in time. Board members expressed concern regarding non-conforming uses and their relationship to this text change and the date of expiration of such use. They requested the City Attorney's comments on same. Mr. Bustin explained that the individuals involved would be getting the life of that speCific use and then, at the expiration of the lease, that use would expire. This procedure would seek to terminate non-conforming uses at a specific time. No citizen appeared either in support of or in opposition to above request. Motion was made by Mr. Mazur, seconded by Mr. Bickerstaffe, to recommend approval of above request, with the additional recommendation that the City Attorney determine an appropriate date to be included in the ordinance and that said date be prior to the second ordinance reading, but after October 18, 1983. Motion carried unanimously. Chairman Regulski next considered Item (e) on the printed agenda. I Clearwater Beach Traffic Study I Jerry Ingram, Kimley-Horn & Associates. made a presentation to the Planning and Zoning Board of the stUdy they have made of ways to improve traffic flow and better' integrate traffic components on the Beach. He presented several recommendations as an adjunct to the Thoroughfare Plan and noted what could be ac- complished wtth the situation on the beach as it exists today. He emphasized that addittonal p~rking is not the solution and proceeded to recommend several items. stating thdt efforts should be made toward develop1ng an integrated transportation system.
