He reviewed the background and history of subject property, commenting that on July 16. 1981. the City Commission approved the RPD-14 zoning and a master site plan for the site, subject to several conditions. Plans are to develop subject site with 240 apartment units. Mr. Davidson noted the similarities and the differences between the previous plan and the present one, citing the following advantages to the present plan sub- mitted: (1) open space has been increased by l'l.j (2) site plan has greater flexibility with more open space; (3) elimination of one driveway access to the site, creating less driveway cuts and less congestion on Coachman Road; and (4) overall improved en- vironmental aspect. Mr. Davidson stated a 6-ft. chain link fence is proposed to be erected on the perimeter of the property. Discussion ensued concerning fences and the Planning Director reviewed the ordinance covering fences. Chairman Regulski expressed concern regarding no precedent having been set. m I Tampa attorney Paul Johnson, representing the Church of Scien- tology, appeared in opposition. He suggested the Board consider the basis of the entire community development effort. He com- mented that the proposed zoning ordinance text change is very dangerous and threatening to new growth and would deter new or- ganizations from purchasing additional land in downtown Clear- wa t e r . m I At this point City Attorney Tom Bustin appeared to answer ques- tions posed by the Board. Mr. Bustin said he was comfortable with the approach proposed with the zoning amendment, and that the thrust of such amendment needed to be understood in the context of distinguishing between categories of use. He cited a recent case in this connection from Lakewood, Ohio..
