On motion by Mr. Bickerstaffe, seconded by Mr. Mazur, minutes of December 21, 1982 were approved as written. Annexation & Zonin~: 1. M 6 B 33.01, Sec. 2-29-15 (Rhodes) Request Annexation & Zoning, RS-50 (Single Family Residential) Above property is located at and consists of 3.72 acres. residence. the southeast corner of Otten Street and Kings Highway Subject site is vacant except for one single family Applicant R. Rhoades stated plans are to develop the property as a single family residential subdivision. Ralph Derydra, 1447 Bentley Street, appeared in support of above request. Mr. Healey stated additional right-of-way will be required for Otten Street and Weston Drive and the annexation requires the abutting rights-of-way be included. No citizen appeared in opposition to above request. Motion was made by Mr. Bickerstaffe, seconded by Mr. Mazur, to recommend approval of above request, including the additional rights-of-way requirements per the Public Works Department. Mr. Richter reviewed the backgrouDdand hi8~ory of subject chapter, .t.ting the propo.ed Code chang_s constitute: an extensive revision to the Zoning Code in the section governing regulation of temporary and portable buildings and other re- lated sections. Further, there is an inconsistency between the Building and Zoning Codes. Mr. Richter stated the City Commission had directed the matter of tents and retail sales from vacant lots be addressed. Regulations governing the erection of tents and temporary retail sales and displays, including location. permitted uses and time period of permits issued are included in the propoeed changes. In addition, provision is made to allow time extensions for temporary and portable buildings to be considered by the Board of Adjustment and Appeal on Zoning in lieu of the Building Bosrd of Adjustment and Appeal. Discussion ensued, in particular whether the setback should be from the Coastal Construction Control Line or the property line or platted line. Ms. Paula Harvey displayed maps depicting the CCCL and the platted property lines to show the differentiation between the two points of reference. Board members asked for several clarifications during the discussion; e. g., possibility of IIgrandfathering non-conformities," Concerns expressed by the Board were: whether or not property owner could rebuild should property be destroyed, utilizing the CCCL as a setback line in lieu of some other line, intent or purpose relative to any waiver and coordination with the State approval forward of such line. Kraxberger, President of The Oxford Group, Inc., presented information concerning the development of site for a shopping center and indicated he was in agreement with the proposed conditions of plat approval. Mr. Healey reviewed for the Board the particulars of the accompanying site plan and indicated the Resource Development Committee had recommended approval of the site plan and the subdivision plat. Motion was made by Mr. Bickerstaffet seconded by Mr. Goodwin, to recommend approval of above request. Motion carried..Mr. Mazur abstained due to a conflict of interest.
