Mr. Anderson expressed concern regarding Mercer Lane which runs north and south of the property along the east property line. He stated that the status of this lane should be in- vestigated. ' Sunset Nurseries, stated that they have been an exit for customers. They had been that this is an open lane. Mrs. Finley, using Mercer Lane as told by the Mercer's Ms. Harvey stated that staff will of the lane and determine the prope~ty in question. investigate the location usage and whether it is on the Mr. Henry Smith, Lakeside Community Chapel School, stated that they had brought supplies to the school by Mercer Lane but now use it for recreational purposes for the students They were also told it was an open lane. No citizen appeared in opposition to above request. Ms. Harvey described subject property and location;~f same, reviewing the background and history for the Board. The area of Sunset Point Road and Hercules Avenue is becoming more Commercial and Residential/Office oriented. The County is also considering more commercial development in this area. The PS zoning will not be in conflict with what staff will be proposing as general land use in the area. Ms. Harvey reviewed comments received from other departments. The Engineering Department stated that they will be looking for an additional 10 foot drainage and utility easement along the south side of the property. They currently have a 7-1/2 foot drainage and utility easement along the eastern side of the property. Sewer service to this property will come from the East plant. The applicant is requesting a waiver of the parkland dedication requirement. The cypress head on the above property and the church property will be protected through site plan review. Chapter 131 Zoning Code of Ordinance. To provide for the establishment & operation of Family Care, Group Care & Congregate Care Facili- ties within selected ,oning district designations in Clearwater. Ms. Harvey reviewed the revised draft of the Zoning text changes. She briefly described the background that the 1980 Florida State Legislature amended the Local ernment Comprehensive Planning Act of 1975 at Section 163.3177 to require that the Housing Element of the Local Government Comprehensive Plan provide for group home facilities and foster care facilities. Three types of facilities are defined for the provision of special living facilities for other than the tra- ditional, nuclear family. Family care facilities are designed to be occupied by not more than five (5) cared for individuals. Group care facilities, further defined according to two levels of care, are designed to be occupied from six (6) to twenty (ZO) cared individuals. Congregate care facilities provide congregate living services for more than twenty individuals. Ordinance stating Gov- Considerable discussion ensued regarding the proposed amendment.
