Public hearing was held for the purpose of considering items to be included in an
ordinance amending the Land Use Plan and Zoning Atlas and Zoning Ordinance text
change.
Tapes of public hearings are on file in the Planning Department.
On motion by Mr. Mazur,•seconded by Mr. Anderson, minutes of March 16, 1982 were
approved as written.
Planning and Zoning Board considered the following.
With the Board's approval, Chairman Regulski deviated from the agenda and Item C
was considered. Representative of Item B had been delayed.
Zoning Ordinance Text Change:
Art. II, Sec. 131.016 (h) (8) a. & Art, III, Div. 17,
Sec. 131.120, and.Art. III, Div. 20, Sec. 131.142 -
To permit as a special exception use Types A, B & C
marina facilities in PS (Professional Services) and
CG (General Business) zoning districts
Mr. Healey stated that'the request was initiated in response to a request by a private
property owner desirous of constructing a marina on property currently,zoned PS,
Professional Services. Said letter stated there is no provision for a marina to be
located in PS zoning district.
Mr. Healey reviewed the background and history and commented that three small areas
could be impacted by the zoning ordinance text change as it related to the PS coning
district. As proposed, Type A, B and C marinas would be considered for special
exception use in PS and CG zones, as well as in PM-28, CTF-24 and CTF-28 zoning
districts where marinas are currently permitted as a special exception use.
No one appeared in favor of above request.
Mr. Charles Vinton, 310 S. Maywood, commented that he had no objection to Type A
marinas being included as a special exception in the CG zoning district but that
careful consideration should be given to further zoning ordinance text change and
he was opposed to including them in PS zoning district.
Mr. Leonard Spoerl, 420 Bay Avenue, appeared in opposition to any establishment of a
marina between Pierce 100 and Oak Bluffs.
' Mr. John P. St. Clair, Pierce 100, had no objection to CG being included but was op-
posed to PS being allowed and stated he did not like to see the integrity of zoning
laws challenged.

Mr. Bickerstaffe felt that we are a water-oriented community but Mr. Canan felt
there were problems with the compatibility of Types A, B and C marina facilities being
included as a special exception in a PS zone.
Mr. Healey recommended that only Type A marina facilities be allowed in PS as a per-
mitted use, descriptions refined to make the distinctions between Types A, B and
C more'clear-cut and Types A, B and C permitted in CG.
Motion was made by Mr. Canan, seconded by Mr. Mazur, to recommend approval of above
zoning ordinance text change to permit Types A, B and C marinas as a special exception
in CG zoning district only, with modifications in Type A marinas as recommended by

Subject request was continued from the Planning and Zoning Board meeting of March 2,
1982 at the request of Mr. Tim Johnson, Jr., representing Clearwater Mall. He
stated he was prepared'to submit a rezoning application for the entire Clearwater
Mall parcel to CSC zoning district, stating this zoning classification would adequately
accommodate the buffer requirements due to greater setbacks in said zoning classi-
fication.
Mr..'Healey reviewed the background and history of subject property, referring to an
aerial photograph. He commented that on December 10, 1981 the City Commission tabled
the request for rezoning the portion of subject property adjacent'to.Sky Harbor Mobile
Home Park to RM-12 zoning classification. He stated subject area cannot accommodate
CG zoning classification but that the area could be utilized for office use and off-
street parking. Many uses allowable in CG zoning district would be objectionable.
40 Planning staff proposes the creation of a buffer area of Residential/Office between
the commercial development at Clearwater Mall and the residential development along

Attorney Tim Johnson, Jr., representing Clearwater Mall, appeared before the Board
and reviewed the history of subject property, reiterating that his client would like
to see the Clearwater Mali rezoned to CSC zoning district and deny Planning staff's
request that the small triangular area described be rezoned PS.
Access and egress to adjoining mobile home park (Sky Harbor) was expressed as a
concern and Mr. Johnson stated there is access at two points from the mobile home
park to the Mall and he saw no reason why this situation would be altered in the
future.
Motion was made by Mrs. Parks, seconded by Mr. Bickerstaffe, to recommend approval
of above request 1. (a) and (b). Motion failed 1-7.
Motion was then made by Mr. Canan, seconded by Mr. Kuntz, to recommend denial of above
request 1. (a) and (b), with the stipulation that the owner come in with CSC zoning
classification for the entire tract. Motion was then amended by Mr. Mazur, seconded
by Mr. Bickerstaffe, that the City initiate the rezoning of the entire parcel. Upon
vote being taken, the amendment failed 4-4. The main motion carried unanimously.
Amendment to Zoning Ordinance No. 1361 b adding Section*2.
"Section 2, That the zoning granted in Sec. 1 is hereby made
subject to the following conditions:
(1) That such property shall be subject to a 42-ft. building height;
(2) That such property may only be used for professional office use
or restaurant use; and
(3) That no night club may be instituted as a use of the property.".
Mr. Healey reviewed the background and history of this parcel of land, located at
the northeast corner of Flushing Avenue and Harn Boulevard. He distributed a pre-
vious memorandum to the City Commission and stated that on January 17, 1972 the
City Commission held a public hearing on the zoning of said parcel of land to
Parkway Business (now referred to as CP, Commercial Parkway). -At that time, the
Commission imposed certain conditions on the zoning as reflected in the subsequent
minutes of that meeting (referred to above). Subsequent Ordinance No. 1361 did
not srcurately reflect the conditions imposed by the Commission and proposed amend-
ment would cite these conditions by the addition of Section 2 as noted above,
Mr. Rick Griesinger appeared before the Board representing the Legal staff.
At Edward J. Geoghegan, President of Morningside Meadows Association, reviewed
the background and history of subject parcel, commenting the intent was to insure
there be no night club at this location and noting that property is adjacent to a
recreational center.
Mr, Peter Teer, 1450 Viewtop Drive, appeared in opposition to above request, stating
there could be legal complications.

Attorney,.Peter Napier, representing the Golden Horn, Inc. (owner of property) and
the estate of John Newcomb, stated proposed amendment to Zoning Ordinance No. 1361
harms the present owner and subsequent sale of the property; further, it raises
legal problems.
Club owner Edo Ferrol, 2400 Harn Boulevard, appeared in opposition, stating that
no nightclub is being operated at subject site.
Motion was made by Mr. Bickerstaffe, seconded by Mrs. Parks, to recommend approval
of amendment to Zoning Ordinance No. 1361 by adding Section 2 as noted above.
Motion carried unanimously.
Chairman Regulski called a recess at 4 PM.

Revised Subdivision Plat - The Village at Countryside
'Tracts 45, 72, 73 &„74 (The Lane Company)
Above property is located at the northwest intersection of US 19 and Enterprise Road.
The area is partially developed with retail stores and office buildings and consists
of a total of 30.9 acres MOL.
Mr. Healey stated that on October 1, 1981 the City Commission approved a preliminary
subdivision plat for the tract showing four individual parcels. Above request is to
add the fifth parcel to the plat and extend the time provided to have the final plat
recorded.
The Resource bevelopment Committee recommended approval.on April 5, 1982.
Mr. Nick Zrarra of Post, Buckley, Schuh & Jernigan represented The Lane Company.
No one appeared in opposition to above request.
Motion was made by Mrs. Parks, seconded by-Mr. Kuntz, to recommend approval of
above request. Motion carried. -Mr. Mazur abstained due to a conflict of interest.

Planning and Zoning Board continued above item in order that concerns expressed by
Board members, private developers and Resource Development Committee members be in-
corporated into a revised proposal for their consideration.
Mr. Healey reviewed the changes from the previous - draft the Board had reviewed

Considerable discussion ensued by Board members, including possible changes offered
by Messrs. Anderson and Mazur.
Mr. Paul Corace, Vice President of The Kerwin Company, reiterated his previous
comments concerning objection to the proposed zoning ordinance text change.
Motion was made by Mrs. Parks, seconded by Mr. Anderson, to approve above request,
incorporating as many changes outlined by Messrs. Anderson and Mazur as feasible.
Following discussion, motion was withdrawn.
Motion was then made by Mr. Kuntz, seconded by Mrs. Parks, to recommend approval of
above request as submitted. Amendment to the motion was made by Mr. Mazur, seconded
by Mr. Turner, to delete sections on impacts-and compatibility (paragraphs (F) (2)
and (F) (9). Upon vote being taken, the amendment failed 3-5 and the motion failed
4-4.
A third motion was made by Mr. Mazur, seconded by Mr. Anderson, to recommend ap-
proval of above request with deletion of sections on impacts and compatibility
(paragraphs (F) (2) and (F) (9) as they are a function of zoning. Motion failed 2-6.
The Board concluded by requesting the Commission be advised that after lengthy dis-
cussion the Board was concerned with but undecided about the proposed ordinance
changes.
