Establishment of RPD-6 zoning for Sunfish Bay Condo and Braeside Sub., M & B 3 and M & B 4-2, Sec. 9-29-16 & Sec. 10-29~16 (Located on Bayshore Blvd. E of Det Oro Heights Sub.) (Sunfish Bay Condominium Association and Murray City initiated) 2. Amendments to Restrictions as they apply to Phase III plac~d on the above land by City Commission action of May 31, 1972 to provide for the development of Br.eside Place Sub. (Murray) 3. Approval of the site plan/subdivision plat for Braeside Place (Murray) Above property is located on Bayshore Boulevard, east of Del Oro Heights Subdivision. Planning Director Dave Healey reviewed the background and hiatory of subject property, commenting that property is to be considered for rezoning in its entirety, subdivision and lite plan for Phase III of Sunfish Bay (undeveloped) and corresponding amendments to originll restrictions placed on it in 1972. He reviewed the previous action which had been taken, noting the re~trictions and plan considered by the Commission in 1979 were never executed. Sufficient changes were being requested in the revised plan for Phlse III so a. to necessitate advertisement, including rezoning, site plan/subdiviSion plat approval and amendment of restrictions. M.. Paula Hlrvey reviewed the specifics of the plan for the Board, commenting that it had been reviewed and recommended for approval by the Resource Development Committee. Mr. Ron Riley, King Engineering, represented the applicant. Mr. Riley stated that seven detlched homel would be built ~n 5 and 3/4 acres. He reviewed the specifics, noting there would be an 80-foot clear zone between existing residences and any new ones and a height,limitat10n of 30 feet. The previous plan had proposed 42 condominiums. Mr. D. James Kikedyk, Secretary of the Sunfish Bay Condominium Aasociation~noted the letter addressed to Mr. Healey from Mr. Don F. Zimmerman, representing the Condo- minium Association in legal affairs~ in which he expressed concerns and stated the proposed parcel is burdened with certain easements and restrictions for the benefit of the individual unit owners at Sunfish Bay Condominium. Mr. Kikedyk stated the road paralleling Sunfish Bay is the only practical means of ingress and egress for large vehiclea. Further, he stated his concerns with respect to the provisions for drainage and requested the Board not approve the proposed plan. Mr. A.' J. Murray reiterated Mr.'Klkedyk's remarks, is too close to Building F, approximately 10 feet. I stating the proposed retention pond MS. Ruth Ann Morris, resident of Building P, atated the proposed dry retention area will not be dry as this area is wet approximately 4 months of the year. MS. Rebecca Watkins expressed concern that the open view would be eliminated. Hr. Murray, owner of Phase III, stated the road in question is temporary and the present entrance should be widened to facilitate movement of large vehicles. He commented the Association desires to establish a road on property that is his, but he is willing to negotiate on this item. Mr. Mazur expressed concern with parking regarding Buildings E and P, the SO-foot clear space between buildings and the 24-foot street width, from back of curb to back of curb. Mr. Bickerstaffe felt that there should be access to and from individual phases of the project. Mrs. Regulski expressed concern with privately owned retention areas relutive to their future maintenance. Hr. Goodwin stated he felt the proposed amendments to the restrictions should accompany .nd be a deed restriction on individual lots in the proposed subdivision. Mr. Riley explained that this would be the case. Mr. Healey stated that legitimate concerns of the residents in Sunfish Bay, Phases I and II were addressed in the plan and amendment to restrictions. Baaed on the merits of this plan and the existing development, he recommended the property be rezoned RPD-6j that the restrictions be amended 8S proposed; and the preliminary site plan/ subdivision plat be approved - subject to resolution of the atreet width and an equitable re.olution of a second connection from Sunfish Bey to Bayvlew Boulevard. Mr. Healey further stated that survey information provided the City showed no record of an access ..sement on Phase III and that if it were' the position of the Association that such existed they should bring forward documentation of same, and that thia was not an issue to be resolved by the City Commission. MOtion was made by Hr. Land Development Code Update Hs. Chris Papandreas presented the progress to date on the Land Development Code, in- cluding presentation to and response of City Commission of materials reviewed earlier by the Board. She noted several drafts would be forthcoming the latter part of the ~nth; specifically, administrative provisions, annexation ordinance and use districts which, follOWing staff review, will be shared with the Board. Downtown Redevelopment Plan The Downtown Redevelopment Plan was distributed to the Board and diBcussed briefly. ~.
