Public hearing was held for the purpose of considering requested annexation and zoning
followed by public hearings for the purpose of considering items to be included in an
ordinance amending the Land Use Plan and Zoning Atlas and zoning ordinance text change.
Tapes of public hearings are on file in the Planning Department.
On motion by Mr. Kuntz. seconded by Mr. Canan. minutes of September 15, 1981 were ap~
proved as corrected.
Motion was made by Mr. Goodwin. seconded by Mrs. Wulfeck, to proceed with Item K w2 on
the agenda as requested by the applicant. Pacific Environmental Properties, Inc.. prior
to considering the remainder of the agenda. Motion carried unanimously.
Planning and Zoning Board recommended as follows.

Representative Thomas P. Hogan stated above request is for construction of 7 slips to be
used exclusively by the property owners of subject site.
Ms. Harvey commented that the application had been reviewed by the Harbormaster and there

Above property is located west of Garden Avenue at Palm Bluff Street and west of Garden
Avenue and north and south of Hart Street.
Mr. Richter reviewed the background and history of above request, commenting it is part
of the N. Fort Harrison rezoning. He noted that in the N. Fort H~rrison rezoning, the
recommendation to RM-8 was denied, both by the Planning Bnd Zoning Board Bnd the City
Commission. Staff was then directed to readvertise in order to amend the Land Use Plan
from Low Density Residential to Commercial/Tourist Facilities.
No one appeared either in support of or in opposition to above request.
Motion was made by Mr. Canan, seconded by Mr. Goodwin, to recommend approval of above

Mr. Richter reviewed the background and history of above request, commenting it is part
of the.N. Fort Harrison rezoning. He noted that in the N. Fort Harrison rezoning, the
Planning ana Zoning Board recommended denial of the request for RM-a and further recom-
mended that the entire parcel be zoned CG and the Land Use Plan be amended to provide
Commercial/Tourist Facilities District.
Applicant Victor Adams appeared before the Board.
No citizen appeared 1n support of or in objection to the above request.
Motion was made by Mr. Mazur, seconded by Mr. Goodwin, to recommend approval of above

Mr. Richter stated the area is developed with a physician's office and single family
residences. which residences are planned for conversion into offices. He identified the
surrounding usage and stated the proposed request is compatible with the area.
Mr. Jim Miller, one of the owners of subject property, stated he plans to utilize one
of the residences for a real estate office.
Mrs. Parks commented that the present zoning of RM-2B would appear suitable zoning to
enable local residents to utilize neighboring services.
No citizen appeared either in support of or in objection to above requests.
Motion was made by Mr. Kuntzl seconded by Mr. Goodwin, to recommend approval of above
requests (a) and (b). Motion was defeated 4~5.
Motion was then made by Mrs. RegulskiJ seconded by Mr. Mazur, to recommend denial of
above request. Motion carried 5-4.

Mr. Richter stated subject property is partially developed with residences and plans are
to convert these residences to professional office use and to allow for development of'
offices on the vacant property.
Attorney Charles Barber appeared before the Board and reviewed the background and history
of the areal commenting that the area had remained virtually unchanged over the years
except for areas where profedsional zoning had been allowed on the south side of Greenwood.
He felt the proposed request wouLd not be detrimental to the single family residences and
~ any impact would be lest than that of multi-family zoning.

~ The following persons appeared in support of above request: Ms. Merle Hall. owner of
Lots 8 through 14. and Ms. Maude Stewart. owner of Lots 3 & 4.
Mr. Woodrow Ranas, 1185 S. Greenwood Avenue. appeared in objection, stating the City
had previously rezoned subject area. He expressed concerns regarding traffic impact
and felt there was "already sufficient zoning for professional use.
Ms. t. Gulley presented a letter addressed to the City Clerk from Mr. John F. Gilbert.
Executive Director of Clearwater Neighborhood Housing Services. Inc. (dated October 5.
1981), wherein Mr. Gilbert stated the proposed rezoning is inconsistent with the
residential preservation initiated in S. Greenwood area.
Mr. Richter had the following comments: (1) Subject area was included in S~ Greenwooo
area rezoning in 1979 and that the circumstances have not changed. (2) PS zoning is
located on Greenwood and Myrtle and all is not utilized for that purpose. therefore,
there is no justification for additional usage; (3) if proposed request is approved,
likely surrounding areas would apply for PS zoning.
Motion was made by Mr. Mazur, seconded by Mrs. Regulski, to recommend denial of above
request. Motion carried 6~3.

Sec. 131.112 through Sec. 131.117
To update the requirements for Mobile Home Park District use
generally. and specifically. to distinguish
for proposed new parks and those applicable to replacement
of units in existing parks.

Planner II and Staff Liaison for the Mobile Home Park Board, reviewed the
history of the proposed ordinance text change, stating there are at present
28 mobile home parks in Clearwater, either wholly in or partly within the City. Two~
thirds of these parks were established prior to 1962 when the existing provisions of the
RMH District were adopted. Permitted uses in this district were mobile homes only; travel
"
trailer parks were regulated separately. He addressed the general characteristics of
existing mobile home parks as to density. setbacks, lot size, street widths and recreation
areas. He noted the difficulties in endeavoring to apply present code requirements to
existing mobile home psrks~ e. g., existing parks rendered non~conforming and mobile home
parks prohibited in CG District. He brought to the attention of the Board a directive from
the City Manager, effective January 31, 1981, which served as the basis on which permits
for'mobile homes 'in existing parks would be considered.
Mr. Richter reviewed with the Board the actual changes proposed to the text of the Zoning
Code for the purpose of remedying the problems identified by Mr. Hawkins. He pointed out
that there will be a distinction made between the rules regulations and regulations governing
the' development of new mobile home parks and existing mobile home parks.

In addition to his presentation. Mr. Richter presented slides depicting the various
separations between mobile homes.

Mr. Bickerstaffe felt that approximately 807. of the parks could not comply~th the pro-
po.ed changes without removing one or two units. He also expressed a desire to sec a
park plat registered in addition to an aerial photograph showing the existing units.
s,d. additionally. investigate if the national fire code could be implemented in the
parks as it is in the County.
The following persons spoke in support of the proposed zoning ordinance text changes
but expressed the feeling that the new regulations should be enforced on new parks
only and that the older units should be allowed to be r~placed if they did not exceed
the existing setbacks: Walter Piper, partner of Gulf-to-Bay Trailer Park. and John
Ritchie. owner of Hillside Mobile Home Park.
Mr. Howard Groth. resident of Happy Trails Mobile Home Park. felt the non-conforming
units could be handled on an individual basis and the ch~nges proposed are needed for
investment protection. He pointed out that the Board of Adjustment and Appeal is an
alternative to solving individual problems.
Mr. John Adams. Manager for the New Ranch Trailer Park. suggested checking out old
trailers when they are ready to be replaced.
Ml'. Robert Struchen. owner of Sunny Grove Mobile Home Park. felt that 2S~~ of his park
~ units did not comply and it would be a hardship when replacing them.

Mr. Bill Boutilette, President of Lakeside Mobile Home Park Association, suggested ad~
ditional publicity prior to a public hearing and the posting of such changes on the
~rk bulletin boards. Mr. Vie Thompson. President of Kapok Mobile Home Park, was in
agreement on this suggestion.
At this point, Mr. Hawkins stressed the need for a survey if these units are to be
"grandfathered." He stated the Building Department needs rules and regulations in order
to enforce compliance.
Mr. Mazur expressed concern about individuals desiring to replace their units and not
being able to conform to the new setbacks. and felt residents should be treated in-
dividually and not be punished for trying to upgrade their unit. He suggested that the
new parks comply but that an old unit should be able to be replaced with a new one if
the separation distances did not exceed those of the old one and would apply strictly
to the resident/owner and not a new owner.
Mrs. Regulski and Mr. Goodwin felt the ordinance could not address each hardship and
one had recourse to the Board of Adjustment and Appeal. Mr. Goodwin felt there should
be a clause in the ordinance to give guidelines to the BAAj i. e., increasing open space
would be one improvement.
Mr. Richter summarized that the staff is endeavoring to establish minimum requirements
to improve the quality of life in the mobile home parks and one must provide some in-
centive to improve the park aituations.
Motion was made by Mr. Canan, seconded by Mr. Turner, to approve the proposed zoning
ordinance text change with the added recommended changes presented by staff and where
all setbacks indicate five (5) and ten (10) feet to be four (4) and eight (8) feet.
Vote was 3-6. Motion defeated.
Motion was made by Mr. Mazurt seconded by Mrs. Regulski. to approve the proposed zoning
ordinance text change with the recommended changes presented by staff with the following
additional changes:
Sec. 131.115 (B)
A mobile home unit to be lorated on an established vacant mobile
home lot shQll be permitted provided that:
ADD:
(e) A mobile home unit which is to be a replacement of an existing
mobile home unit by the existing resident/owner cannot be erected
without the unit owner having prepared a plot plan to be filed
with the Building Department showing the location of any ad-
joining unit which is the basis for establishing separation dis-
tances; such plot plan and unit location to be prepared by and
bear the seal of a land surveyor licensed by the State of Florida.
The new unit shall not create lesser setbacks than as shown on the
p 10 t plan.
Vote was 1-8.
Motion defeated.
