Public hearing was held for the purpose of considering requested annexation and zoning
followed by public hearing for the purpose of considering items to be included in an
ordinance amend,ing the Land Use Plan and Zoning Atlas.
Tapes of public hearings are on file in the Planning Department.
On motion by Mr. Bickerstaffe, seconded by Mr. Canan, minutes of August 18, 1981 were
approved as written.
Planning and Zoning Board recommended as follows.
Annexation & Zoning:
1. Lot 5, Block A, Sallis Sub., Sec. 22-29-15 (Milner)
Request: Annexation & Zoning, CG, General Business
Above property is located on the east side of S. Missouri Avenue, south of Bellevue
Boulevard and north of Woodlawn Street.
Mr. Richter note4 there is an existing structure on the .19-acre site and plans are to
cenvert the single family residence to retail use. He stated CG zoning is consistent with,
the Land Use Plan and with other properties in the area. Applicant is requesting a waiver
of the parkland dedication.
Applicant was not present.

and consists of .628 acres
Attorney George Greer. representing the applicant. stated property is currently being
developed in the County as ~ strip center. Request is for a zoning designation of CG
and a Land Use Plan amendment from Low Density Residential to Commercial/Tourist
Facilities for a portion of the northeast corner of the property identified as Parcel 2.
The remainder of the property identified as Parcel 1 currently has a Land Use Plan
classification of Commercial/Tourist Facilities.
Mr. Richter stated the property to the north has been rezoned by the County to P-I.
Professional usage.
No citizen appeared either in support of or in opposition to above request.
Motion was made by Mr. Mazur. seconded by Mr. Goodwin, to recommend approval of above
requests (a) and (b) above. Motion carried unanimously.

Above property is located on the east side of Eldorado Avenue, west of Bruce Avenue and
south of Kipling Plaza, and consists of .40 acres MOL.
Attorney Harry S. Cline, representing the applicant. reviewed the background and history
of subject property, noting the property had been vacant since the 60's and, at present.
it is utilized as a parking lot for the overflow parking of beach patrons. He stated
the applicant plans to develop multi-family residential condominiums, with a maximum
of eight (8). incorporating parking underneath. Mr. Cline felt the configuration of
the three lots does not lend itself to single'family development. He commented that
a petition had been circulated and signed by 14 property owners in the immediate neigh-
borhood who stated their preference for a development in lieu of the existing situ~tion.
Mr. Theodore Tsagaris, owner of 43 Kipling Plaza. appeared in favor of above request.
stating proposed development would upgrade the surrounding neighborhood.
Those persons appearing in opposition follow.
Mr. Ed Mlrchibelli. 917 Mandalay Avenue, stated he feared a precedent would be set if the
proposed request were granted. He submitted a petition with 279 ,f~atures of persons
in opposition. He read a letter of objection from F. E. Sunderland, Vice Chairman of
Allkhe C.rlo~el Garden and Improvement Association. in addition to letters from owners of
properties to the north.

Mr. \ Richter reviewed the purpose for considering the Zoning Ordinance text change) stating
the' current provisions of the RMH District contained in Section 131.112 t.hrough Section
131.117 do not distinguish between standards for existing mobile home parks and those'
applicable to a proposed new park. He commented that when the p~oblem of lack of en-
forcement and compliance was brought to the attention of the City Manager in 1980) a
directive was ~hen issued by the Manager which set forth the basis on which permits for
mobile homes in existing parks would be considered. Mr. Richter emphasized that) at
present, the following s1~ations exist: (1) mobile home units cannot be replaced in
the CG, General Business Zoning District; (2) said units cannot be r~placed if they would
create a non-conforming structure to a greater degree than what had been located there
previously; (3) lot must be staked out with permanent markers where actual lot lines
exist. As a consequence) the City is initiating Code smendments to provide a distinction
in treatment of new vs. existing mobile home parks. The City is also initiating re-
%Oning8 to place existing mobile home parks in the RMH) Mobile Home District for the
purpose of providing applicable rules and regulations governing replacement and additions
for exilting mobile hom~s.

Mr. S. Curtis Kiser represented residents of the Kapok Mobile Home Park 'and he submitted
letters in objection to the proposed ordinance text change and change in zoning, con-
sisting of 51 names.
Mr. Robert Struchen, owner of Sunny Grove Park, questioned setbacks, as did Mr. John Ritchie,
owner of Hillside Mobile Home Park. '
Mr. B. Thompson, President of Mobile Home Park Owners Association, commented that mobile
home park residents expressed concern should they be required to move if condominiums
were built. Mr. Richter explained that in the proposed ordinance, as written, this
would not be allowed.
A letter was received from Mr. Lowell B. Easter, owner of Plaza Pines, o~jecting to the
ordinance text change.
Board members expressed concern that they needed additional time to study this text change.
Mr. Richter stated the proposed amendment would not affect the park residentst security
or anticipated longevity in the park. He felt that the revision would provide some
measure of assurance that as older mobile home units are replaced in the future, minimum
separation distances will be established, thus representing an improvement over existing
conditions.
Letters in opposition to proposed rezonings were received from: Ralph Englert and George
Bruning, partners of Happy Trails; Howard E. Jones for J. B. Nall, owner of Bayviewj
Walter Piper, partner of Gulf-to-Bay; and John tl. Oty, one of the owners of Green Acres
Mobile Home ,Park.
Mr. T. D. Hawkins of the Planning staff commented that staff had endeavored to project
20 to 30 years and, when turnovers occurred. most units would meet the setbacks as
proposed.

Motion was then made by Mr. Mazur, seconded by Mr. Bickerstaffe, to adjourn the meeting
for five minutes, come back and continue to discuss the proposed ordinance so that the
Board can give staff recommendations to come back with a revised ordinance for the next
meeting and that Items F, G, H, I and J on the agenda be continued until October 6, 1981.

Board members continued discussion of the revision to the proposed ordinance text change
