Bickerstaffe, Canan, Goodwin, Kuntz, Mazur and Turner; John D. Richter, Chief Planner/Current Public hearing was held for the purpose of considering annexation and zoning items followed by public hearing for the purpose of considering items to be included in an ordinance amending the Land Use Plan and Zoning Atlas. Tapes of public hearings are on file in the Planning Department. On motion by Mr. Bickerstaffe, seconded by Nr. Kuntz, minutes of August 4, 1981 were approved as written. Planning and Zoning Board recommended as follows. Annexation & Zoning: 1. East 17 ft. of Lot 14, Pinellas Groves Sub., NE 1/4 of Sec. 12-29-15 (Brunet) Request: Annexation & Zoning, ML, Ligh t ~Ianufacturing Above property is located on the north side of Range Road, west of Belcher Road. Subject site consists of .18 acres MOL and is presently planned industrial. /" Applic~nt Norman Brunet requested waiver of the parkland recommendation dedication. Request: Annexation & Zoning, RS-60, Single Family Residential (Abad) . . ,e Above property is located on the east side of Belcher Road, west of Nanor Blvd. Subject site is developed with a singie family residence. Mr. Richter stated an Agreement to Annex was executed for the property on October 17, 1979 and the City is now exercising its option to annex. Sub., Sec. 7-29-16 (Dohrman & Smith) Request: Annexation & Zoning, RS-60, Single Family Residential Above property is located west of the intersection of Arlington Place and Hemerick Place. Subject sites are each developed with a single family residence. Nr. Richter stated an Agreement to Annex was executed for the property on JanuaTY 31, 1977 and the City is now exercising its option to annex. The requested RS-60 zoning is consistent with the Low Density plan classi- fication and with the zoning placed on other lots \~ithin this subdivision previously annexed into the City. No one appeared either in support of or in opposition to above request. Sec. 5-29-16 (Sylvan Abbey United Methodist Church) Request: Annexation & Zoning, ISP, Institutional Semi-Public e . Above property is located south of County Road SO between U.S. 19 & lo'cMullen-Booth Rd. Subject site consists of 2.82 acres MOL. Mr. Mike Oliver, Pastor of Sylvan Abbey United Methodist Church, requested to have City water and sewer service for subject site. He also requested waiver of parkland dedication. ~tr. Richter stated that site plans were reviewed by the Resource Develop- ment Com~ittee on August 13, 1981 and were approved subject to the 'condition that a sidewalk be constructed adjacent to Main Street. Discussion ensued by Board members concerning the sidewalk. Nr. Bickerstaffe stated his concern of whether the sidewalk will be used or not. ~~. Richter stated that if the sidewalk isn't required.as a condition of the annex- ation, the City will likely no~ have the opportunity again to have the church guarantee that the sidewalk will be provided. , No, one appeared in support of or in opposition to above request. Motion was made by ~lr. ~Iazur, seconded by Mrs. Wulfeck, to recommend approval stating that the parkland dedication requirement be waived and that the applicant be required to install a sidewalk along the right-oE-way when deemed appropriate by the City of Clearwater. Motion carried unani- mously. Subject site is developed with a single family residence. 5. Mr. Richter stated that the applicant desires City sewer service. The requested RS-75 zoning is consistent with the 'Lo\~ Dens i ty plan classifi- cation and with the zoning placed on other properties within this sub- division previously annexed into the City. The applicant was not present. No one appeared either in support of or in opposition to above request. Motion was made by Mr. Mazur, seconded by Mr. Goodwin, to recommend approval of above request. Motion carried unanimously. 6. Lot 4, Block 8, Highland Pines First Add., Sec. 11-29-15 (Benson) Request: Annexation & Zoning, RS-SO, Single Family Residential Above property is located on the south side of Gentry Street, west of Ridge Avenue. Maclin Milner, Jr., speaker and pastor of Voice,of Faith Christian Center, Inc., requested to waive the application fees. No one appeared in favor of above request. Motion was made by Mrs. Wulfeck, seconded by Mr. Turner, to recommend approval of above request. Motion carried unanimously. Dock Applications: 1. Isle of Sand Key Condos - 1621 Gulf Blvd. (Cont'd from Planning & Zoning Board meeting of August 4) Above item was continued to allow sufficient time for subject plans to be approved by the Harbormaster for presentation to the Board. Request is to extend the existing marina 65 feet to the east and west, adding four slips on each end. " 0" e, .. Minutes of the Planning & Zoning Board - August 18, 1981 Page 1#5 Mr. L.M. Conklin, representing the applicant. stated the plans have been approved by the Harbormaster. Both ~Iills Development and the Isle of Sand Key will relinquish one boat slip. He stated that ~lills Development would not sign the agreement until their attorney could look at it. ~Ir. Conklin requested that the Board approve the plans in spite of the delay to sign the agreement. Mr. Pfeil then presented drawings of the new agreement. Mr. Goodwin stated concern with the prospect that ~lills Development may not be willing to sign the agreement. Mrs. Regulski requested that a letter of agreement be signed before the application is heard by the Board of Adjustment and Appeal on August 27, 1981. Mr. Richter stated another suggestion for approval that the slips be reserved for the exclusive use of the condominium residents and not for e~ale or lease to anyone other than those residents. ~Iotion was made by Mrs. Regulski, seconded by Nr. Goodwin, to approve the dock application subject to 'the completion and signing of the letter of agreement on removal of the tie poles. before the Board of Adjustment and Appeal meeting on August 27, and with the further provision that the slips be used for condominium owners only. Motion carried unanimously. 2. The Harbour - 1591 Gulf Blvd. (Cont'd from Planning & Zoning Board meeting of August 4) Above item was continued in order for Mr. Pfeil to make appropriate arrange- ments with the Department of-Public Works to insure that any dredging done in conjunction with the construction of these slips, be done in a manner which would not adversely effect the marine environment of the bay. Mr. Richter stated he was in possession of a letter from the applicant which has been reviewed by Mike Kenton. Assistant Director of the Department of Public Works. The letter establishes five conditions which satisfy the Public Works Department's concerns if incorporated as conditions of approval for this application. The five conditions are: (1) Public Works Department approve the location of all turbidity controls. silt screen, mesh size and spoil containment area design; (2) no keeled boats of deep draft boatsj (3) all dredging be done on the incoming or ebb tide; (4) all monitoring for turbidity be set up on a daily basis at the expense of the applicant; and (5) make for the public record recognition that this is indeed a dock application and that Planning and Zoning Board and Public Works Department stand on record as being opposed that this not to become a precedent-setting operation that would allo\~ further channel maintenance or more channels to be constructed to open water from this site. Mr. Richter suggested one more condition. The slips be used faT the exclusive use of the condominium residents and not for sale aT lease to the general public.
