Dennis, owner of Lot 5. requested that said lot be deleted from the application per letter dated February 27, 1981. Applicant Mr. Steve Brown, owner of Lot 2, stated he wished annexation in order to re- ceive City Services. Applicant Mr. Louis Shirley, owner of Lot 7, appeared in favor of requestion action. Several persons appeared in objection to the proposed application. Mr. Jack HolLand, 888 Forest Glen Road, submitted a petition in objection, signed by 30 individuals. felt the City of Clearwater did not offer the present time, as stated Ms. Josephine E. 'Mr. William Anderson, 765 Forest Glen Road, sufficient incentive for annexation at Ho lIand. Mr. William F. Knebel, 925 Forest Glen Road, cited proposed annexation as a further encroachment in the area and failed to understand the benefit which owners would derive. Mr. Healey emphasized the fact that those individuals ~ppearing in objection would not be required to annex as a result of the proposed application. ~ Motion wae made by Mrs. Regulski, seconded by Mr. Turner. to recommend approval of above request for Lota 2 and 7 and recommend approval of withdrawal for Lot 5 per Mr. Dennis' letter dated February 27, 1981. S',ngle Family Residential Above property is located between Landmark Drive and McMullen-Booth Road, approximately 550 feet south of Curlew Road. and consists of a total of 16.4 acres MOL. Mr. Elli M. A. Mills. President of Mills Land Development Group, Inc., owner of several lots. represented the applicants, including five individual property owners. He reviewed the background and history of subject property, stating that Mills Development had ac- quired it in July, 1980. Mr. Mills identified the several conditions to the Petition for AnnexBtion and explained that his company and the individual lot owners are jointly requesting annexation at this time in order to. facilitate the process. The following persons appeared in support of the proposed annexation: Tony Eman, owner of Lot 22j Dr. Lloyd Tabb, owner of Lot 24; and Roger Rolfe, owner of Lot 25. They ex- pressed the desire to receive the benefit of City Services and that they. as residents. would contribute to the City's tax base. They were, however. opposed to making payment for park related purposes. No one appeared in opposition to the proposed annexation. Mr. Healey enumerated several environmental features including vegetation, water table, soils. elevation and the portion of the property within the IOO-year flood plain. He designated the contours of the land on the map. explainin~ that the eastern portion of the property is at an extremely low elevation so as to place it within the 100-year flood plain and that he desired these specific concerns to be made a part of the record. Further, Mr. Healey stated this subdivision had been reviewed by the Resource Develop- ment Committee and the members were unanimoualy opposed to the proposed annexation due primarily to the elevation of several of the platted lots and corresponding drainage concerns. A letter dated February 5. 1981 had been received from Mr. Gerald J. Leach, Vice President of The Mills Land Development Group, Inc., wherein it was stated that the application for annexation is conditioned upon the City of Clearwater agreeing to five (5) conditions, which conditions Mr. Healey enumerated and is hereby made a part of the record. Mr. Mills expressed the opinion that if the individual lots camp. in one by one for annex~tion, the City would accept them on this basis without payment of park fees. Mr. Roger Rolfe stated that if he applied for annexation as an individual his property would not be contiguous to the City limits. Dr. Lloyd Tabb stated his house is now under construction and was of the opinion that the majority of lots are over 10 feet above sea level. Mr. Gerald J. Leach, Vice President of Mills Land Development Group, Inc., stated there were drainage problems in the area over two years ago, stemming from Countryside, but since that time improvements have occurred. Further, DER had endorsed drainage plans and run-offj County Engineering Department had worked with the drainage plan and ap- proved same; and plat has been recorded and signed by the Board of County Commissioners. Mr. Healey enumerated the follOWing conditions to the annexation as a recommendation from staff: (1) 20-foot right-of-way dedication for Landmark Dri ve on lots that abut the eastern boutd ary of said right-of-way; (2) payment made in lieu of parkland dedication, such payment to be negotiated with applicants based on predevelopment value of property and number of lots involved in the application; ,(3) developer and/or existing property owners bear the cost of installing the sewer laterals 'to the individual properties so as to connect each pro~rty to the public system; and (4) covenant as to the establishment of the subdivision other than under the City Jurisdiction and to recognize existence of lots in the flood plain' below the applicable 'flood hazard elevation and the need to comply with appropria te requirements. -Mr. Bickerstaffe emphasized that he would like' to see a notation in the property deed to the effect that the owner, being awa~e of the low~lying landt would accept the responsibility. He felt individualst in contemplation of purchasing said property, should' be advised of what they might expect. Mr. Gillen- waters stated he has no immediate plans for construction but will eventually propose to utilize the property consistent with this application.
