the City Zoning Atlas followed by public hearing for the purpose of considering ordinance
text change to amend Article XXX, Sec. 30.07; XXXV, Board of Adjustment and Appeal on
Zoning, Sec. 35.09 (5) (a) (2); and XXXV. Zoning Appeal Hearing Officer, Sec. 35.10 (F) (1).

Above property is located between Proapect and Booth Avenues, north of and abutting Grove
Street. The area is developed with residences and offices and consists of .85 acras MOL.
Mr. Healey reviewed the background and history of above request, stating that said area
was the subject of a recent Land Use Plan amendment to Commercial/Tourist Facilities ap-
proved by the City Commission on October 16, 1980. However, on January 21, 1981 the
Pinellas County Planning Council denied the Land Use Plan change from Residential/Office
to Commercial/Tourist Facilities for this property. Mr. Healey pointed out that in
order to resolve the existing conflict of the CG zoning with the Residential/Office
Land Use Plan classification on subject property, and confronted with the County's denial
of an amendment to the Land Use Plan for a Commercial/Tourist Facilities classification,
the City is seeking to amend the Zoning Atlas to a PS (Professional Services) District
compatible with the present Residential/Office Land Use Plan classification. Further,
legislation dictates referral to the Planning and Zoning Board for recommendation to
adjust the zoning to coincide with the Land Use Plan.
No one appeared in support of the proposed request.
Mr. Chris De Maio, realtor and contractor at 124 Booth Street, appeared in opposition.
He stated that, as the owner of Lots 11 and 12, he feels subject property is not suitable
for professional usage.

200-ft. area of subject property were in objection and that, due to a postponement of
this item by the Pin~11as County Planning Council, they were not afforded an opportunity
to appear in opposition and were unaware of the January 21 meeting.
Mr. Healey enumerated the .1ternatives and considerable discussion ensued.
Motion was made by Mr. Bickerstaffe, seconded by Mr. Goodwin, to recommend denial of
above request and recommend reapplication to the Pinel1as County Planning Council for
rehearing inasmuch as property owners missed the opportunity to be present and voice
their opinion due to the postponement of the hearing. Motion carried unanimously.
To consider Ordinance Text Change of the
Code of Ordinances of the City of Clearwater by:
1. Amending Article XXX, Sec. 30.07 Waterfront Property Setback (3) (d) to
add new paragraph 4 to clarify intent and correct cumulative unrelated
bonus provisions.
Mr.. Healey explained the recent changes to the Code and stated clarification was needed
as it relates to height bonuses on waterfront property. There is a provision whereby
a height bonus may be given when waterfront property meets the setback requirements.
Since the time this ordinance was adopted a separate provision has been interjected for
height bonus where grade level parking under the building is provided. Recent changes
are being compounded or used in conjunction with the earlier provision to defeat the
purpose of the height limitation. Result is an additional one story where it is least
appropriate.
Mr. Bickerstaffe stated he had no objection to additional height as long as density
was not increased and parking was off the streets.
Mr. Goodwin inquired as to the power of the Resource Development
when a site plan is submitted and desire is to implement the two
said that, although not explicitly intended, both are permittedt
rent wording of the Ordinance.

of above request (1) as presented. Vote was 4-4.
Motion was then made by Mr. Mazur, seconded by Mr. Turner, to recommend that the wording
as shown be revised to reflect that no additional building height bonus can be applied
to the additional adjustment of the building height based on the grade level being
~devoted in part to off-street parking. Motion carried 5-3.

Mrs. Regulski gave a short report on the symposium entitled "Strictly for Zoning
Officials" held in Tampa on February 6. Board members expressed their appreciation
to the Planning Director for the opportunity to attend.
Mr. Healey informed Board members of the progress made with the consultant contract
and stated he will keep the Board advised as to the upcoming meeting schedule and items
that will be addressed.
