He stated the request is to allow for expansion of planned commercial uses and future development of a self~ service storage facility. Lots 2 & 3 ~ere approved in September, 1980 to be sub- divided without replat by the City Commission. Above proposed Article XXXVI was continued in order to properly reflect the Board's concerns. Mr. Healey reviewed a memorandum outlining the purpose and procedure of the measure as well as proposed adjustments thereto. Commissioner Garvey was pr~sent and stated her concern as regards someone who wishes to engage in the preparation of art works and comply with the law. At the present time. there is no medium whereby this individual can obtain a business license with the home address. Board members cited similar examples and discussion ensued, including types of businesses that could logically be conducted from a home. Upon vote being taken! both the amendment and the main motion carried unanimously. Dock Application - Sand Key Yacht & Tennis Club Mr. Germany, AAA Marine Company! appeared before the Board. Request for a special exception is made for construction of three separate sites in an.RM-28 zoning district. Mr. Healey located the property for the Board members as the area behind of Sand Key, said property being previously named the Sand Key Yacht and At the present, name has been changed to the Harborage. the Is 1e Tennis Club. 40 slips are proposed which would be allowable as the RM-28 zoning district pe~its same as an adjunct to residential use as a special exception. Mr. Germany stated three sites are involved -- site #1 would propose 14 slips; site 12, 16 slips; and site 13 would be utilized by all condominium owners as a recreational area. He stated the slips would be a separate condominium entity available only to the residents of the residential condominium. Concern was expressed regarding maneuverability of large boats but the Board was assured it would prove adequate. Mr. Healey Btated t.hat, in terms of location, size and arrangement. there should not be any problems, but cited the following concerns: (1) assurance that the marina facilities be related to the buildings as they are erected; and (2) that ownership and use of the docking facilities be limited to residential unit owners~ Motion was made by Mrs. Regulskit seconded by Mr. Scheideman, of the dock application with the following provisions: (1) docking facilities and condominium ownership be defined; and (2) building permits and permits for marina facilities for sites 1.. 2 and 3 be coordinated with one ano.ther.
