Mr. Healey pointed out that three blocks to the north of the property, the area is designated Residential/Office and to the east and west the properties are used for residential purposes. He noted that the service station, hair replacement shop and the Carriage House are all non- conforming and, as such, th~ usage could be continued. It was Mr. Healey's feeling that extension of the Commercial cat~gory would encourage intrusion into the Garden Avenue neighborhood. This area, if retained in Residential/Office, would be amended to a PS, Professional Services, zoning district which would allow for appropriate and reasonable use. Board members sought re-affirmation that the three shops now non-conforming could still continue their operations and were so assured. High Density Multi-family Xoninll: From: To: Above property is located between Pierce and Franklin Streets, west of S. Evergreen Avenue and east of Waverly Way, including vacated Lady Mary Drive. It consists of 4.7081 acres and is currently vacant. Requested land use category is in conflict with the l'inellas County Land Use Plan and will necessitate an amendment to that l'lan. Mr. Elwood Hogan, Trustee for ten local businessmen, appeared before the Board. He presented the background and history of the property, stating his clients had pur- chased said property April 10, 1979. Land Use Plan became effective in November, 1979 and his clients were unaware of Medium Density classification. At the time the City had a sanitary sewer line with no easement but that an agreement was reached on December 28, 1979, whereby the sewer easement was given to the City. Mr. Hogan stated the unita need to be 4 stories in height due to drainage and that the Engineering Department had approved same. The Engineering'Department had stated a sloped area should be worked out and, having done this, i~ cut down the number of units. 80 units are planned, with a total of 5 buildings. The following persons appeared in opposition: Curry. George James, Norman Liege and Cecelia Among their concerns were: (1) history of subject property when Minnesota-Ohio wished to vacate Lady Mary Drive and rezone to high density (September, 1977; (2) people purchased their property in duplex and triplex area and this would change the character of the area; (3) creek overflows and there is a flooding problem; (4) opposition to high-rise buildingsi and (5) possible creation of a traffic problem in the school area. Mr. Healey reviewed the background of the property and stated the City Commission had refused to rezone the area now designated RM-l2 to RM-28 in 1977 and directed the l'lanning Department to make a study of the area. As a result of the study, the property was classified Medium Density Residential in the Plan andt absent any specific proposal to do otherwise, would be zoned RM-12 in its entirety. Mr. Healey alerted the Board members that 100 units of low-cost housing for the elderly are proposed for approval on a portion of the St. Cecelia's property to the south. Thia it~m will come before the Board at a future date. Board members Regulski and Gildersleeve expressed concern regarding drainage. Mr. Gildersleeve desired to see the character of the area maintained but recognized the need for housing. -" In reply to the drainage situation, J. LaLonde, engineer for E.M.I. Engineering, stated that a detention and retention area are planned on the site to adequately handle drainage. Under Board and Staff Comments, Mr. Bickerstaffe stated that building a scale model of structures and proposed development pattern on the mid-beach would be advantageous in analyzing the zoning. Inasmuch as the City Commission had proposed an alternative to the mid-beach rezoning at their last meeting; i. e.) building maximum of 40 feet, Mr. Healey asked the Board members for their input and comments for transmittal to the City Commission. Mr. Bickerstaffe expressed concern re vista and Mr. Tice stated that the people with whom he had talked felt the cap of 40 feet was a good idea to implement. Mr. Gildersleeve stated it is short-sighted to look at height alone. After considerable discussion, the ~jority comment of the Planning and Zoning Board was to the eff~ct that they were unclear as to how a building height cap would work in conjunction with other requirements of density, vista and setback. It was the Board's observation that' building height is not the only consideration and must be considered together with such factors as existing use, character of the area and pro- posed pattern of development.
