Bickerstaffe, Gildersleeve, Kuntz, Scheideman, Tice and Turner Absent: Mr. Dimmitt Public hearing was held for the purpose of considering requested annexation and zoning item followed by public hearing for the purpose of considering items to be included in an Ordinance amending the City Zoning Ordinance, Appendix A. Clearwater City Code. Tapes of public hearings are on file in the Planning Department. Chairman Hall welcomed Mr. Bickerstaffe to the Planning and Zoning Board. On motion by Mr. Tice, seconded by Mr. Gildersleeve, minutes of November 6, 1979 were approved as written. Planning and Zoning Board recommended as follows: Annexation & Zonin~: 1. Lot 8. Pinellas Groves Sub. in NW~ of SE~ of Sec. 12-29-15 Request: PS, Professional Services (Woodley) Above property is currently vacant and located on the east side of Hercules Avenue south of Palmetto Street. Request will require a Clearwater Land Use Plan change and a County Land Use Plan change. An additional 7-foot right-of-way for Palmetto Street is required, making a total of 40-foot half right-of-way. A 30-foot right-of-way and utility easement are required along the south property line. A la-foot drainage and utility easement will be required along the east side of the property. MOtion was made by Mr. Tice, seconded by Mr. Scheideman, to recommend approval of above request, subject to the necessary rights-of-way and utility easements as requested by the Engineering Department. Home) Request - From: RM-20 (High Density Multi-family) To: RM-28 (High Density Multi-family) 1. Above property contains 20.4 acres and is located east of Village Drive, west of Florida Power right-of-way, north of Enterprise Drive and south of Countryside Boulevard. Mr. Prank Bosworth, architect, represented the applicant Florida Condo Division of U. S. Home Corp. He stated unusual site planning problems and the need to increase the height to four stories (plus loft in some of the units) as the reason for the request. Mr. Bosworth stated it is not their intention to increase the density of the proposed project but to develop the number o~ units permitted under the RM-20 zoning classification. This arrangement would provide for a greater amount of open space for the residents. The possible appli~ation of the variance process was questioned and Mr. Healey stated there were no proper grounds for a variance. It was merely a matter of preferred design. Consensus of the Board was to consider the requested change in zoning in the abstract and not observe the site plan available. Mr. Tice expressed concern that shoUld the subject .property be rezoned to RM-28 classification, the applicant could proceed to optimize the maximum density. Board members discussed the possibility of RPD zoning category and, upon deciding thia to be a more appropriate zoning, asked to see the site plan. The proposed project consists of 408 units (10 separate buildings - two 3-story and eight 4-story units). Mr. Bosworth stated this project would supply a broad range,of units, fro~ efficiencies to 2-bedroom units, at a moderate cost. The units would be condominiums but with an urban-type apartment concept. He stated ,this property becomes a buffer between high intensity use of commercial and the residential properties to the east. He alia cited another reason as the undesirable con- dition at low tide on the corner of hi. property. There i8 3 silt problem from run-off and the water is usually no more than 1-2 feet deep. The construction of this catwalk would not eliminate tho odor but would aid cosmetically. Mr. Healey stated his concern with the catwalk being utilized as an extended use of the property. He felt this could establish a precedent for other than marine- related purpose.. He allo exprelled concern with any interference with use of the adjoining property. Mr. Sykes Itated the adjoining neighbor does not object. Mrs. Parka expressed concern with the trend of boat docks being constructed to extend the backyard. in order that residents may take advantage of the sun in the winter. After considerable discussion, motion was made by Mr. Scheideman, seconded by Mr. Tice, to recommend approval of above request. to.the Board of Adjustment & Appeal. Motion carried unanimously. Mr. Healey asked the Board for further comments concerning the proposed Code amend- ment that would establish the Zoning Appeal Hearing Officer process. Board members will again review the proposed ordinance and direct any additional comments to the Planning Director prior to the next City Commission meeting.
