Attorney Harry S. Cline appeared before the Board Bnd described the project proposed
by Mr. John Mancini. Thirteen single family residences are proposed on this property.
He stated that the land does not lend itself to RS-200, Single Family Residential
Diatrict zoning classification and that the requested RPD zoning classification will
preserve the large estate and character of the property; also the large oak trees,
with one or two exceptions.
Mr. Kurt Youngstrom, architect for the project, elaborated on the plans and presented
charts and graphs, including lot sizes and tabulations of the adjoining area. Said
data was compiled from information prepared by the Harbor Oaks Association. He
stressed the point that it was their intent to preserve the bluff, oak trees, and keep
the preservation in line with the City's plan.. Zero lot lines are proposed for
several of the lots.
In his presentation, Mr. Youngstrom noted the following variances from the normal
standards for the project: (1) height to approximate 2\ stories on the lots abutting
the main house in order to conform to its structural characteristics; (2) private
roadway to be smaller than City standards in order to conform with the roadways in
Harbor Oaks; and (3) setbacks to vary to accommodate unique setting. Mr. Healey
indicated that deviation in density, lot size and building coverage is also part of
the plan.
A.home owners association will be formed, including an Architectural Review Committee,
to insure that housing plans will conform to the present development.
Mr. Alfred Hoffman, 802 Druid Road, appeared in opposition. He expressed several
concerns; namely, the RPD plan constitutes a 307. increase in density over that per-
mitted in RS-200. He was of the impression that the property would be developed at
the'same density as RS-200. Further, he stated that said project does not maintain
the integrity, of the waterfront properties from just north of the property to the
termination of Harbor Oaks~to tbe.,ou~n anq.that ,~he:main house would be decimated
by utilizing the front yard as cooperative space. In summary, he felt the concept
of RPD would take away the waterfront and would not be in keeping with good planning
standards.
Mr. Cedio Saltarelli, President of Harbor Oaks, expressed concern rem tive to the
density of the project. In response, Mr. Healey stated that RS-200 permits only
2.2 dwelling units per acre whereas the proposed project would allow 2.5 dwelling
units per acre.
Mrs. Constance Mudano, Volunteers in Pteservation, stressed the historical signi-
ficance of the main building and stated that the Florida Review Committee for the
National Register of Historic Places approved the nomination of the Donald Roebling
Estate at its meeting of September 13, 1979. She expressed concern regarding the
entrance of the house and felt it required additional space for its setting in
order to maintain the present character. She mentioned the City's Historical
Preservation Plan and reviewed the action of the City Commission in July. 1979
concerning rezoning properties to RS-200, Single Family Residential.

Ms. Jan MacNutt, 322 Magnolia Drive, stated that the southernmost one-third of the
property should be recognized as an area of historical significance consistent with
the Hiatoric Preservation Plan.

Mr. Healey expressed the following concerns:

Farther, Mr. Healey stated the proposed plan is a major departure from the existing
character of the estate and reminded the Board it is being asked to amend the
zoning map based on a specific plan under the RPD provisions.
Mr. Gildersleeve expressed several concerns. He felt it was the Board's duty to
protect the property with respect to its historical significance and that the plan
is at odds with the objective. He noted particular concern over the road extending
down the bluff.
Mrs. Parks expressed the feeling that the neighborhood is unique and sensitive and
the manner in which this pDOject.is.~eloped would affect the entire neighborhood.
She felt the developer should return with a plan showing lower density and one that
would address itself to the concerns and recommendations made by staff.
MOtion was made by Mr. Gildersleeve, seconded by Mrs. Parks, to recommend denial
of above request. MOtion failed 2-3.
Considerable discussion ensued. It was the consensus of the Board members that the
RPD designation would be a satisfactory one but that the plan had several short-
comings.
Public hearing recessed at 3:45 PM in.order that the applicant might discuss modi-
fications to the plan for presentation to the Board. '
Planning and Zoning public he8ring reconvened at 3:55 PM.
Mr. Youngstrom stated they would be willing to modify the plan as follows:
(1) shorten the cul-de-sac so that it would not extend westward of the care-
taker's wing of the main house; and (2) omit one lot and make Lots Ull and 12 deeper.
After considerable discussion and review by the applicant, Board and staff,
Mr. Healey stated there were still problems with the plan and that the one sug-
gested change did not represent an adequate solution, in his view.

Motion was then made by Mr. Tice to recommend approval of the requested zoning
'amendment with the plan to be revised as outlined by the architect in order that
he might proceed. Motion died for lack of a second.
The applicant's representatives indicated their preference for a Board decision
that would allow them to proceed to the Commission. 8S opposed to submitting a
revised plan.
MOtion was then made by Mrs. Parks, seconded by Mr. Gildersleeve, to recommend
denial of the plan 8S originally submitted. Motion carried 4-1.

Section 35.10 Zoning Appeal Hearing Officer
(A) Purpo.e - The purpose of thi. Section is to provide a process for
appeal of a decision of the Board of Adjustment and Appeal on
Zoning at the administrative level prior to any available recourse
in a court of law. It i. further the intent of this Section to
provide such administrative relief in the most professional.
objoctive and equitable manner possible through the appointment
of a Hearing Officer and the establishment of the proce.s by which
the appaa1 ~s conlidered.
(B) Procedure for Appeal - Shall be according to the following:
(1) Any par~of interest affected by the decision or any representative
of the City acting at the request of the City Manager may appeal
the decision of the Board of Adjustment and Appeal on Zoning to
the Zoning Appeal aearing Officer.
(2) Appeals to the Zoning Appeal Hearing Officer shall be commenced .
through the filing of a notice of appeal with the City Clerk within
ten (10) days of the decision of the Board of Adjustment and ~ppeal
on Zoning.
(3) The notice of appeal shall set forth in detail the basis of appeal
in relationship to the requirements of Appendix A, Zoning. Code of
Ordinancu.

(4) The City Clerk aha11, in concert with the Hearing Officer. establish
the date and time for hearing the appeal, which date shall be not
1e.. than fifteen (15) days or more than forty~five (45) days from
the date of notice of appeal, unless otherwise requested by the
appellant. .
(5) The public haaring before the Hearing Officer shall be advertised
and the .urrounding property owners notified consiatent with the
provisions for luch advertisement and notice for hearing before the
Board of Adjuatment and Appeal on Zoning set forth in Section
35.09 (4).
(6) The City Clerk Ihal1 prepare a verbatim transcript of the pro-
ceedings bofore the Board of Adjustment and Appeal on Zonins.
.uch tran.cript to be available at least one week ahead of the
date of public hearing. The co.t of luch transcript will be
paid by the appellant, in addition to the fee for appeal from
the Board of Adjultment and Appeal on Zoning 81 est.bli.hed by

(E) Zoning Appeal Hearing Officer - The appointment, term of duty, qualifica-
tion., conduct and removal of the Hearing Officer shall be aa follovs:

(1) The City Commiseion shall appoint two (2) Zoning Appeal Hearing
Officers from among three or more persons recommended for such
pOlition b~ the City Manager.
(2) Th. Zoning Appeal Hearing Officers shall be appointed for a term
of two (2) yearl, except one of the initial appointments shall be
for one (1) yaar 10 that the terms of the officers vill be Itasgered
,with respec~ to the termination date of the appointment. A Hearing
Officer may be reappointed to one or mora sub.equent terms at the
conc1ulion of a previoul term of appointment, in accord with the
provilions for initial appointment.
(3) A person recommended for appointment as Zoning Appeal Hearing Officer
shall have a recognized degree in law, architecture, plenning or
ensineering and be duly licensed or certified to practice such pro-
fellion in the State of Florida. Such persons shall further have
practiced their profes.ion for a minimum of three (3) years and be
knowladgeable in the field of land use planning and land use regu-
laUons.
(4), NO,Hearing Officer 'shall act as agent or attorney or be otherwise
involved with any land use plan'or zoning ordinance matter which
will come before the City during the term of the officer's appoint-
ment. Further, no Hearing Officer shall initiate or consider ex
,parte or other communication with any party of interest to the
hearing concerning the subltance of any proceeding to be heard by
the officer; except such expert advice as the officer may determine
appropriate aad solicit.
(5) Any Zoning Appeal Hearing Officer, once appointed, shall be removed
only by the City Commis.ioD, for due cause shown.
(6) In the event that an appointed Hearing Officer is not available for
or removes himlelf fro~ a particular ca.e, the City Attorney shall
be authorized to act as'Hearing Officer for that specified appeal.
Where this occurs, the City Attorney or his staff shall not otherwise
participate in the hearing_

(7) The City Clerk Ihall assign each appeal as received by the City
Clerk on a confidential rotation basis to the designated Rearing
Officer.
. (F) Powers and Dutiel of Hearing Officer ~ The authority of the Hearing
Officer shall be .s follows:
(1) To schedule end hold a public hearing on an appeal from a decision
of.the Board of Adjultment and Appeal on Zoning under the provisions
of Section 35.07 (7) and (8) with respect to the grant or denial of
a.variance or special exception, respectively.

To receive and conlider the record of the appeal from the Board of
Adjultment and Appeal on Zoning.

Therefore, the City Conunission and the City Manager have directed

requirements.

The attached draft attempts to establish attendance requirements with
the intent of giving the responsibility for dismissal to the City Manage.t.
Although Section 2-68 gives the authority for dismissal to the City
Conunission, Section 2-69 allows for each board to adopt their own
rules governing attendance. Therefore, if this particular board adopted
rules similar to those in the attached draft, the City Manager could
act administratively and changes to the ordinance would not be required.

Section 2-69 - Officers and Bylaws:
States that each board shall adopt rules ~nd regulations to govern its
proceedings including rules and regulations governing attendance and
keep a correct record therefore (Ordinance 1#1664).
Therefore, a suggested procedure wou1~ be as follows:
1. Three absences allowed per year for conflict in schedules, providing
that prior arrangements are made with the secretary to assure a quorum
