Cline appeared before the Board Bnd described the project proposed by Mr. John Mancini. Thirteen single family residences are proposed on this property. He stated that the land does not lend itself to RS-200, Single Family Residential Diatrict zoning classification and that the requested RPD zoning classification will preserve the large estate and character of the property; also the large oak trees, with one or two exceptions. Mr. Kurt Youngstrom, architect for the project, elaborated on the plans and presented charts and graphs, including lot sizes and tabulations of the adjoining area. Said data was compiled from information prepared by the Harbor Oaks Association. He stressed the point that it was their intent to preserve the bluff, oak trees, and keep the preservation in line with the City's plan.. Zero lot lines are proposed for several of the lots. In his presentation, Mr. Youngstrom noted the following variances from the normal standards for the project: (1) height to approximate 2\ stories on the lots abutting the main house in order to conform to its structural characteristics; (2) private roadway to be smaller than City standards in order to conform with the roadways in Harbor Oaks; and (3) setbacks to vary to accommodate unique setting. Mr. Healey indicated that deviation in density, lot size and building coverage is also part of the plan. A.home owners association will be formed, including an Architectural Review Committee, to insure that housing plans will conform to the present development. Mr. Alfred Hoffman, 802 Druid Road, appeared in opposition. He expressed several concerns; namely, the RPD plan constitutes a 307. increase in density over that per- mitted in RS-200. He was of the impression that the property would be developed at the'same density as RS-200. Further, he stated that said project does not maintain the integrity, of the waterfront properties from just north of the property to the termination of Harbor Oaks~to tbe.,ou~n anq.that ,~he:main house would be decimated by utilizing the front yard as cooperative space. In summary, he felt the concept of RPD would take away the waterfront and would not be in keeping with good planning standards. Mr. Cedio Saltarelli, President of Harbor Oaks, expressed concern rem tive to the density of the project. In response, Mr. Healey stated that RS-200 permits only 2.2 dwelling units per acre whereas the proposed project would allow 2.5 dwelling units per acre. Mrs. Constance Mudano, Volunteers in Pteservation, stressed the historical signi- ficance of the main building and stated that the Florida Review Committee for the National Register of Historic Places approved the nomination of the Donald Roebling Estate at its meeting of September 13, 1979. She expressed concern regarding the entrance of the house and felt it required additional space for its setting in order to maintain the present character. Mr. Gildersleeve expressed several concerns. He felt it was the Board's duty to protect the property with respect to its historical significance and that the plan is at odds with the objective. He noted particular concern over the road extending down the bluff. Mrs. Parks expressed the feeling that the neighborhood is unique and sensitive and the manner in which this pDOject.is.~eloped would affect the entire neighborhood. She felt the developer should return with a plan showing lower density and one that would address itself to the concerns and recommendations made by staff. MOtion was made by Mr. Gildersleeve, seconded by Mrs. Parks, to recommend denial of above request. MOtion failed 2-3. Considerable discussion ensued. It was the consensus of the Board members that the RPD designation would be a satisfactory one but that the plan had several short- comings. Public hearing recessed at 3:45 PM in.order that the applicant might discuss modi- fications to the plan for presentation to the Board. ' Planning and Zoning public he8ring reconvened at 3:55 PM. Mr. Youngstrom stated they would be willing to modify the plan as follows: (1) shorten the cul-de-sac so that it would not extend westward of the care- taker's wing of the main house; and (2) omit one lot and make Lots Ull and 12 deeper. After considerable discussion and review by the applicant, Board and staff, Mr. Healey stated there were still problems with the plan and that the one sug- gested change did not represent an adequate solution, in his view. . MOtion was made by Mr. regular meeting of the lack~of a second. Scheideman to continue the discussion until the next Planning and Zoning Board (October 16). Motion died for lack of a second. Section 35.10 Zoning Appeal Hearing Officer (A) Purpo.e - The purpose of thi. Section is to provide a process for appeal of a decision of the Board of Adjustment and Appeal on Zoning at the administrative level prior to any available recourse in a court of law. It i. further the intent of this Section to provide such administrative relief in the most professional. objoctive and equitable manner possible through the appointment of a Hearing Officer and the establishment of the proce.s by which the appaa1 ~s conlidered. (B) Procedure for Appeal - Shall be according to the following: (1) Any par~of interest affected by the decision or any representative of the City acting at the request of the City Manager may appeal the decision of the Board of Adjustment and Appeal on Zoning to the Zoning Appeal aearing Officer. (2) Appeals to the Zoning Appeal Hearing Officer shall be commenced . through the filing of a notice of appeal with the City Clerk within ten (10) days of the decision of the Board of Adjustment and ~ppeal on Zoning. (3) The notice of appeal shall set forth in detail the basis of appeal in relationship to the requirements of Appendix A, Zoning. Such persons shall further have practiced their profes.ion for a minimum of three (3) years and be knowladgeable in the field of land use planning and land use regu- laUons. (4), NO,Hearing Officer 'shall act as agent or attorney or be otherwise involved with any land use plan'or zoning ordinance matter which will come before the City during the term of the officer's appoint- ment. " The attached draft attempts to establish attendance requirements with the intent of giving the responsibility for dismissal to the City Manage.t. Although Section 2-68 gives the authority for dismissal to the City Conunission, Section 2-69 allows for each board to adopt their own rules governing attendance.
