Minutes of the Planning & Zoning Board - September 11, Page 12 1979 Mr. Frank Morrow, resident of Island Estates, 'inquired concerning the size of the dock and its projection into the channel. He expressed concern that such a pro~ jection would take the water rights away from the public. He also questioned the procedures followed in gaining approval for said construction, emphasizing they should be followed to the letter, and that the Rules of Declaration of Condominiums are clear-cut on this matter. Mr. Maurice Washer appeared in opposition. He stated that 21 to the construction of the dock previously; now it is only 17 or 22 persons objected or 18. He questioned the legal authority to request a special exception and stated that, in his opinion, there would be an overflow of boats and parking. Further, leases were granted on the first 6 dockR which enhanced certain apartments and reduced the value of others. Mr. Phail addressed several of the points of concern to Mr. Washer and stated that the plan has to be submitted to several agencies for further approval. Mr. Paul Vogel, resident of Bayhouse Condominium, stated the Board had voted unani- mously on the first dock and it has increased the value of their property. Mr. Healey pointed out the following: (1) proposed dock extends over 100 ft. from the seawall; (2) nature of the dock is a 2-tier arrangementj and (3) it has been somewhat of a piece-maal arrangement and that perhaps in the future additional resi- dents would desire a dock, requiring further additions. Mr. Tice questioned whether there was room for 56 units inasmuch as there only exists 407~ ft. of waterfront. Motion was made by Mrs. Parks to recommend denial of above request. lack of a second. It is presently in an RM-12 district. Mr. John Sullivan, Regional Vice President of Cameron~Brown Co., represented the applicant. Plans are for one-story attached units to be marketed as fee simple townhouses. 80 dwelling units in 16 buildings are proposed. Article II, paragraph 58, Article XXXIV, Section 34.02, Article XXXV, Section 35.09 (7) - To provide definition for portable buildings and to further provide regulations, permitted uses and criteria for granting a special exception Mr. Healey stated the change is requested to provide a definition for portable buildings, provide regulations, permitted uses' and criteria for granting a special exception designed to deal with a series of situations which have previously occurred. Ordinanc~ changes were discussed in detail, item by item. Discussion ensued. No one appeared in support or objection. Motion was made by Mrs. Parks, seconded by Mr. Turner, to recommend approval of above per the following: (1) the new portion of the Zoning Code proposed to be included under Section 34.02, Land use permits, be repositioned in the Code as a new section (30.12) under Article XXX, Supplementary Regulations Applying to a Specific, to Several, or.to All Distdcts; (2) Paragraph (e) be amended to read....."no portable buildings shall be used on public or private property....." and (3) a paragraph be included to allow portable structures to be used for emergency housing. Motion carried unanimously. A copy of the changes proposed is attached hereto and made a part of the 'record thereof. 2.
