John Lessl, of Ogle and ~'laters, informed the Commission that to use a final
salary benefit formula instead of final average salary would be an additlo~QI cost
of 12-13%.

Discussion ensued regarding the form of the questions on the referendum
ballot. The City Manager suggested the consensus items could be lumped into one or
two ballot questions; the items on which there is no conscnnus could be separated
into separate ballot questions.

Mike Stuart stated the Pension Rewrite Committee could have come to a
consensus on some of the items if they had more time.
John Nicholson, of the Pension Advisory Committee, questioned why the pension
changes had to go on the ballot in November. The possibility of delaying the
election was discussed. The City Manager stated the issues are so complex that
they have not been addressed previously, and he feels the pension changes should
be made as soon as possible.
Discussion ensued regarding whether the costs of the proposed pension changes
would need to be on the ballot. It was determined it is not a requirement. The
Ci ty Manager stated if the cost figures were put on the ballot, it would be
confusing to the voters.
Charlie Dunn, Chairman of the Pension Advisory Committee, suggested the
Commission look at the proposed changes, see what they agree and disagree with, and
try to solve the non-consensus.

2) Disability Benefit, Service Related There are three considerations
proposed: 1) if the disability is service related, there will be a minimum benefit
equal to 50% of final average salary; 2) if the disability is service related,
there will be a minimum benefit equal to 75% of final average salary for those
employees eligible for non-hazardous duty personnel. If the disability is service
related there will be a minimum benefit of 60% of final average salary for those
employees eligible for hazardous duty pension provided, however, that the benefit
payable will be equal to 3% of final average salary per year as opposed to 2-1/2%
of final average salary per year. (This 3% of final average salary would also
apply to normal retirement for hazardous duty personnel); 3) if the disability is
service related, there will be a minimum benefit equal to 75% of final average
salary. If an employee receiving a disability benefit receives additional
compensation as a result of engaging in any other occupation, the disability
benefit will be adjusted annually by 50% of any such compensation received after
total compensation (pension plus other income) exceeds the final salary pension of
the employee. The adjustment would apply only to the basic disability benefit and
would not apply to the dependant child benefit.
Steve Zimmerman, of the C.W.A. Union, stated the second consideration is a
good way for the police and fire departments, which only consist of 1/3 of the
employees, to keep disability benefits in their favor. He feels the situation is
out of balance and went on record supporting the third consideration. Mr.
Zimmerman stated the pension was designed to be a substitute for social security
which provi~es for 50% disability pensions. He stated police and fire department
disability rates have risen, whereas the general employee rate has dropped.

John Nicholson stated all three considerations are designed to make job-
connected disabilities less attractive. He emphasized the firefighter prOfession
is the second most hazardous and police service is also in the top five. Mr.
Nicholson sta ted he has never approved anyone who was not truly disabled; he
doesn't feel it is the Pension Advisory Committee's place to tell a doctor that his
opinion is wrong.
Mayor Garvey stated the Board of Trustees has remanded decisions back to the
Pension Advisory Committee; however, the Board has been informed by the Legal
Department that they cannot overrule Pension Advisory Committee decisions.

Commissioner Regulski stated he feels the second consideration is not a good
approach in that it treats the employees differently. He stated the third approach
could be equitable if the additional total compensation the disabled employee could
make would not exceed final salary adjusted to the consumer price index.

Mike Stuart stated if this change is adopted, pay raises that the employee
could have received had he stayed on the job should also be included.
Miles Lance, Assistant City Attorney, stated the third consideration is
designed to prevent certain types of injury-causing disabilities. When recovery
takes place, the disabled retired person can get a better job; and the City has no
control over the amount of money they are allowed to make. Mr. Lance stated he
feels this proposed change is equitable to both the employee and the pension fund.
The City Manager stated the increase in the number of disabilities began when
the percent of final average salary was increased to 75%.

John Nicholson stated State law requires that a firefighter be able to perform
100% of his duties in order to maintain his certification. Mike Laursen pointed
out the dilemna of this situation is to provide a disincentive for employees to go
on disability without penalizing the truly injured.
John Nicholson and Mike Stuart stated the Police and Fire Unions support the
second consideration.
Van Horton, of the I.A.F.F. (Firefighters Union) stated the answer would be to
revoke the pension of a disabled person if it was found that he was not truly
disabled, and that re-examination after a period of time should be a provision.
Discussion ensued regarding using three years instead of five years to compute
final average salary. John Lessl, of Ogle and Waters, stated the increase to three
years would amount to about a half million dollars per year and would be an
increase in employee benefits of 5-6%.
Mike Stuart pointed out that after a person retires, there are no further
benefit increases. Van Horton stated this increase from five to three years in the
computation of final average salary is the only consideration that benefits the
employees.
Charlie Dunn stated the majority of police officers retire after 20 years
because of being burned out physically and emotionally.

time, police officers' outside employment compensation goes through City payroll
and is included as salary. He expressed concern with the equity of allowing for
police officers' outside employment compensation to be included in salary when
general employees are not afforded this privilege.

such assignments.) In lieu of granting a disability pension, the employee and
employer may mu tually agree in the placement of the employee in an alternate
position of a different job classification for which he/she is qualified under
civil service and personnel rules. In such event, the employee shall continue to
be compensated in the same salary schedule as provided in the position from which

Mike Laursen stated the first consideration provides that an employee who can
perform duties consistent with his job classification is not considered disabled;
if the employee and management agree, the employee can be placed in an alternate
position with the same salary. lt provides the option that the City can assign
alternate tasks within the employee's job classification. Consideration two does
not provide the option for the City to assign tasks in the same Job
classification. Mr. Laursen stated the first consideration gives the City more
flexibility; the employee is not considered disabled if the City feels he can do
some alternate job within his job classification.
Commissioner Winner questioned whether assigning an employee into an alternate
position at his same salary would not penalize the department through their salary
budget. He suggested the pension plan should pay part of the employee's salary at
that point.
Van Horton stated the I .A.F. F. supports the second consideration; the first
consideration becomes a problem with state certification of firefighters.
Mike Stuart stated police certification standards also have to be met, and
management does not want police officers to stay if they are not able to perform
all of the duties of a police officer.

procedures open to them if that should happen.

Discussion ensued regarding letting the voters decide who should be the final
authority to determine disability as there is no consensus between the Pension
Advisory Committee and the Board of Trustees at this time.
5) Structure o~ Pension Advisory CollllDittee - The first consideration is for
the Committee to be composed of seven members, three from management, three
employees and one citizen. The second consideration is for the Committee to be
composed of five members, two from management, two employees and one citizen. The
third consideration is for five members, all employees.
Commissioner Regulski suggested the Pension Advisory Committee be made up of
five members and requiring a four to one vote by the Board of Trustees to overturn
a recommendation of the Committee.
