Motion was duly seconded and carried unanimously. 8 Item 012 - Land Use Plan Amendment from Commercial/Tourist Facilities to Medium Density.Residential and a Zoning Atlas Amendment from CG to RMH for a 1.25 acre parcel - the S 170 ft. of M&B 23.02, Sec. 18-29-16; located on the N side or Gulr-to-Bay Blvd. apx. 300 ft. E of Belcher Rd., a portion of Green Acres Mobile Home Park (Keller Park Partnership I, Ltd./City) LUP 86-30, Z 86-18. (PUD) In 1981 the City initiated applications to assign Mobile Home Park (RMH) District zoning to all mobile home parks within the City not already assigned that classification. While most of the applications were approved, the owners of Green Acres Mobile Home Park represented to the City Commission that they were implementing plans to purchase the mobile homes located on the commercially zoned land in order to utilize that property for commercial purposes. A recent rield check of the property revealed there has been no visible change to the property since its previous consideration by the City Commission in 1981. The same mobile homes exist on the parcel and there are no signs or other indications of any existing commercial use. Justification for providing RMH (Mobile Home Park) zoning on properties in Clearwater developed with mobile homes is that the RMH district permits such use and other zoning districts do not. Once a mobile home park is zoned RMH, a request for change to any other zoning category would be subject to F.S. 723.083. Merritt's Sub.; located on the NW corner at the intersection of Garden Ave. and Seminole St. (Kirby) LUP 86-33, Z 86-21. (PUD) ,~ '0 The site is currently developed with a group care facility on Lots 6 and 7, with the rear 17,500 sq. ft. being vacant. The owner plans to increase the number of beds and possibly develop Lots 8 & 9 with an adult care center, activities center, and additional bed space. This necessitates a rezoning in order to consider establishment of a congregate care facility. If the requests are approved, a conditional use for a congregate care facility must be subsequently approved by the Planning and Zoning Board. The Planning Director stated the Planning and Zoning Board recommended denial of this land use plan and zoning atlas amendment as the Board considered this an intrusion into a single-family residential area. John Kirby, representing the applicant, stated the facility is already designed to hold 30 people and he does not intend to expand the facility. Mr. Kirby stated the property was downzoned in 1982. A variance would only allow 20 beds. Therefore, the requested amendments are necessary. Discussion ensued regarding the rezoning setting a precedent for fUture requests for rezoning and concern with the concept of spot zoning. The remainig three "pUblic" trustees shall be selected by the trustees chosen by the other organizations for a total of 15 members. (PW) o The Marshall Street Digestion System Improvements portion of the project consists of the installation of an additional Anaerobic Digestor and appurtenant pumps and piping to stabilize waste sludges produced at the Marshall Street Treatment Facility. This system replaces the temporary system and will provide better stabilization of sludges for land disposal and is much less energy intensive than the aerobic system. The Control Building portion or the project consists of a second floor addition to the east end of the existing Control Building. In anticipation of the lease recover, several necessary actions have already been taken: 1) a draft set of operating rules and regulations for the safe conduct of operations at the Airpark has been developed and is being sent to pilots based at Clearwater Executive; 2) a letter of agreement has been developed extending the terms of the former lease to the present Fixed Base Operator (FBO) for the interim period until a new lease agreement can be negotiated with the present or another FBO, or until the Airpark is closed; and 3) airport insurance has been purchased to assure that exposure occurring with the change in status is covered. .. l . " I o Any decision to retain the airport should recognize the folLowing factors: 1) the Airpark will be operated on a minimum break even financial basis; 2) no increase in activity will be allowed where it would result in any inc~ease in noise or safety concerns; 3) Federal or State funds will not be accepted if the ability to exclude certain types of undesirable activity is impaired (banner towing, ultralights, gliders), or if the City's ability to control activity at night for noise abatement is limited; 4) no businesses will be conducted at the Airpark without the express consent of the City Commission through the approval of leases and agreements; 5) management of day to day on site activities will be through a separate management services agreement with an FBO; 6) the City will exercise control through oversight by a City Coordinator ror Airport matters; 7) review and advisory authority will be retained and exercised by the present Airport Authority; 8) no long term commitment or local, State, Federal, or other third party funds to effect the repairs and upkeep at the Airpark can be made without a decision to retain the faCility; 9nd 9) staff will develop and advertise a Request For Proposals (RFP) for a consultant to prepare an Airport Master Plan. Staff examination of all ractors discovered no reason to close the airport and deny the availability of its services to that segment or the populace it serves. The Airport Authority recommends the continued operation of the Airpark. Six oitizens spoke in support of the continued operation of the Clearwater Airpark citing the advantages of having the transportation facility in Clearwater. Discussion ensued regarding the financial advantages of selling the Airpark versus the future appreciation of the land value. Concerns were expressed regarding the small percentage of pilots who take chances in operation of the air flights in and out of the Airpark. Commissioner Garvey moved to continue the operation of the Clearwater Executive Airpark on at least a break even financial basis, and further the current Airpark authority in conjunction with the Pilots Assoc. come up with operating rules that the pilots will abide by; and that the appropriate officials be authorized to execute same.
