Item 012 - Land Use Plan Amendment from Commercial/Tourist Facilities to Medium
Density.Residential and a Zoning Atlas Amendment from CG to RMH for a 1.25 acre
parcel - the S 170 ft. of M&B 23.02, Sec. 18-29-16; located on the N side or
Gulr-to-Bay Blvd. apx. 300 ft. E of Belcher Rd., a portion of Green Acres Mobile
Home Park (Keller Park Partnership I, Ltd./City) LUP 86-30, Z 86-18. (PUD)
In 1981 the City initiated applications to assign Mobile Home Park (RMH)
District zoning to all mobile home parks within the City not already assigned
that classification. While most of the applications were approved, the owners
of Green Acres Mobile Home Park represented to the City Commission that they
were implementing plans to purchase the mobile homes located on the commercially
zoned land in order to utilize that property for commercial purposes.
A recent rield check of the property revealed there has been no visible
change to the property since its previous consideration by the City Commission
in 1981. The same mobile homes exist on the parcel and there are no signs or
other indications of any existing commercial use.
Justification for providing RMH (Mobile Home Park) zoning on properties
in Clearwater developed with mobile homes is that the RMH district permits such
use and other zoning districts do not. Once a mobile home park is zoned RMH,
a request for change to any other zoning category would be subject to F.S.
723.083. This particular piece of state legislation was adopted in 1984 for
the purpose of protecting the mobile home owner residing in mobile home parks.

Initiated by the City in 1981, the owners of Happy Trails Trailer Park
presented to the City Commission that they were implementing plans to purchase
the mobile homes located on the commercially zoned land in order to utilize
that property for commercial purposes.
A recent field check of the property revealed there has been no visible
change to the property since its previous consideration by the City Commission
in 1981. Mobile homes are still located on the parcel and there are no signs
or other indications of any existing commercial use.
Commissioner Garvey moved to approve the Land Use Plan amendment to Medium

The site is currently developed with a group care facility on Lots 6 and
7, with the rear 17,500 sq. ft. being vacant.
The owner plans to increase the number of beds and possibly develop Lots
8 & 9 with an adult care center, activities center, and additional bed space.
This necessitates a rezoning in order to consider establishment of a congregate
care facility. If the requests are approved, a conditional use for a congregate
care facility must be subsequently approved by the Planning and Zoning Board.
The Planning Director stated the Planning and Zoning Board recommended
denial of this land use plan and zoning atlas amendment as the Board considered
this an intrusion into a single-family residential area.
John Kirby, representing the applicant, stated the facility is already
designed to hold 30 people and he does not intend to expand the facility.
Mr. Kirby stated the property was downzoned in 1982. A variance would only
allow 20 beds. Therefore, the requested amendments are necessary.
Discussion ensued regarding the rezoning setting a precedent for fUture
requests for rezoning and concern with the concept of spot zoning.
Commissioner Regulski moved to deny the requested Land Use Plan and
Zoning Atlas amendments. Motion was duly seconded and carried unanimously.

The 23.3 acre M.O.L. site is currently in the annexation process and is
requested to be zoned CPD (Commercial Planned Development District) with a Land
Use Plan designation of Commercial Tourist Facilities. The second ordinance
reading for the annexation/zoning and LUP change is scheduled for December 18th.
The property had been approved fol' CH (Highway Commercial) zoning at the initial
public hearing for the annexation. The applicant has since amended the request
for zoning to CPO, and in so doing, is requesting the subject site plan be
considered as the master site plan for the property.
A retail center development is proposed which will consist of four major
department stores, several shops, and a free standing restaurant.
Access is proposed at two points from Old Coachman Rd., one point at Drew
St. and two points at u.s. 19.
Commissioner Winner moved to approve the master site plan for The
Commons, a Commercial Planned Development, SUbject to the fOllOWing conditions:
1) On site mitigation plans and sections shall be submitted to and subject to
approval by the Environmental Manager prior to the issuance of the initial
building permit; 2) All recreated wetlands as part of the mitigation process
shall be zoned ALII (Aquatic Lands Interior District) and such applications
shall be submitted prior to the issuance of the initial building permit;
3) A letter from Florida Power giving the applicant permission for parking
drives and water service in the ROW easement shall be submitted to the City';
4) The Building heights of each building shall be given on the plan to assure
that the development will be in compliance with side and rear setback
requirements*; 5) An easement shall be prOVided over the storm line running
from Drew St. to the drainage pond at U.S. 19'; 6) A drainage easement over
the entire drainage pond shall be provided*; 7) A forty (40) ft. wide drainage
and utility easement shall be provided along U.S. 19*; 8) The applicant shall
obtain approval to vacate the easement near proposed "Major Dept. Store Oil or
the plan shall be revised accordingly'; 9) The design of the littoral shelf
for the drainage area at U.S. 19 shall be submitted for review by the Water
Quality Specialist'; 10) The handicapped spaces shall be positioned on site
as required by state law'; 11) The proposed driveway adjacent to Kane's
Furniture property (the southernmost driveway proposed on U.S. 19) shall be
right turn in, right turn out only'; 12) An easement shall be provided for
the parking spaces which will encroach on the Kane's Furniture property*;
13) The water system shall be redesigned to provide a looped system serving
proposed "l"iajor Dept. Store Oil': 14) A ten (10) foot wide utility easement
shall be provided over the water mains up to and including meters and hydrants';
15) The dumpsters shall be visually screened with a twelve (12) foot wide clear
opening'; and 16) The required open space fees shall be paid prior to
certification of the final site plan-; and those conditions as noted' shall
be indicated on the site plan and/or shall be subject to approval by the City
prior to certification of the final site plan; and that the appropriate

Linda Mielke, Library Director, stated there are some issues that need
to be addressed prior to Commission approval of the contract with Williams
Architects, Chartered.
Discussion ensued regarding whether the residents of the area are satisfied
with the design concept. The name of the branch library, whether to call it
the Northeast Branch or the Countryside Branch, was also discussed.

Commissioner Berfield moved to approve the design concept for the
Countryside Branch library and to authorize negotiations of the contract.

Item tJ1 00 - Clearwater for Youth - Educational/Recreational Foundation,
Memberships. (ADM)
A non profit corporation has been established to administer all phases
of the planning, fundraising, construction and operation of the proposed
educational/recreational center.
Each of' three organizations involved - UPARC, Clearwater For Youth and
the City - is entitled to name four trustees to the Board. The remainig three
"pUblic" trustees shall be selected by the trustees chosen by the other
organizations for a total of 15 members.
Commission consensus was the appointees to the Clearwater For Youth Board
need not be City of Clearwater residents.
Disoussion ensued regarding when the appointments should be made.
Consensus was to delay the appointments to the meeting of December 18th.
Commissioner Regulski moved to place Richard Leandris in nomination as
Trustee to the Board. Motion was duly seconded and carried unanimously.
Commissioner Garvey moved to place Jim Rasmussen in nomination as
Trustee to the Board. Motion was duly seconded and carried unanimously.

private business in our geographic area who compete for our labor pooli and
3) to determine the equitability or the present pay plans, both within and
across the various plans.

The Marshall Street Digestion System Improvements portion of the project
consists of the installation of an additional Anaerobic Digestor and appurtenant
pumps and piping to stabilize waste sludges produced at the Marshall Street
Treatment Facility. This system replaces the temporary system and will provide
better stabilization of sludges for land disposal and is much less energy
intensive than the aerobic system.
The Control Building portion or the project consists of a second floor
addition to the east end of the existing Control Building.
The available balance in this project is 8urficient to provide runds for
this contract.
The Public Works Director reviewed the long range plans for improvements
to the Water Pollution Control plants.
Commissioner Regulski moved to approve the contract with W.E.D.

A policy decision of the future operation of the Clearwater Executive
Airpark is needed from the City Commission to enable appropriate and timely
action by staff in preparing for the recovery of the Airpark lease and the
control of Airpark operations. In anticipation of the lease recover, several
necessary actions have already been taken: 1) a draft set of operating rules
and regulations for the safe conduct of operations at the Airpark has been
developed and is being sent to pilots based at Clearwater Executive; 2) a letter
of agreement has been developed extending the terms of the former lease to the
present Fixed Base Operator (FBO) for the interim period until a new lease
agreement can be negotiated with the present or another FBO, or until the
Airpark is closed; and 3) airport insurance has been purchased to assure that
exposure occurring with the change in status is covered.

Any decision to retain the airport should recognize the folLowing factors:
1) the Airpark will be operated on a minimum break even financial basis; 2)
no increase in activity will be allowed where it would result in any inc~ease
in noise or safety concerns; 3) Federal or State funds will not be accepted
if the ability to exclude certain types of undesirable activity is impaired
(banner towing, ultralights, gliders), or if the City's ability to control
activity at night for noise abatement is limited; 4) no businesses will be
conducted at the Airpark without the express consent of the City Commission
through the approval of leases and agreements; 5) management of day to day on
site activities will be through a separate management services agreement with
an FBO; 6) the City will exercise control through oversight by a City
Coordinator ror Airport matters; 7) review and advisory authority will be
retained and exercised by the present Airport Authority; 8) no long term
commitment or local, State, Federal, or other third party funds to effect the
repairs and upkeep at the Airpark can be made without a decision to retain the
faCility; 9nd 9) staff will develop and advertise a Request For Proposals (RFP)
for a consultant to prepare an Airport Master Plan.
Staff examination of all ractors discovered no reason to close the airport
and deny the availability of its services to that segment or the populace it
serves. The Airport Authority recommends the continued operation of the
Airpark.
Six oitizens spoke in support of the continued operation of the Clearwater
Airpark citing the advantages of having the transportation facility in
Clearwater.
Discussion ensued regarding the financial advantages of selling the Airpark
versus the future appreciation of the land value. Concerns were expressed
regarding the small percentage of pilots who take chances in operation of the
air flights in and out of the Airpark.
Commissioner Garvey moved to continue the operation of the Clearwater
Executive Airpark on at least a break even financial basis, and further the
current Airpark authority in conjunction with the Pilots Assoc. come up with
operating rules that the pilots will abide by; and that the appropriate
officials be authorized to execute same. MOtion was duly seconded and upon
(~ the vote being taken: Commissioners Garvey, Winner and Regulski voted "aye".
