The meeting was called to order by the Chairman at 5:28 p.m. in the
Commission Meeting Room in City Hall. He outlined the procedures and advised any
aggrieved party may appeal a final administrative order of the Municipal Code
Enforoement Board to the Circuit Court of Pinellas County. Any such appeal must
be filed within thirty (30) days of the execution of the order to be appealed. He
noted that Florida Statute 286.0105 requires any party appealing a decision of
this Board to have a record of the proceedings to support such an appeal.

Packer, Sanitation Inspector, stated he inspected this property on
17, 1987 and found debris in the form of sawdust, wood shavings and piles

stated the owner of the property is listed on the Pinellas County tax rolls as
Mack Dixon. He has since found out this is an estate and that Mr. Dixon is
deceased. Mr. Packer stated the only person he has talked to regarding the
violation is Charles Dixon who was hostile and verbally abusive. Mr. Dixon is in
the business of cutting and selling firewood and feels he has no responsibility to
comply.

Bernard Dixon stated he is the son of Mack Dixon and Charles is his brother.
Charles does not reside in the house on the property. An unknown person or
persons are doing illegal dumping on the property and the property has been in
violation before. Mr. Dixon stated he has been attempting to clear the property
manually; he does not have equipment to use and it will take additional time to
get it cleared. Concerning the illegal dumping that has taken place, he stated he
called the Police Department and was told it was a civil matter. His brother has
been uncooperative with the rest of the family. Mr. Dixon stated he would attempt
to get the family members together to try to correct the situation and would need
about three weeks to a month to take care of it.

a legal description of Moase and Harrison, Blk. 2, Lots 8 & 9, Sec. 15-29-15 a/k/a
1127-1133 Brownell St., Clearwater, Fla., the Municipal Code Enforcement Board has
heard testimony at the Municipal Code Enforcement Board hearing held the 23rd day
of September, 1987, and based on the evidence, the Municipal Code Enforcement
Board enters the following F1nd~s of Fact. Conclusions or Law, and Order.

The FJ.ndings 01" Fact. are: after hearing the testimony of Vern Packer',
Sanitation Inspector, and Bernard Dixon, representing the owners, and viewing the
evidence, exhibits submitted: City exhibits 1 & 2, it is evident that there does
exist excessive weed and/or plant growth, debris and trash at the above address.
The Conclusions of Law are: the Estate of Mack Dixon is in violation of
Chapter 95 of the City Code.
It is the Order of this Board that the Estate of Mack Dixon shall comply
with Chapter 95 of the Code of the Ctty of Clearwater by October 26, 1987. Upon
failure to comply within the time specified, the Sanitation Division shall arrange
remedial action and the cost of clearing plus $150 administrative charge shall be
owed by the owner and shall constitute a lien against the property until paid. If
the owner takes remedial action after the time specified, the administrative cost
of' $150 shall be owed and shall const! tute a lien against the property until
paid. A notice of lien in such form as the City Commission shall determine may be
recorded in the Public Records of Pinellas County. Upon complying, the Estate of
Mack Dixon shall notify Vern Packer, the City Official who shall inspect the
property and notify the Board of compliance. Should a dispute arise concerning
compliance, either party may request a further hearing before the Board. The
motion was duly seconded and earr1ed unanimously.
Done and Ordered this 23rd day of September, 1987.
