The meeting was called to order by the Chairman at 1:09 p.m. in the
Commission Meeting Room in City Hall. He outlined the procedures and advised
any aggrieved party may appeal a rinal administrative order of the Municipal
Code Enrorcement Board to the Circuit Court of Pinellas County. Any such appeal
must be riled within thi~ty (30) days of the execution of the order to be
appealed. He noted that Florida Statute 286.0105 requires any party appealing
a decision or this Board to have a verbatim reco~d of the proceedings to support
such an appeal.

Eric Peterson, a resident of 431-A Mandalay Ave., stated he has lived at
the Mandalay address since August, 1986. His residence, ID1ich he rents, is
located to the west of a sign belonging to JB Family Restaurant. He stated
the sign ~as moved from one side of the west wall to the other.
The City submitted EKhibit 81, an Affidavit signed by Eric Pete~sonj
Composite Exhibit H2a-c, three photog~aphs taken by Mr. Peterson on October
13, 1986, depicting the sign in its current location; Exhibit #3, a photograph
taken September' 6, 1986 by Mr. Peterson Showing the sign in its original
location.

Geri Doherty, Land Development Code Inspector, stated this case is the
result of a complaint received on October 13, 1986 regarding a sign for JB
Family Restaurant at 432 Poinsetta Ave., Suite #5. The sign in question is
located on the west side of the building. She stated she visited the property
on October 15, 1986 and again on this date and found the sign in the same
location. No permit for moving the sign or for the sign itself was found upon
researching the records. Miss Doherty stated that Beach Commercial zoning
allows one 10 sign per business. Mr. Bugar has a sign on the canopy on the
front of the bUilding in addition to the sign in question. The sign in question
is non-conforming due to the additional sign and because of its location. The
sign would have been allowed to remain as a non-conforming sign had it not been
moved to another location on the side of the bUilding.

The City submitted Exhibit #4, a copy of a page in the Zoning Atlas showing
the zoning as Beach Commercial; Exhibit #5, a copy of Section 134.010(3)a1;
and Exhibit 06, a copy of the Transfer of Occupational License to Mr. Bugar
dated June 30, 1986.
Julijan Bugar stated he bought the restaurant on July 1, 1986. The sign
existed at that time, having been put there by a previous leasee of the property.
Mr. Bugar had the sign moved on October 6th due to its being hidden by bushes
and trees.

Pierre DeHert, owner of the building that houses the restaurant, stated
the sign had been put up many years ago by a former tenant. He stated he
thought he had an understanding with the land owner of the Peterson property
to maintain the bushes and trees to keep them from obstructing the sign on the
building.

The Assistant City Attorney stated the move of a non-conforming sign is
the issue at this hearing, not the maintenance of bushes.

Mr. Sugar stated, since the sign in question is the only sign which faces
a public street, he feels it would be unfair for him to have to remove it.
Mr. Amburgy moved that concerning Case No. 99-86 re: violation of Section
13'.015(a) of the Clearwater City Code on property having a legal description
as follows: Lot 41, Block A, Barbour-Morrow Sub., Sec. 8-29-15, a/k/a 432
Poinsetta St., the Municipal Code Enforcement Board has heard testimony at the
Municipal Code Enforcement Board hearing held the 14th day of January, 1987,
and based on the evidence, the Municipal Code Enforcement Board enters the
following Findings at Faot, ConclusioDs at Law, and Order.

The Findings ot Fact are: After hearing testimony of Eric Peterson,
Geri Doherty, JUlijan Bugar and Pierre DeHert and viewing the evidence, exhibits
submitted: City Exhibits #1 - 06, it is evident that the business has two
business identification signs; the sign in question on the side of the building
was moved within the past year during the ownership of Mr. Bugar.

It is the Order of this Board that Julijan Bugar shall comply with
Section 134.015(a) of the Code of the City of Clearwater by March 1, 1987.
If Julijan Bugar does not comply within the time specified, the Board may order
him to pay a fine of $25.00 per day for each day the violation continues to
exist. If Julijan Bugar does not comply within the time specified, a certified
copy of the Order imposing the fine may be recorded in the public records of
Pinellas County, Florida, and once recorded shall constitute a lien against
the land on which the violation exists if the violator owns the land, and a
lien against any other real or personal property owned by the violator pursuant
to Chapter 162, Florida Statutes. Upon complying, Julijan Bugar shall notify
Geri Doherty, the City Official who shall inspect the property and notify
the Board of compliance. Should the violation recur, the Board has the
authority to impose the fine at that time without a subsequent hearing. Should
a dispute arise concerning compliance, either party may request a further
hearing before the Board. Motion was duly seconded and carried
unanimously.

Flagship Coach Pine lIas
Mr. Stirling of Flagship Coach stated the business opened in May, 1986.
At that time they applied for a Pinellas County occupational license and were
not aware they needed a City of Clearwater occupational license. Once they
were informed they needed a City occupational license, they applied on September
22, 1986. They were then informed they needed a conditional use permit to
operate that type of business in the zoning district. On September 30th they
applied for a conditional use permit but were not heard by the Planning and
Zoning Board until November 4th, at which time the conditional use was granted.
They received their City occupational license on November 21, 1986. Mr.
Stirling stated he feels the fine, which accrued from the date of the order
until compliance was reached, is unjust as the time frame did not allow time
to get the conditional use permit.
