Mr. Ehrig questioned whether, since the code was not in effect, this
would be a case of grandfathering in. The present Life Safety Code does
not make provision for any structure to be grandfathered in, leaving it
to the discretion of the Fire Marshal. Mr. Mattheus stated the Fire
Marshal is aware of the situation and nas not agreed to allow the structure
to be grand fathered in.
Scott Brainard, Attorney representing St. Andrews Cove, stated the
plans were only found through the ClerK of the Circuit Court the morning
or the hearing. The plans show some discrepancy in that the condominium
was not constructed exactly according to the plans. The plans call ror
2 buildings witn 24 units with a 4 hour rated center wall. The building
is constructed with 28 units. Mr. Brainard stated they are requesting
a continuance to the July 9, 1986 meeting in order to make borings to
determine if the rire wall does exist.
Mr. Mattheus stated he would like the Board to issue an order as he
has been working on this case since September 1985. Discussion ensued
regarding whether to issue an order or to continue the case to the July
meeting.
Mr. Elliott moved to continue Case Nos. 47-86 and 48-86 to the
meeting of July y, 1986. Motion was dUly seconded and carried
unanimously.

The Assistant City Attorney requested the case be withdrawn as the
violation has been corrected. Mr. Morris moved to withdraw Case No.
49-86. MOtion was duly seconded and carr~ed unanimously.

Carl Tilly (Building Code)
The Secretary to the Board stated a letter from the BUilding Inspector
had been received stating the alleged violator has applied for a variance
and they are requesting the case be continued to the meeting of August 13,
1986 to allow them to go berore the Development Code Adjustment Board.
Mr. Aude moved to cont~nue Case No. 51-86 to tne meeting of August
13, 1986. MOtion was duly seconded and carried unanimously.

A memo from the Building Inspector had been received stating that
a demolition permit has been issued and they are requesting the case be
continued to the July meeting to see if demolition is completed.

U.s. Home/Rutenbe~g (Uniform Development Code)
The Assistant City Attorney reported an agreement had been reached
prior to the hearing with the Rutenberg Corp., U.S. Home, regarding the
fence. The agreement basically reduces the height of the fence to 4 feet
above the presently eKisting grading. The Assistant City Attorney is
requesting this case be continued to August 13, 1986, to give Rutenberg
Corp. time to reach compliance.

The Secretary to the Board inrormed the Board this case is due to
be brought before the City Commission for demolition. The Board instructed
the Secretary to develop a chronological orde~ of e~ents for the media
on this partioular case to show the Board had given Mrs. Russell ample
opportunity to rehabilitate the property before demolition ~as instituted.

The Assistant City Attorney stated foreclosure has been initiated;
however, the property is not worth foreclosing on. He stated he had
contacted the Community Development Department to see if they had any use
for the property and they responded negatively.
Discussion ensued regarding how to proceed with demolition on this
structure as it has now become an unsafe building. The Board instructed
the Secretary to see if this item could be brought back to the Board cited
as an unsafe building at the July 9 meeting. The Assistant City Attorney
stated if the property is demolished, the City will drop foreclosure.
CASE NO. 58-83
Charles Robinson
The Secretary informed the Board this property is going before the
Commission for demolition on July 17, 1986.
HEW BUS~
The Assistant City Attorney reported legislation amending the State
Statute re the CEB has passed and will go into effect July 1, 1986. One
change is to extend the time in which action must be taken on liens from
two years to five.
Mr. Amburgy requested the names and addresses of all Board members,
including former member Adam Midura, be sent to him.

at 1003 Railroad Ave., Case No. 184-85, will be going before the City
Commission for demolition on July 17.
