City's exhibit No.1, a copy of' the inspection report sent to Mrs.
Karelis and City's composi t Exhibit No. 2 (a through f), pictures
of the condition of the property were presented into evidence.

of Section 138 of the Standard Housing Code on property with a legal
description as follows: Navajo Park Subdivision, Block F, Lots 36,

Municipal Code Enf'orcement Board has heard testimony at the Municipal
Code Enf'orcement Board hearing held the 6th day of April 1983, and
based on the evidence, the Municipal Code Enforcement Board enters
the f'oUowing FiIlcling:s ot' Fact, Concluslona of Law, and Order.
The Findings or Faot are: In accordance wi th Inspector Ulen
Hopkins' and Mrs. Jessie G. Karel1s' testimony all worl, has been
completed except for painting or applying some other protective
coating to the structures.
The Conclusions of Law are: Mrs. Karelis is in violation of ~eo~ion
305.14 of the Standard Housing Code.
It is the Order of this Board that Mrs. Jessie Karelis shall comply
with Section 305.14 of the Standard Housing Code within 60 days from
the date of this hearing. If Mrs. Karelis does not comply within
the time specified, she shall pay a fine of $10.00 per day for each
day the violation continues to exist. If' Mrs. Karelis does not comply
within the time specif'ied, a certified copy of this Order, together
with an Affidavit of Non-Compliance, shall be recorded in the public
records of the Of'fice of the Clerk of' the Circuit Court in and for

The City's exhibits No.1, a picture of the sign in question and
City's exhibit No. 2 being a building permit from the County issued
in October, 1979 for a 10' x 40' sign were submitted into evidence.
Stuart Williams, Sign Inspector, stated there is no permit for the
lower portion o~ the sign which measures B' x 16'. The signs do not
meet city requirements and there are no county permits for the lower
portion of the sign. In September of 1982 the sign was removed and
re-erected without a permit.
The defendant or his representative was not present.
Discussion ensued regarding whether or not the sign was
grand fathered in when this property was annexed into the City and
also whether or not there are other signs on the property. It was
stated that there are other signs identifying the business in
question.
Exhibit No.3, a sign inventory for the property was submitted into
evidence.
Mr. Hostetler moved that regarding case Ro. 8-83 re: violation
of' Section 143.21(a)(1) of the Clearwater City Code on property with
a legal description as follows: M&B 4-2A Section 20-29-16. The
Municipal Code Enforcement Board has heard testimony at the Municipal
Code Enforcement Board hearing held the 6th day of April 1983, and
based on the evidence, the Municipal Code Enforcement Board enters
the fOllowing F1Dd1D8s of' Fact, CoDclus.10118 ot Law, and Order.

Manley Mallett, City Inspector, indicated an inspection was done
at the requst of Community Development. He found that roofing repairs
had been done. No permit had been pulled and the roofing was done
improperly.
Russell Freeman stated he had informed the owner of the property
he did not have a license and that she would have to get a permit.
Discussion ensued whether or not the proper party was being
charged.

Ulen Hopkins stated that the Municipal Code Enf'orcement Board
had ordered Mr. Beneke to demolish the building on this property.
The building was demolished, however, it was done without the proper
permitting.
Mr. Beneke stated that he had tried to obtain a permit but was
not granted one as it is the Building Department's pOlicy not to issue
demolition permits to the property owner if they do not reside at
the property.
Mr. Regulski moved that regarding Case Ro. 10-83 re: violation
of Section 133.01 of the Clearwater City Code on property with a legal
description as follows: John Williams Sub., Lot 3, aka 1306! Railroad
Avenue. The Municipal Code Enforcement Board has heard testimony
