It is the ~er of this Board that: Continental Towers Condominiums,
Inc. shall comply with NFPA 101, 1981 Edition, Sec 7-6.3.3.3 of the
Code of the City of Clearwater by January 1, 1983. If Continental
Towers Condominiums, Inc. does not comply within the time specified,
he they shall pay a fine of $50.00 per day for each day the violation
continues to exist. If Continental Towers Condominiums, Inc. does
not comply within the time specified, a certified copy of this Order,
together with an Affidavit of Non-Compliance, shall be recorded in
the public records of the Office of the Clerk of the Circui t Court
in and for Pinellas County, and once recorded shall constitute a lien
against the property upon which the violation exists, pursuant to
Chapter 80-300 Laws of Florida, 1979. Upon complying, Continental
Towers Condominiums, Inc. shall notify John Chester the City Official
who shall inspect the property and notify the Board of compliance.
Should a dispute arise concerning compliance, either party may request
a further hearing before the Board. The motion was duly seconded.
Discussion ensued regarding whether the January 1st compliance
date would allow the Association enough time to correct the problem.
Mr. Regulski amended his motion to show a compliance date of January
31, 1983. Mr. Hostetler, the seconder of the motion accepted the
amendment. Upon the vote being taken the amended motion carried
unanimously.

Ulen Hopkins, Housing Inspector, stated that some work had been
done to correct the violations. However, all violations were not
corrected. Exhibits 1A and 1B, photographs of the building in
question and Exhibit 2 the receipt signed by Mr. Zadok indicating
he received th original Notice of Violation, were submitted as
evidence.
Neither the owner or his agent were present at the meeting,
however the files indicate the certified letter notifying the owner
of the meeting was received on the 12th of November, 1982.
Mr. Gerlach moved that regarding Case Ifo. "9-82 re: violation
of Sections 305.13,305.16,303.4,305.8,305.11,305.14 and 304 of
the Standard Housing Code of Chapter 138 of the Clearwater City Code
on property with a legal description as follows: Lot 25, Block 24,
Magnolia Park Sub, located at 914 E. Druid Road, the Municipal Code
Enforcement Board has heard testimony at the Municipal Code
Enforcement Board hearing he ld this 1 st day of December, 1982, and

The Findings of Fact are: The board accepts the testimony
of Ulen Hopkins, Minimum Housing Inspector, concerning the violations.

The CooclWJioos of Law are: Mr. Shlmo Zadok is in violation of
Sections 305. 13, 305. 16, 303.4, 305.8, 305. 11, 305. 14 and 304 of the
Standard Housing Code made part of Chapter 138 of the Clearwater City
Code.
It is the Order of this Board that: Mr. Shlmo Zadok shall comply
with said Sections of the Code of the City of Clearwater within 30
days. If Mr. ShImo Zadok does not comply within the time specified,
he shall pay a fine of $1.00 per day for each day the violation
continues to exist. If Mr. Shlmo Zadok does not comply within the
time specified, a certified copy of this Order, together with an
Affidavit of Non-Compliance, shall be recorded in the public records
of the Office of the Clerk of the Circuit Court in and for Pine1las
County, and once recorded shall constitute a lien against the property
upon which the violation exists, pursuant to Chapter 80-300 Laws of

A copy of the stipulation filed with the Circuit Court was
presented to the Board. The stipulation provided the structure, being
a hot tub and enclosure could remain for a period of 1 year from its
date of construction. The construction date was in April, 1982. U.
S. Homes cannot represent to prospective buyers of this lot or lots
of equivilant size that the hot tub could be constructed on their
property. If the house is sold prior to the one year time granted
the hot tub and accouterments would be removed.

Attorney Dennis Ruppel submitted two Engineer's letters stating
that the common area and the individual balcony fOl' this unit are
in compliance, therefor he requested that this one unit, No. 606 of
Building 12, be released from the recorded lien.
Elton Reichardt, Building Inspector, stated he would issue an
Affidavit of Partial Compliance for this unit based on the engineering
reports submitted by Attorney Ruppel.
Discussion ensued regarding other individual units that might
possibly be in compliance.
Mr. Gerlach moved that regarding Unit 606, Building 12,
Clearwater Seville, to grant the partial release provided that J &
Z Properties, Inc., place in escrow .74% of the $21,000.00 of lien
to be held in trust account of Johnson, Blakely, Pope, Boker, Ruppel
and Tew, Attorneys and Counselors at Law, until further order of the
Board. Said escrow deposit shall be returned to J & Z Properties,
Inc., should this Board subsequently satisfy the lien. This Order
is SUbject to the issuance of an Affidavit of Compliance by Elton
Reichardt of the Building Department.
The motion was duly seconded and carried unanimously.
