The meeting was called to order by the Chairman at 2:05 p.m. in
Commission Meeting Eoom in City Hall. He outlined the procedures
advised any aggrieved party may appeal a ruling or order of the

Mr. Tylawsky's Exhihits were admitted as evidence: 4 (a) and (b)
copies of the red tag and letters to Mr. Tylawsky, one from November
2, 1981 from Roy Ayres g~anting a 90 day extension to the building
permi t and the other May 20, 1982 from Cyndie Goudeau, Secreta~y to
the Boa~d, regarding Mr. Tylawsky' s request for certified copies of
building permits; Exhibit No.5, a copy of Building Permit No. 6652D;
composite Exhibit No.6, (a) being copy of application for permit
dated October 2, 1981 and (b) a copy of Building Permit 6652D for
demolition of shed; and Exhibit No. 7 being another copy of Building
Permit 6652D.

Mr. Tylawsky stated he had gotten verbal permission from
Inspector Reis to alter the arbor. Upon questioning by the board,
M~. Tylawsky refused to answer any further questions without
counsel.

Inspector Reis stated the verbal permission he had given Mr.
Tylawsky was to finish the arbor in a reasonable manner once a

Mr. Regulski moved that regarding Case 110. 18-82 re: violation
of Section 106.1 of the Southern Standard Building Code as adopted by
the City of Clearwate~, on property with a legal description as
follows: Lots 5 and 6, Block 1, less street, Belleview Addition
located at 935 Lakeview Road, Clearwater, Florida, the Municipal Code
Enfo~cement Board has heard testimony at the Municipal Code
Enforcement Board hearing held this 2nd day of June, 1982, and based
on the evidence, the Municipal Code Enforcement Board enters the
follOWing PiDdiDga or Paot, Cooolusloaa or Lavp SDCl Order.
The PiDdiDga or Pact are: John Tylawsky did violate the
conditions of the building permit application by making a change in
the plans and constructing same prio~ to app~oval of the Building
Official which rendered the permit null and void.
The Ccmolusloaa ot Law are: John Tylawsky is in violation of
Section 106.1 of the Southern Standard Building Code.
It is the Order of this Board that: John Tylawsky shall comply with
said section by bringing the structure in question into conformance
with plans submitted with the building permit application filed
7-28-81, specifically a shade lattice arbor with a lattice roof or
remove structu~e entirely by July 1, 1982. If Mr. Tylawsky does not
comply within the time specified, he shall pay a fine of $10.00 per
day for each day the violation continues to exis t. If Mr. Tylawsky
does not comply within the time specified, a ce~tified copy of this
Order, together with an Affidavit of Non-Compliance, shall be recorded
in the public records of the Office of the Clerk of the Circuit Cou~t
in and for Pinellas County, and once reco~ded shall constitute a lien

shall notify Charles Reis, the City Official who shall inspect the
property and notify the Board of compliance. Should a dispute arise
concerning compliance, either party may request a further hearing
