I l , ! i 4 The FlDdtnga or Fact are: The Board accepts the Affidavit that has been filed by the attorneys for the Imperial Court Condominiums in whioh they admit they are in violation of the Code. The Conclusions or Law are: Imperial Court Condominiums are in violation of the above cited Section of the Clearwater City Code. It is the Order of this Board that: Imperial Court Condominiums shall comply with the Section cited above within 90 days. If Imperial Court Condominiums do not comply within the time specified, they shall pay a fine of $50.00 per day per building for each day the violation continues to exist. If Imperial Court Condominiums do not comply within the time specified, a certified copy of this Order, together with an Affidavit of Non-Compliance, shall be recorded in the public records of the Office of the Clerk of the Circuit Court in and for Pinellas County, and once recorded shall constitute a lien against the property upon which the violation exists, pursuant to Chapter 80-300 Laws of Florida, 1979. Belcher Rd., Clearwater) Fire Code Donald McFarland, attorney for Imperial Court Codominiums, filed an answer to the Affidavit of Violation stating the majority of units have had smoke alarms installed. The only exceptions are those units where the owners are not presently in residence. He requested the case be dismissed. John Wagstaff, attorney, explained that, while Florida Statutes grant condominium associations authority to make decisions and enforce them, they do not have authority to enter individual units. Therefore, the only way unoccupied units can be brought into compliance is to await the return of the owner. Mr. Winner moved that regarding Case No. 15-82 re: violation of NFPA 101, 11-3.3.3.1, as adopted by the Clearwater City Code, on property with a legal description as follows: see attached Exhibit A made a part hereof, located at 1433 S. The Conclusions or Law are: Since there is a violation of NFPA 101, 11-3.3.3.1 it is the Order of this Board that: Imperial Court Codominium Bldgs. A,B,C,D,E,F, and G shall comply with Section NFPA 101, 11-3.3.3.1 as adopted by the Code of the City of Clearwater by installing smoke detection systems in any units presently not having said units within two weeks of the time they become occupied. If' Imperial Court Codominium Association Bldgs. A,B,C,D,E,F, and G do not comply within the time specified, they shall pay a fine of $50.00 per day per unit owner for each day the violation continues to exist. Greenwood Ave., Clearwater) Fire Code Mr. Custer moved to cancel the hearing since an Affidvit of Compliance has been submitted. The motion was duly seconded and carried unanimously. CASE 10. 16-82 Larry Lambros (Kipling Arms Apts., 32 Bay Esplanade, Clearwater) Fire Code Fire Inspector Chester reviewed the 7 violations of NFPA Code 101, 1981 edition and City's Composite Exhibit 01, slides A through I which were taken April 19, 1982. The Inspector submitted City's Exhibit 12, copy of a letter dated 1/27/82 addressed to Larry Lambros which listed the 7 violations and which was signed by Mr. Lambros. The property was reinspected 3/10/82 at which time no corrections had been made and at which time Mr. Lambros stated he would not comply. ',", o The F1ndiDga or Fact are: Through testimony and evidence presented by the City Fire Inspector and not refuted by the owner of the property at 32 Bay Esplanade known as Kipling Arms Apts., it was shown that this property does '.lot have adequate fire alarm, enclosed stairwells, smoke detectors, emergency lighting, fire extinguishers, illuminated exit signs and adequate separation between certain hazardous areas and living ares. The Conolusions or Law are: The property at 32 Bay Esplanade is in violation of NFPA Code 101, 1981 edition, Secs. 19-3.~.2.1, 19-3.1.1, 19-3.~.1.1, 19-2.9.1, and 19- 3.2.1 Sec. A, NFPA 10, and 19-2.10.1. It is the Order of this Board that: Owners of Kipling Arms Apts. shall comply with Sec. 19-2.10.1 within 10 days, NFPA 10 and 19-3.4.1.1 within 30 days, and 19-3.4.2.1, 19-3.1.1, 19-2.9.1, and 19-3.2.1 Sec.
