Donald McFarland, attorney for Imperial Court Codominiums, filed
an answer to the Affidavit of Violation stating the majority of units
have had smoke alarms installed. The only exceptions are those units
where the owners are not presently in residence. He requested the
case be dismissed.
John Wagstaff, attorney, explained that, while Florida Statutes
grant condominium associations authority to make decisions and enforce
them, they do not have authority to enter individual units.
Therefore, the only way unoccupied units can be brought into
compliance is to await the return of the owner.
