7042-02 ORDINANCE NO. 7042-02 AN ORDINANCE OF THE CITY OF CLEARWATER, FLORIDA, AMENDING THE FUTURE LAND USE PLAN ELEMENT OF THE COMPREHENSIVE PLAN OF THE CITY, TO DESIGNATE THE LAND USE FOR CERTAIN REAL PROPERTY LOCATED ON THE EAST SIDE OF ELIZABETH AVENUE SOUTH, APPROXIMATELY 960 FEET NORTH OF GULF-TO-BAY BOULEVARD, CONSISTING OF EAST 135 FEET OF THE WEST 980 FEET OF THE SOUTH 70 FEET OF THE NORTH 299.88 FEET OF THE SOUTHWEST ONE-QUARTER OF THE NORTHEAST ONE-QUARTER, TOGETHER WITH THE ABUTTING RIGHT-OF-WAY, WHOSE POST OFFICE ADDRESS IS 155 ELIZABETH AVENUE SOUTH, UPON ANNEXATION INTO THE CITY OF CLEARWATER, AS RESIDENTIAL URBAN (RU); PROVIDING AN EFFECTIVE DATE. WHEREAS, the amendment to the future land use plan element of the comprehensive plan of the City as set forth in this ordinance is found to be reasonable, proper and appropriate, and is consistent with the City's comprehensive plan; now, therefore, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF CLEARWATER, FLORIDA: Section 1. The future land use plan element of the comprehensive plan of the City of Clearwater is amended by designating the land use category for the hereinafter described property, upon annexation into the City of Clearwater, as follows: Property East 135 feet of the west 980 feet of the south 70 feet of the north 299.88 feet of the southwest one-quarter of the northeast one-quarter, of Section 17, Township 29S, Range 16E, Public Records of Pinellas County, FL, together with the abutting right-ot-way. (ANX 2002-08012) Land Use CateQorv Residential Urban (RU) Section 2. The City Commission does hereby certify that this ordinance is consistent with the City's comprehensive plan. Section 3. This ordinance shall take effect immediately upon adoption, contingent upon and subject to the adoption of Ordinance No. 7041-02, and subject to the approval ot the land use designation by the Pinellas County Board of County Commissioners, and subject to a determination by the State of Florida, as appropriate, of compliance with the applicable requirements of the Local Government Comprehensive Planning and Land Development Regulation Act, pursuant to 9 163.3189, Florida Statutes.
