City Attorney reviewed the rules and regulations, been previously distributed, for the conduct of Mr. Zussy moved to approve the rules as submitted. The motion was seconded by carried unanimously. The City Attorney explained the progression of events, referring to the appropriate form to be used at each stage. Considerable discussion ensued concerning the language in Paragraph 3 of the Claim of Lien form. Mr. Carnahan moved to delete the reference to a $5,000 maximum fine, seconded by Nr. Zussy. Mr. Bustin suggested alternative wording and Mr. Carnahan moved to amend his motion to provide for deletion of the entire first sentence in Paragraph 3 and substitute: "Pursuant to Chapter 80-300, Florida Statutes, such fine shall increase at the rate of $ for each day that the violation continues past the compliance date stated in Paragraph 2 above." The amended motion was seconded by Mr. Zussy and carried unanimously. . Mr. Winner moved to sentence relating to 10% Paragraph 3. The motion and carried unanimously. delete ln its entirety the interest in the original was seconded by Mr. Carnahan Mr. Ehrig moved to adopt the packet of forms, with appropriate modifications which have been made, with the City Attorney to prepare the final documents. Mr. Zussy seconded the motion which carried unanimously. The City Attorney advised a property owner, by law, has one year after the filing of a lien to satisfy that lien before foreclosure proceedings could be instituted. He reminded the Board that the philosophy behind the establishment of the Board is to obtain compliance with the Code, rather than with collection of fines. Discussion ensued as to what City Department would be authorized to collect any fines imposed. Mr. Zussy moved that the City Attorney be authorized to add to the language to include the proper City Department authorized to receive payments of fines.
