Pension Fund, met in regular session at the City Hall, Monday, November 1, 1982,

Commissioner Garvey moved to accept the recommendation of the Advisory
Committee. Motion was duly seconded and carried unanimously.
b. Denial of Membership.
The City Manager presented the recommendation of the Advisory Committee
to deny membership based on physician's findings for two (2) employee listed
below:

Commissioner Garvey moved to accept the recommendation of the Advisory
Committee to deny membership. MOtion was duly seconded and carried
unanimously.
c. Pension to be Granted.
The City Manager presented the recommendation of the Advisory Committee,
General Employees' Pension Fund that the employee listed below be granted
Employee Disability Retirement Pension under the Employees' Pension Plan.
Scheuerman, Franklin L. - Tradesworker II, Building and
Division, Central Services Department, effective August 11,
of $778.40 per month.

Commissioner Garvey moved to grant the pension request. Motion was duly
seconded.
Commissioner Garvey moved to amend the motion to direct the City Attorney
to execute an agreement with Franklin L. Scheuerman to waive his rights to file
for lost wages under Worker's Compensation beginning with the month of September
1982 and that the City shall only be liable for retroactive pension payments
for the difference between the Worker's Compensation and pension payments for
the period from August 11, 1980 through October 31, 1982. Motion was duly
seconded. Upon the vote being taken the ~ motion carried unanimously.

receipt of a City of Clearwater Disability Pension, recognizing that under
Ordinance No. 1832 of the City of Clearwater I cannot receive City Pension
and Worker's Compensation (except medical ~ayments) for the same period of
time, do hereby agree that:
1. My effective date of pension shall be August 11, 1980; and
2. The City of Clearwater shall only be liable for retroactive
pension payments for the period from August II, 1980 through
October 31, 1982 in an amount determined by computing what my
pension payments would have been for the above-referenced
period of time and the monies actually received by me for all
Worker's Compensation pu~poses ~xcluding medical payments for
the same pe~iodi and
3. I expressly waive my rights to file for lost wages under
Worker's Compensation beginning with the month of
September, 1982, throughout any period during which I
receive City of Clearwater Disability Pension.
