Commissioner Kelly moved to approve the minutes of the February 1,
1982 meeting. Mot~OIl was duly seconded and carr!.ed unanimously.
ITEM #3 - Recommendations of the Pension Advisory Committee
a. Disability Pension, Polioe Officer J. Borsoh.
John Borsch was employed by the City as a Police Officer on 4-12-71.
In September of 1981 he requested job related disability pension due to a
cardiac condition. The Pension Advisory Committee reviewed his request
along with his medical documentation and (1) recommended that he be granted
a disability pension and (2) that the matter of whether the disability is
job-connected or non-job-connected be decided by the Trustees fOllowing
research by the City Attorney. The City Attorney recommended that the
officer be granted a non-jab-connected disability pension. On December 7,
1981, motion was made to award a non-job-related disability pension in
accordance with the provisions of the Employees Pension Plan, Section
26.34.
Brian Johnson, attorney representing John Borsch, requested the City
Commission reconsider this matter as he had not received proper
notification of the date the Trustees would be considering the item and his
partner had attended the meeting in his stead.

He reviewed the offieer's employment with the city for eleven years
including the week before the attack and the many stressful events. He
maintained the heart condition and stress are tied together. He presented
two studies on stress to the Commission. The first was done locally on
various stressful factors in police work and the second was done in
California and related to the high incidenee of heart attacks in police
officers and is associated with stress.

reviewed. Commission discussion ensued.

Commissioner Garvey moved to award a job-related-disability pension in
accordance with the prOVisions of the Employees Pension Plan. Commissioner
Hatchett seconded the motion. The Mayor clarified the motion and stated a
75% job-connected disability pension was to be granted retroactive to the
date of the previous award. He further stated it would be retroaetive to
January 14, 1982. Upon the vote being taken, Commissioners Garvey,
Hatchett, Kelly and the Mayor voted "Aye". Commissioner Calderbank was
absent.

Commissioner Garvey moved to amend the motion of April 13, 1981,
to include the wording "permanent total disability benefits recipients as
well as permanent partial disability benefits recipients" in order for John
Lindsey to go under pension while he is continuing to reoeive Workers'
Compensation payments. Motion was duly seconded and carried
unanimously.
