Shoemaker Thomas A. Bustin Lucille Williams City City City Manager Attorney Clerk The Mayor called the meeting to order. ITEM #2 - Minutes Commissioner Garvey moved to approve the minutes of the November 16, 1981, meeting. Motion was duly seconded and carried unanimously. ITEM #3 - Recommendation of the Pension Advisory Committee a. Pension to be Granted. The City Manager presented the recommendation of the Advisory Committee of the Employees' Pension Fund to grant the employee listed below a disability pension in accordance with Section 26.35 of the Employees' Pension Plan: John B. Stanton, effective October 22, Police Officer, Police Department, 1981, in the amount of $1,305.53 per month. The City Manager reported the Pension Advisory Committee recommended Police Officer John Borsch be granted a disability pension, but that the City Commission determine whether the disability was job-connected or non-job-connected. Attorney Jeff Myers, representing the police officer, stated John Borsch was a ten-year employee af the City of Clearwater with a total of 24 years of police work. He distributed a memo to the Commission relating to the emotional stress and physical exertion of the police officer. There is no history of heart problems in the family and three letters from area physicians were included in the packet which expressed the opinion that he is totally and permanently disabled for police work. Commission discussed setting a precedent by this decision and the applicants attorney stated a bill has been proposed to the legislature to compensate police officers for heart and lung problems the same as firemen are now covered. '@'" r; ~ :.;. , ' The City Attorney recommended the police officer be granted a non-job-connected disability pension as the emotional stress and physical exertion of this job were no greater than other positions in the city. the item be brought back for amendment adopted during Commission discussed the pending legislation and requested if the legislation is legislature. the next session of the Commissioner Garvey moved to award a non-job-related disability pension in accordance with the provisions of the Employees Pension Plan, Section 26.34, and that the appropriate officials be authorized to execute same.
