The City Manager presented the recommendation to grant
retirement pension under Section 5 of the Employees' Pension Plan
to Charles E. Hayden, Police Sergeant, Police Department, in the
amount of $868.53 per month, effective March 23, 1981.
Commissioner Garvey moved to accept the recommendation of
the Advisory Committee. Motion was duly seconded and carried
unanimously.

Discussion
Motion regarding disability pension, where permanent partial
disability benefits have been awarded under the Workman's
Compensation Act.
The City Manager reported between eight and twelve employees
will be impacted by this chan~e to the Pension Plan and the cost
to the City will approximate $10,000 to $20,000 over a period of
time.

Commissioner Garvey moved to rescind the following motion
and amendment approved at the January 19, 1981 meeting:
"Employees participating under Workman's
Compensation shall, when their claim is
resolved by the Workman's Compensation
Commission, have the option to allow the
settlement to be 1) prorated to a date
certain and then the employee allowed to
retire at that time under the City Pension
Plan, or 2) willingly deposited with the City
and the employee allowed to immediately retire
under the City Pension Plan." and
"The date to be considered would be the maximum
medical improvement date set by the attending
physician."
Motion was duly seconded and carried unanimously.

Commissioner Calderbank moved that the effective date
of a disability pension for an employee who has been awarded
permanent partial disability benefits under the Workman's
Compensation Act be the date that maximum medical improvement
is reached, as determined by the attending physician, provided
that the disability, once maximum medical improvement has been
reached, is of such a nature that it qualifies the employee
for a job-connected disability pension under the pension plan,
with the following conditions:
1. The employee must return an amount equal to any
Workman's Compensation award (with the exception of medical
benefits) received subsequent to the maximum medical improvement
date. The amount so returned must be such an amount as will
not result in the employee receiving doubl~ ~ompensation at
the time that such employee commences receIvIng any pension.
This amount will be placed into the General Employee's Pension
Fund.
2. This motion to be in effect until the date of referendum
implementing this program.
3. The Pension Advisory Committee to review and make
recommendations to the Trustees of the Pension Plan for disability
pensions.

the employee.
