I have been asked, as chairman of the committee, to present
the facts that we have concerning Karen Wilson and her request
to come under pension. For convenience I will do this in
chronological order.
02-06-80 The Pension Advisory Committee met and rejected Karen
Wilson for pension based on the opinion that was given
by Dr. Murphy, the city physician.
02-18-80 Karen Wilson wrote a memo to Mr. Weimer indicating a
desire to appeal the recommendation of the Pension
Advisory Committee.
02-21-80 A letter was sent by Dr. Johnson to Dr. Murphy advising
that Ms. Wilson was examined by him in 1973 and to
his knouledge has had no back problem since that date.
04-03-80 The City Commission met as Trustees of the Employees
Pension Plan and continued the case re: Karen Wilson's
membership into the Pension Plan.
04-15-80 Karen Wilson wrote a memo to Mr. Weimer explaining her
position and again requesting acceptance into the Pension
Plan.
06-02-80 Russell Britton wrote a memo to Mr. Weimer giving a
chronological history of the c~se from 2-18-80 to 5-26-80.
06-12-80 Dr. Sullivan wrote a letter stating he examined Ms.
Wilson on 6-9-80 and found her back to be normal.
06-17-80 Ms. Wilson wrote Mr. Butler a memo refusing the pension
refund check in the amount of $304.97.
08-11-80 Ms. Wilson wrote Mr. Shoemaker a memo listing the chrono-
logical sequence of events and Mr. Weimer wrote Mr.
Shoemaker a memc re: problems with Ms. Wilson in keeping
the appointment with Dr. Nach.
09-05-80 Mr. Weimer wrote Dr. Siek asking about x-rays and the
radiation risk presented by x-rays.
09-08-80 Dr. Siek wrote to Mr. Weimer advising x-rays are needed
for proper evaluation of a back problem and also that
the risk by radiation is nil.
09-11-80 Dr. Murphy wrote Nurse Bayexle advising that Dr. Nach
advised x-rays were needed for a proper evaluation of
Ms. Wilson's back.

The committee has discussed the case and feels that since Ms.
Wilson was initially not approved based on Dr. Murphy's medical
opinion and will not comply with Dr. Nach's request for x-rays,
the initial medical opinion stands and we still deny her for
membership into the plan. We realize that we cannot force her
to have x-rays taken against her will, but likewise we should
not be forced to accept an employee who is n~t a first-class risk.

x-rays. If x-rays have been taken sometime in
past, that should suffice, unless the patient has had a
serious accident or injury involving the back in the mean-
time. Many patients with normal backs by x-ray stil~ have
significant back problems that are on the, basis of other
than bone problems, namely ruptured discs, nerve injuries,
etc., so that an x-ray of the spine gives valuable informa-
tion pertaining to the bones of the back, but does not give
any information as far as what is happening to ~~e discs,
nerves, etc.

In answer to question *2, it is my opinion that there are
absolutely no physical risks involved for ordinary x-rays
taken for evaluation. The radiation dosage is so minimal
that it is not even to be considered as a bonafide risk.
The only time that there is some risk involved is when the
patient is known to be pregnant, and then the risk is not
to the patient, but to the embryo. There are no known cases
of having reproductive organs damaged by the taking of in-
cidental x-rays. However, if a patient has frequent ~epeated
x-rays, such as every week over a long period of time, then
there could be the problem of damage to reproductive organs,
but this would have to involve the excessive use of taking
K-rays, not the occasional use as in this case.

I was discussing problems concerning physical examinations with Joyce
Bayerle, City Nurse, and she s-uggested that you might be willing to give
me some answers. I am looking for advice and answers to questions
and the City is willing to reimburse you for your time involved.

We have problems where we need to know if an employee has a.ny phys ical
deficiencies of the back that would prevent the employee from being a
first-class risk for adm.ission into the City's pensi.on plan. The problem
stems from the fact that the employee refus es to have ex- rays taken
because of the risk to her reproductive capabilities. She had an ex-ray
'of her back (lateral view only) in Mayor June 1980, and r understand that
this ex-ray did not include the thoracic lumbar spine area.
My questions are: (1) Is there any way, other than through the evaluation
of ex-rays, that one can determine i1 there are any defects involved in the
back that would prevent the employee from being a first-das s risk for
admission to the pension plan; (2) Wbat would be the physical risk involved
if the ex:-rays necessary for evaluation were taken.

I do not know what her appointm.ent may be about; however, 1
have inquired regarding the physical examination appointm.ent
she had with D~. Nach.

The City Nurse advised me on .August 8, 1980, when I made an
inquiry that she bad made an appointm.ent with Dr. Nach for
Ma. Wilson after she waa unable to get aD appointment with
another orthopedic surgeon. I had,:requested that, if at all
possible. the wmmination should be given by some one other
then Dr. Nach ill as much aa Ma. WUson had refused to keep
a previous appolnbnent with Dr. Nach.
The nurse tells me that, in response to my inquiry, ehe talked
to D!'. Nach and that he had made an appoint:m.ent lor Ma. Wilson
to have ex-raya made at Clearwater Community Hospital
b9c&US8 the ex-rays that Ms. WU50n presented to him were not
adequate tor a proper ezamil1ation. He stated that her ex-ray.
did not include the thoracic lambar region. The Du.rse also
told me that Ma. WUson failed to keep the appointment.
In my meeting with Ms. Wilson before the appointment with
Dr. Nach was made by the City Nurse, ! had told her that we
would attempt to get an appoiutment with another orthopedic
doctor. (which we did) and she told me that .he "WaS ready to
get the examination over with and would even go to Dr. Nach.
I alao told her that we would accept her present ex-rilYs if they
were good (to eliminate the need Eor taking another ex-ray) and
that we would pay lor one of them (the newest).
I have no other information regarding the case; nor have I
talked to the PensioD Advisory Committee.

1. December, 1979 - I indicated "back trouble" on the employment p~sical
form because I thought the two times (in ten years) I had strained the
muscles in Y1fY' back during rigorous exercise constituted "back trouble."
In neither case did I need medical attention. I also indicated that
I felt the "trouble" might be due to a narrowed disk I he.d been told
I had. Dr. Murphy never asked to see X-rays or that I see a specialist.

2. Februar,r, 1980 - I received a form from the Pension Advisory Commdttee
that stated the Committee recommended oot allowing me membership in
the Pension Plan' because of "back trouble."
3. I called Ray ICamiIlskas who said he couldn't do anything - he recommended
I call l>!rs. Ba.yerle. Mrs. Bayerle said she would set up another
physical with Dr. Murphy.
~. I 'Was told by Cecil Henderson that I was on the Commission agenda for
denial of membership in the Pension Plan. I vas never informed of
this by enyone else.
5. I went before the Commission and was asked to see another specialist
for a third opinion, since Dr. Murp~ ~uld oot accept the favorable
opinion of the doctor (Dr. Johnson) who originally said I had a
slightly narrowed disk betveen t~ o~ rI1'J' vertebrae. Dr. Johnson sent
a letter to Dr. Murphy -indicating that there vas no reason why I should
be denied m~~bership in the Pension Plan - that my back was not
abnormal .

Dr. Murphy stated that I should go to a Dr. Nack for the third opinion.
I wanted a choice of doctors, selected by the City, rather than by
Dr. Murphy to a:void any subJectivity on anyone's part;. The City nurse
then ~&1d I could choose between Dr. Nack and his ~artner, no one else.
7. June 9 - I selected an orthopedic sur~eon ~rom the phone book (Dr.
0' Conner of 0' Conner, Sul.li van, and Slomka) and went to him for a
third opinion. Be said I did not have a "back pro-c~em", not even a
thin disk, and he wrote a letter to that effect.
8. Mr. Weimer sa.id that the City could not acceIlt atlY doctor that I
selected. I would have to go to one se~ected by the City., I finally
agreed. Mrs. Bayerle set an appointment up tor me with Dr. Nack.
9. August 4 - I went to Dr. Nack, who e:xamined:me and looked at the
X-rays I had from the other two specialists. lIe said I was very limber
and that he did not f'ee~ I had a back probleln, b\.\t that I would need
to have three more X-rays before he could make a final decision.
10. My husband and I do not vant me to have the additional X-rays because
of the risk to my reproductive capabilities. Unless X-rays of this
type ere proven to be necessary for medical reasons they should be
avoided. I do not feel that they are varranted in this case, since two
other orthopedic surgeons found additional X:-rays uonecessa..ry.

Dr. Murphy advised she should see an orthopedic specialist. He tried
to set up an appointment with Drs. Seik., Logue and Barrett. They would
not take the consultation. Dr. Murphy's of'fice contacted Dr. Nach who
would see Ms. Wilson on a consultation basis. However, she wanted to
make her own appointment at her convenience.
Nurse Bayerle ca.l1.ed Dr. Nach 1 s off'ice several times to see if Ms.
Wilson had scheduled an appointment, she had not.
5/21/80-Mr. Weimer called the Nurse to see if Ms. Wi~son could be
given a. choice of' doctors.
5/23/80-Nurse Bayerle set up an appointment with Dr. Nach at 2:45 p.m.
2 June 80 and with Dr. Michelle at 2:15 30 May 80. It was ~oo late
Friday to give this inf'ormation to Ms. Wilson.
5/26/80-Russ Britton hand carried the appointment
around 9:00 a.m. She indicated she would not see
Britton told her there was another Dr. available. She a.sked if they
were at the same address, she received an affi:r:ma.tive answer.

Britton brusquely took the appointment slip back and a.dvised Ms. Wilson

Pl~3e find attached copies of two documents from Karen Wilson supporting
her request to be granted membership in the City's Pension Plan. She first
presented her case to the Commission April 3. At that time the item was con-
tinued pursuant to the Commission obtaining additional information. MS. Wilson
provided what she felt was adequate additional information on April 15. She
vas not told that anything more was necessary for a decision. She is concerned
that her case was not brought up at the April 17 meeting, and each pay period
she is now having to pay money to FICA (nonrecoverable), rather than toward her
pension.
I would very much like to see her case again brought before the Commission
at its May 1 meeting, hopefully with a decision reached at that time. If anything
more 1s needed of her, please let me know in sufficient time to allow preparation
for the May 1 meeting. Your help in this matter would be most apprecia~ed.

The purpose of tMs memorandum is to support my request of the City
Commission for a decision in my favor concerning members nip in the
C~ty's Pension Plan. I am attaching a copy of a letter from my doctor
to the C~ty's doctor, supporting my premise that the,"back problem"

I have spoken, at length, with Dr. Johnson (a noted orthopedic surgeon)
regarding Dr. Murphy's analysis of my back condicion, and his placing
a weight restriction on my job, and Dr. Johnson feels that both the
anal-ysis and the weight restrict10n are unjustified. Since Dr. Johnson
has x-rayed my back, and is a specialist in the field, I feel certain
that the Commission will be interested in reading the attached and/or
contacting b1Jn. Dt:. Johnson has assured me that he will do whatever he
can to heJ.p me gain membership in the Pension Plan as he feels there is
no reason whatever to deny such membership.
I would very much appreciate your help in this matter.

Mr. Henderson informed me Thursday that the City Commission had
acted OD the Pension Advisory Committee's recommendation and denied
me membership in the pension plan based on my physical. I was not
informed that the Commission would be acting on this, and so was
unable to be present to provide any defense on my behalf. I also
find the Advisory Committee's recommendation a bit strange since,
after speaking with the City doctor who originally recommended my
dental, Dr. Murphy has decided (based on an outside specialist's
letter to him) to allow me admission to the Pension Plan.
I am very confused and dimnayed at t~e current situation and
uould very much appreciate anything you mght b. able to do in my
behalf to resol~e this problem.
