CITY COMMISSION BRIEFING SESSION
April 14, 1980
The City Commission of the City of Clearwater met in
briefing session at the City Flail, Monday, April 14, 1980,
at 9:40 a.m., with the following members present:

The City Manager called the meeting to order and the
following items were discussed.
Sand Key Beach Renourishment Contract and Amendment One
On July 6, 1979, the City Commission approved terms and
conditions, authorizing execution of a proposed contract for
City construction of a 11-mile long beach renourishment pro-
ject fronting private properties on Sand Key.
Andy Nicholson of the Engineering Department, stated the
contract had been presented to the property owners but proved
controversial in regard to protection extended by the property
owners to each other. A modified contract which will be
executed by all the property owners will be presented to the
Commission on Thursday. The contract provides for the property
owners to pay a set amount for the City's construction of the
beach, which will extend 150 feet from the seawall. The State
is to determine how much of the beach will be public and how
much private.
Adrian Bacon, attorney representing all the property owners,
recommended that a resolution be passed to request State approval
of the erosion control line.
Mr. Nicholson reported that once the contract is executed,
construction could begin in two to six months, with completion
in eight months to a year.
Commissioner Garvey questioned how the contract condition
relating to use of this constructed beach in figuring density
would be regulated.
Community Development Block Grant Program - Sixth-Year Appli-
cation
The Mayor questioned the ramifications of taking away the
East Clearwater swimming pool and substituting shelter. Joe
McFate stated the issue is, where is the money going to come
from for this needed pool for East Clearwater.
Commissioner Tenney stated he felt it was more important
to help people by providing money for home improvements i.e.
insulation, weatherproofing, etc.
The Mayor requested more input from the citizens,

Joe McFate said an application could be drafted and a
public hearing held for public input and, if needed, a second
public hearing could be held. He also stated they are pro-
posing to raise the loan and grant limits to keep up with
inflation and will bring this proposal before the Commission
at its next meeting.
Commissioner Garvey was concerned about the substandard
housing policies and the need to obtain right-of-way on Drew
Street for a second access to Condon Gardens. Don Jass stated
this was being looked at but at the present time has a low priority.
Keene Road Family Housing Proposal
The HUD Area office notified the City it had received a
preliminary proposal from Clearwater Associates to develop
Section 8 New Construction Housing, consisting of 89 two and
three-bedroom units for families to be located on North Keene
Road. The City has until May 3, 1980, to object to the pro-
posal on the grounds that it is inconsistent with our local
Housing Assistance Plan as approved by HUD and to provide any
information or comment which is relevant to HUD's consideration
of the proposal.
The Mayor reported that many of the surrounding residents
are objecting to a public housing project in their vicinity.
Joe McFate stated the City's objection must be based on
reasons other than people not wanting public housing in their
area. The application states the area is zoned RPD (residential
planned development), however, the RPD zoning for this parcel
may have expired. The surrounding areas are zoned RM-16
(medium density, multi-family). If the Commission wishes to
object, the zoning could be the reason.
Financial Disclosure
The City Commission established rules for Social Service
Agencies at their Commission meetings of 10/7 and 11/4/74,
whereby the policy requirement for Financial Disclosure was
also established. The consensus of the Commission is to re-
move that requirement.
Names for Parks and Recreation Facilities
Present City policy prohibits naming City facilities
after a living person. The Parks and Recreation Board has
requested the policy be changed and they be assigned respon-
sibility for recommending names for future City Parks and
Recreation Facilities. The Board will establish and submit
for Commission review criteria to be used for future recom-
mendations. The Commission will still have final approval
of the name of any City facility.
Fountain Proposal - Crest Lake
Staff recommends denial of the Greater Clearwater Chamber
of Commerce's request to install a fountain in Crest Lake,
due to cost factors of installation and maintenance.
The Mayor suggested Staff find an innovative energy
source to make operation of such fountains less costly.
Commissioner Tenney
Requested that citizens have the opportunity to make
comments and input information at the work sessions. The
consensus of the Commission was not to allow this, presently.

Review of Preliminary Site Plan of Countryside Tract 22 in
t fie NWA o section 29-28-16 - uncoast ames
David Healey, Planning Director, stated that with this
site plan, the City is obtaining a 15-foot right-of-way
easement on SR 580.
Commissioner Nunamaker suggested some of the parking
spaces be made of a permeable surface. The City Manager
will check with the City Engineer on materials available
for such surfacing.
Preliminary Site Plan - Ba a Shores Condominium Lots 11,

There are no'objections to this site plan and consensus
was to approve.
Review of Preliminary Site Plan - Villa's of Clearwater Beach
This item was not placed on the agenda as there was some
question as to the 18-foot setback requirement from the sea-
wall which has been resolved. There is no seawall in this
area and the setback is not required.
The development will consist of 3 buildings, with a 7
story building on the waterfront. Commissioner Tenney sug-
gested the height of this one building be reduced. Citizens
have complained about the height of buildings on the beach.
Preliminary Subdivision Plat - Cedar Heights Subidivision in
t F-NEA of Section 1-29-15 (S. and N.
This subdivision was originally to be platted in the
County. However, due to an annexation agreement, the area
became part of the City before the platting occurred. They
now need the Commission's appr)val of the subdivision plat.
Consensus was to approve.
Zoning Atlas Amendment from CG (General Business to PS
Pro essional Services) on Lot , the Wly 80 feet--or-'911

The applicant is requesting this be withdrawn as he is
no longer able to develop the property as he had wished to.
Commission consensus was to allow the withdrawal.
Land Use Plan Conformance with Pinellas Count Land Use Plan
for M&B 3 7 7-2 25 26, in ections 21 & 8- 8-1 - it )
The Planning Department is requesting Commission's
authorization to resubmit to the Pinellas County Planning
Council, a request for Land Use Plan Amendment from Recreation/
Open Space and Low-Density Residential to Public/Semi-Public,
for City-owned property east and west of McMullen-Booth Road,
north of State Road 580.

The City Manager stated that under tho old Land Use Plan
this area had been shown as Park. At that time the Land Use
Plan was only an advisory document. When the possibility of
the location of Square D in part of this area was raised, it
triggered the question of the Land Use Plan Amendment. The
Planning Department feels the Square D issue clouded the whole
Land Use Plan Amendment and, therefore, caused it not to be
passed.. Six months has elapsed since the initial request to
the PPC and the Planning Department would like to resubmit.
Commission consensus was to approve the resubmission.
City Attorney Reports
Resolution #80-45 - Supporting Reeresentative Jim Smith's Bill
Relating to the wing of ervice _ Charge? _Against Otherwise
'Fax bxemvt Organizations.
Commissioner Tenney requested explanation of the bill.
Mr. Bustin stated it was an attempt to clarify the language
that property owned by a church and used for other than
religious purposes be taxed, with the Property Appraiser
making`the determination as to whether or not it was being
used for religious purposes.
The draft bill which has been presented to the City
Commission for support does not concern service charges, but
rather, tax exemption.
Commissioner Nunamaker reported he had a call from a
religious lobbyist group in Tallahassee, wanting clarification
on what was taking place. He further stated he had also been
advised that in order to get the bill passed, that represent-
atives of the Commission should go to Tallahassee and meet
with the people who will get the bill before the entire
legislative body. It was decided that when the bill is being
considered, Commissioner Nunamaker and Mayor LeCher will
represent the City in Tallahassee.
Other Commission Action
Mayor LeCher
Questioned whether or not the City should recycle news-
papers, as some local churches are doing. The City Manager
stated the cost would be prohibitive, however, he would ask
Sanitation Division for their input.
Expressed concerns about the flooding of streets during
heavy rains. An elderly lady was caught in a low spot on
Druid Road during the recent heavy rains and had to be rescued
and her car towed. He requested a program be devised for
automatically noting hazardous areas during these heavy rains.
Commissioner Tenney
Asked when the City would be claiming the property from
Holiday Inn and was informed the exchange will take place upon
completion of construction.
He questioned whether the County Paraphernalia Ordinance
applies to the City. He was informed that we could opt out of
it, however, we are presently under that ordinance.

Requested a moratorium.on the conversion of rentals to
condominiums. As the State is addressing the problem, there
is some question as to whether the City has the authority to
impose a moratorium.
He also wants a letter sent to the County requesting
something be done about the trucks on Belcher after six
o'clock. Citizens are complaining about,the noise.
He also stated that after the national coverage the City
received from the Sixty Minute segment on Scientology, that
the City has to take a stand against the actions'of the Church
of-Scientology. He feels the whole country is watching Clear-
water to see how we solve this problem.
