Planning Director Dave Eiea�.ey reported the area narth
of Marianne �0 5omerset �rom the Gulf to the Bay is under
cansideratian for rezo�ing to current� use. He reviewed �he
present zoning and the pxopas�d zoning. Manda].ay Avenue
between Marianne and Baymon� wi�l remain CG {gen�ral business)
and i.ncl.ude a half-b�ock on each side of the street. The
balance o� the area wi11 be CTF-28 (cammercial/touri.st
�acilities}. The Yach� Basin Apartments wa,lJ. be rezoned to
RM-20 (high densi.ty, mul�z-�amily): this a.s a 2-story devel-
opm�nt in �he high density ca�egory. North of Bay Esplanade,
Manda7.ay Avenue will be limite� to CG �o the strip currently
in use and the purpose is to limit �he business area. The
church property wiZl be rezaned to ISP (i�istitutianal semx-
pubiic), the current use. The properties nor�th o� Bay
Espl.anade wa1.I, generally be rezoned to xheir current use.
There is a ma.x�ure of uses and the exi.sting density wz].l. be
controlled by �he proposed zoning.
The Planning Director also discussed a new zone --
residential/x�sort, which was da�scussed as an alternative.
However, a.t wi.3.1 requir� a code amendmen�. There have been
several pxaposed cando projects £or the area north of Bay
Esplanade.
The Planning Director reported tihis is the first o�
approximately 24 areas being reva.ewed to assure consistiency
between zoni.ng dis�ricts, the Land Use Plan, and existing or
desa.red deve].opmenti characteristics.

Zn 1973, a master deveiapment plan for property awned
by Field Construc�ion Assoc�a�es was approved. The a1�ow-
able density at that time was 34 un�ts per acre. Two o� the
proposed 7 buildings were construc�ed. �rdinance 1�56 was
adopted, wha.ch rezoned the property designated CTF-34 to
CTF-2B. Field Associates filed suit seeking an order which

After much litigation and a reversal ot the decision,
the City and the developer negotiated a proposed settlement
�o resolve a11 the zssues in thc �i��gation. The sett�emen�
agreement pravides £or cansCruction o� the remaining unitis,
praviding a11 ather aspects of the City Code a� Ordinances
are met wi�h the specific exception fnr building height of
85 �eet ra�her than 80 �ect and a parkzng ra��o o� �.25
Sp�C�S per uni� rather than 2.
-The developer w�11 meet ai1 significant code req.uirements
such as wa�erfront vzsta, building separat�on, and electrical,
plumbing and ��re codes; and the di�fsrence o£ the addi�ional
few un��s make �his an accep�able se���ement.
Satis�action of Si�e P�an Conditions �or Holiday Inn
When the Comm�ssion approved �he HoZiday Inn Site Pian,
a condition af approval was that adequate assurance he given
for public access to and use of the beach area. An agreemen�
has been drawn be�ween tihp praperty owner, Holiday Inn, and
the City, to assur� such public access and use.
A pubiic hearing will also be held ta consider an �
exchange a� City property �or Taylor property o� comparable
value for the 10x75-toot strip on ihe Beach. The City
Manager suggestied the site plan conditions be continued
until aiter the pub�ic hearing.
• A Ie��er from the 5tate has been received stating the
accreted land beZongs to the property owner as it was the
result o� the City's pier and groin developmen�.
The Haliday Inn prefers ta £ile a palicy letter ra�her
than the agreement. In the agreemen�, the owner of the prap-
er�y and the lessee agree ta the area being bounded on the
north by Papaya, on �he south by Aiarianne, on east by Man-
dalay, and on the west by the Gul� o� Mex�co; tha� th�
general publ�c have unimpeded zngress and egress, pass and
repass, and the right �o use and occupy for beach re�ated
purpas�s �hat portion o£ the tract lying between the high
water mark o� the GuZt ot Mexico and the seawall located
on such property, such area representing the beach area
associa��d with such �rac�.
Holiday Inn has expressed concerns that the exchange
of 3 parcels af their property could af�ect �heir established
density.
Revi�w o� Preliminary S�te P1an - Menna Matel
The property is currently vacan�, contains 1.2 acres,
and is �acated an the nor�h szde a� Gulf-�o-Bay Boulevard
approximately 650 fee� wes� of Bayv�ew Boulevard. The
dev�lopment w�ll consist o� a�8-unit motel.
The Resource Development Gommittee r�cammended approval
subject to acquisition of a permit �ram the Dep�r�ment of
Environmenta� Regulatians £or installat�on o� a tempaxary
sand �ilter sewage �reatmen� facili�y.
Au� �o the moratarium at the East P1ant, the applicanx
has applied for a temporary permit for a sand filter sewage
treatment facility. The waste wxll st�ll go �o the East
plant but wi1� be 9U$ pure a�ter having passed through the
sand �ilter sys�em and wi11 not create as much o� a load on
the �as� P�ant. The owner has agreed to pay alI sewer tap
�nd month�y scrvice fees.

The proposed shoppa.ng center is a strip shopping and
business office development containing 1.735 acres Ioca�ed
at �.he northwest corner of Hampton Road and Gulf-to-Bay
Boulevard.
The item was con�inued to permit review of the ingress
and egress o� Gc��,f-to-Bay Boulevard. 'The develope� has since
submit�ed a rev�.sed site plan e].a.minating any access to Gul£-
to-Bay Baulevard.
Commissioner Tenney expressed c�ncerns abaut tree re-
�noval by deve�,opers. The Tree Orda.nance pexmits removal as
long as �he txees are replaced.
Parking at this shoppi�g center is iimitsd. Due to the
use (a portion of �he center �.s devatec� to of£ice space) which
daes not require as much garking space as retail.
Si.te P�.an Review Policy
Staff recommends a Gode amendmen� wherehy ali projects
involving both si�e plan reva.ew and variance or special
exception, require site plans be submitted and reviewed by the
itDC pxior to a xec{uest for variance ar special exception to �he
Board of Adjustment and Appeal on Zoning or City Cammission.
Moccasin Lake Park
The Parks and Recreation Direc�or reported a$100,000
grant is available to the City, under the FZarida Recreational
De�ela ment Assistance Program, ta develap this park. The
first $50,OQU is an autright grant buti the second $5U,a��
requires an equal match from the City, A concep�ual site
pI.an has been prepared, with an estimated cost o� $169,770.
The residents o� a portian of Owen Drive, where tih�
entxance �n the park wi11 he pZac�d, have petitioned the
Commissian not to designate Owen Drive as an ingress/egress
�aci.lity £or the paric.
Mr. Wi.lson nated that there i,tere severa�. o�her alternatives
�or access which are extremely expensive or will af�ec� other
citizens, with the possible excep�tion af obtain�ng an ease-
men� from U.S. Hame thxaugh an��her undeveloped area.
Esti,mated cos'� is �45,DOQ. Mr. Wilsan mainta�ned that access
to a city park doas no� creat� traf�ic jams al�hough tihere
may be some additxanal traffa.c. T�e park wi11 on�y have 40
parking spaces. Visitors come and go and do not a11 arxive
at one time or leave at one time. Ev�n'�ua].ly, a�ence wil�
be needed axound the pro�ect, a� a cost af $25,000. The
park will be closed at sundown and thexe will be no lights.
Co�missianer Tennay suggested n camping area be set
aside ior Scouts. It was sugges�ed service club donations'
