The City Attorney reported Ordinance 2U85 wiil establish
the rates tio be charged by Vision Cab1.e and aiso set the
fxanchise £ee at 3$. The City Manager reparted zf 5$ were
reques��d it would have to be justified. Commissianer Tenney
requss�ed the Ci�y Manager research th� 5$ fee and advise if
any citi.es in F].flrida are recea.ving �ha�, amaunt. The bas�.c
rate wi.Zl he $6 for the tirsti outlet. When the company wishes
to raise i�s ra�es, the City must be noti£i�d. Commissioner
DeBlaker suggested a].1 raCes be included in one ordinance
ins�ead af some in the �ranchise Qrdinance anc� same in this
ordinance. The franchise ordinance provides that the City
sha�1, by ordinance, se� fair and reasanable rates to both
company and subscribers.
Commi.ssioner DeBlaker question Arta.cle IIF of the
franchise ordinance that provides �or a revision o� �he rate
schedule anytime after three (3) years; and Sec�a.on 5 0�
Ordinance 2085 which pxovides up to 7.0 autlets wi�hout charge
at public schoo�s, colleges, and municipal buildings. The
City Manager reported this would be ten (IO) autlets �or each
of the designate� categories.
Commissioner I3unamaker requested a clause reauiring an
ongoi.ng construction cost x-eport to the Commission at
periodi.c i.n�erva�.s .
Oz�di,nance 208A - The City Manager reviewed the ordznance
and sta�ed thzs nonexciusive franchise wil7. be for a I5-year
pera.od. Cammission discussed �he �i»anciai capabi�ities of
Vision Cable of �'inellas, �nc. The�ordi.nance requires that
they provide a 1e�ter of credit in the amount of $20 000; a
corparate suxety construction bond in the amount o� �5Q4,000;
liabi],�.�y insurance; and an annual �inancial repor�. There
was considerable discussxan on poten�ial bankruptcy and vari.ous
sa�eguards o��ered by �he letter of credi.� and the cons�ructi.on
bond. The att.orney for Vision stated the parent company wauld
guaran�ee t3nancial responsiUility.

The Employees' Pension Fund presently has �zx,oao,aoo
inves�ed. The Exch�nge Bank o� TAmpa is custodian of �he
investments and k�eps records, makes comparisons and annual
per�axmance xeports of tihe money managers.
Jim 5hively of the i�ya�t Company, pensian fund Gan�
sultants ior the City, reviewed the pxocedures under tha
o1d p�an and n,�tied thnt when the �und makes money the Ci�Gy's
cantr�.bu�ion is reduced. He sugges�ed the Commissian be
aware o� a new 1aw which became effective 3anuary 1, Z980,
which states the Board a� Trustees can be personal3.y he�.d
liab].e far �unds turned over ta an investment caunsellor if
they do no� lis�en �o advi.ce and monitor per�ormance. If
th�y ignore advice they are in trouble.
John Wi],loughby of The Exchange Bank of Tampa, discussed
the bank's pracedur�s and stated the Ci�y has Zimited options
fox i.nvestment of their funds, s�ch as 5'iOC�CS � bonds, ax
insurance company annuities. The Gity needs 1nng�term a.nvest-
ments and treasury bi11s do not fil.�, the bi.�7.. The cost for
�investment management services axe deducted �rom investment
returns at the xate of apgxoxa.ma�e�y one-ha�� of one percent
ior Aetina and Loomzs-Say�es (Washington}, and one pc�xc�nt �ar
Loomis-Sayles af Memphis. .
Firemen's Pension
� Thxee bi.7.ls axe be�.ng submi�ted �o the Legislative De�.e-
gation relating to changes in the Piremen's Relie� and Pension
Fund of the �ire Department of the City o� C].earwa�er. One
bi11 provides that re�iremen� a't age 65 shall not pertain to
chiefs, whose age I.imits are gaverned by Civi� Service rules,
and ela.mi.nates �he prouision �hat in no case sha11 the re�a.re-
ment pension provided exceed 60� of the prevaxling wage o�
the lowest xank he�.d by member during the 3 years immedia�ely
preceding rsti,xemen�.
Tha.s Pension Fund was also nat actuarily stable �.n 1962
and new firemen, at thai time, were placed in the General
Employees Pension Fund. Current].y thexe are sti11 19 t�.remen
under the o].d p�.a�, with approxi.mately 44 already retired.
�ventually the plan will be phased out when a11 the �i.xemen
have retired, and bene£its paid. Any balance in the fund
would revert to the City's pensi�n plan, The fi.remen are
concerned that the �und may nat have reserves sufficient
to pay the ben��a.ts .
The second bill will amend the act to allow �he City to
� app].y non-ad va�.orum revenues to mee� the obligatzons imposed
and �he City agr�es to app�y such funds �or as lang as any
person is entitled to campensati�an under thi.s act.
The �h�.rd bili wi11 amend the provision that a person
retiring above the rank af captain sha1�, have h�,s pension
calcu].ated at no higher xat� �Chan captiai,n. The amendment wi11
read: "Any person retiri,ng above the rank of captain sha11
have his pension and any adjus�ments calculaied at no high�r
than the rank o� ca�tain, unless he sha�1 make up any de�i.ciency
a.n his contributions, with interest ca3,culatec� at the rate ot
_$ p�r annum, which sha11 be the dif�erence be�ween the
contributions he made and the con�ributians which he shou],d have
made had the contri.butions been calculated according to hi,s
actual ranlc and not limited to the rank of captain."

PACT Ordinance and some docvment changes wi.Zl be brought �o
the Commission at the regulax meeting. He also reported the
PACT Commi��ee has xecea.ved many pledg�s but one o� the
requirem�n�s was tha� PACT have a certain cash sum in the
bank. The amended change wi11 prov�de thati the endowment

�he construction of Big Pier GQ. The groin was reconstructed
by the Tayl,ors a.n �he early 50s and later removed and is nat
now in p3.ace. The appI.icant has had a detailed title search
made with an $�8-mill�on guarantee. The proper�y apprai.ser
has been intormed of tihe situation and zvill receive �-years
back taxes which wexe not here�a£ore collected. That partion

The Planning Director discussed �he site plan, stating
