February 12, 1979
The City Commission of the City of Clearwater met in briefing
session at the City flail, Monday, February 12,1979, at 9:30 a.m.,
with the following members present:

The City Manager called the meeting to order and the following
items were discussed:
Consent Agenda:
Notifications of Expirations and Resignations of Advisory
Board Members:
Community Relations Board:
Ordinance '1843 in effect abolished the former Community Relations
Board, consequently there are 13 vacancies. The City Manager requested
direction about recommendations to boards as some are very specialized
boards for which it is difficult to find qualified members. He
stated that the former Community Relations Board members would serve
until the new board is appointed. The item will be placed on the
agenda for notification.
Housing Code Violation ~ City Resolution '78-116
The owner has requested a time extension to comply with the Code
requirements and the consensus is to grant a 60 day extension.
Downtown Development Board - Request for Joint Meeting
The City Manager sent a letter to the Board suggesting they wait
until the Land Use Plan has been adopted. Commissioner DeBlaker
pointed out the Downtown Plan must be adopted establishing the core,
with appropriate public hearings and Planning Council approval,
before the ordinance is drawn. However, the item will be placed on
the agenda for discussion with the Board as requested.
Main Library Renovation/Construction Design Contract
Commission questioned the missing page of the agreement setting
forth additional services to be provided at a fixed fee for:
a. architectural and structural, mechanical, electrical engineering
services, investigate existing conditions $2,200; b. preparing a
set of reproducible record prints of drawings showing significant
changes in the work made during the construction process $1.400.
Considerable discussion ensued concerning the time frame and the
architect's responsibility for meeting the contract dates.
The City Attorney stated the City's recourse would be to sue
for breach of contract if the requirements were not met. Commissioner
DeBlaker questioned the timetable for the first phase stating she
felt the date was unrealistic. She feels the date of the fi.rst
phase should be set back approximately one month to allow for input
by the Commission, the Library Board and the Public.

The City ~tanager recommends that some critical dates be set
with the understanding that we have the prerogative to ask for an
extension if necessary.

Termination of Agreement with Clearwater Housing Authority
The split authority provided by this agreement has created
administrative difficulties and since the authority is now able to
pay all salaries and benefits of the employees required to conduct
its operatfon it is recommended the agreement be terminated subject
to HUD concurrence.
Elderly Housing Site
An appraisal has been ordered on property in the vicinity of
Barbee Towers which is owned by Minnesota-Ohio Oil Company. The
appraisal has not yet been completed.
An offer to sell a 1.51 acre parcel in Morningside has been
received, with the proposed usage being for elderly assisted housing.
Commission does not favor this location. Commission directed the
City Manager to look at various sites for the project and the item
is to be removed from the agenda.
Sign - Morningside Subdivi5ion
The sign has already been installed and approval of a permit is
recommended with the Association agreeing to remove or relocate
upon request of the City Manager.
Marina Auditorium - Waiver of Usa~c Fees for Coast Guard Auxiliary
There was discussion concerning possible problems with other
non-profit organizations requesting waivers.
Commissioner Martin suggested an agreement be entered into
stipulating fees will be waived in exchange for their providing
free public meetings. The item will be approved with an agreement
to be brought back to the Commission.
Agreement between City of Clearwater and Mr. John Williams, Tennis
Professional at the McMullen Park Tennis Complex
Discussion ensued regarding items available for sale at the
Complex. Commissioner Martin questioned whether the City is com-
peting against private business. The City Manager stated the City
is not, this matter having been carefully investigated. He
recommends approval of the agreement stating it is one of the best
tennis professional agreements in the entire state.
ParkinR Management ARreement - Clearwater llieh School Band Boosters
Commissioner Tenney recommends the parking fee be raised to
$2.00, stating this is the minimum parking fee charged for other
activities in the Bay area. '
Considerable discussion ensued regarding the merits of raising
the parking fee, the general consensus being that the maximum should
be no more than $1.00. It was suggested that the City Manager
check with St. Petersburg concerning their arrangements.
Agreement Between City of Clearwater and Clearwater Babe Ruth
Baseball League, Inc.
Commission objected to the change in the agreement concerning
clean-up procedures and the City Manager is to determine how many
employees are on hand during these games.
Surplus Property
Once the items are declared surplus an effort is made to obtain
bids on any usable items. If no bids are received, the material is
disposed of as scrap.
The City Manager assured the Commission nothing would be dis.
posed of for which a use within the City could be found.

Verbal Reports & Other Pending Matters (Also see page 4)
Phillies Appreciation Day
A budget appropriation of $800.00 for a dinner for the Phillies
will not be needed as the Chamber of Commerce will have a golf
outing instead this yenr. It was suggested the City purchase a
banner not to exceed $800.00 to extend across Cleveland Street
welcoming the'Phillies to ,ClearWater.
Preliminary Site Plan Review, Tract 21 (U.S. Homc)
The Community Impact Statement was waived and the Tract is
currently in the process of being rezoned fr~m RM-24 to RM-12.
Recommendation is to approve the plan and the Planning Director
concurs.
Commissioner Martin requests the plan show only one exit on
S.R. 580. She suggested the developer indicate only one exit on
S.R. 580 on their sales drawings in fairness to purchasers in Phase I.
CPD Plan ChanRe, Countrysidc Country Club
Commission questioned the number of parking spaces in Phase I.
The plan provides 15 spaces more than required, but 19 lcss than
they currently have. Commission approval may be granted with the
stipulation that in Phase II a more porous surfacing be used subject
to the City Engineer's approval.
Extension of the RPD and approval of revised plan for Phase III of
Sunfish Bay (Tibma)
Considerable discussion ensued concerning the history of this
project and whether or not the developer had lived up to the original
plan and restrictions.
The Planning Director feels the intent to comply is evident
and requiring the developer to remove certain plantings would be
more damaging than allowing them to remain.
Consensus is to deny the request for extension and schedule the
item for public hearing to rezone with height restrictions clearly
outlined.
Purchase Contract Award - Twelve-inch (12") Cutter Head Dredge
Max Battle, City Engineer, outlined the complicated bid pro-
cedures which were followed on this item. Eight bids were received;
1 did not meet specifications for either a new or used machine and
only one met specifications for a new machine.
The City Engineer explained some of the procedures involved in
the dredging of Dunedin Pass also in the offing and, considering
all factors, the recommendation is to purchase the new machine which
meets specifications. Discussion ensued concerning personnel costs
connected with the dredging operation. These employees are covered
under the Federal Longshoreman's Act. Personnel used in the
dredging operation would be under the supervision of the Harbormaster
and he recommends they be contract employees only for the length
of time of the dredging operation.
A fully qualified dredgemaster cannot be hired at a salary less
than $16,000. This figure is in line with salaries paid in Boca
Raton and in Palm Beach County and is low compared with the Corps
of Engineers.
The City Engineer reported if the bid is approved as recommended
the Company representative will present a change order at the time
of award which will increase the height of the dredge by one foot,
which they feel is advantageous because of the wave action in this
area, at no additional cost to the City.
Discussion ensued as to disposition of the dredge material.
It is the Engineering Department's opinion the City's best interests
would be served by purchasing the new dredge.

Public Hearings
Starcrest Library Site
Commissioner DeBlakeT reported George Hunt has his property
on the next Planning Council agenda for a rezoning and she presumes
he will then ask for annexation.
Bid
Request for Proposal - Study Natural Gas Utility
The City Manager reported he would have copies of the actual
contract to distribute before Thursday's meeting.
Verbal Reports and Other Pending 'Matters (Also see page 3)
The City Manager reported there would be recommendations for
proposed legislation. He advised he would be in Tallallassee
Wednesday and would not be present for canvassing th~ vote. Jeff
Butler will be acting in his place.
Public Hearings
Requests for Rezoning
e. Lots'l and 2, Block A, J. J. Eldridge's Subdivision
from RS-sO to RM-12 (Wickman).
Commission questioned division of the property into single
family lots. The Planning Director stated this would require street
access to all lots, the street being either public or private.
The Planning and Zoning Board and the Planning Director recommend
denial of the application and approve RM-8 zoning instead. The
City would then return with a complementary application to rezone
the appropriate adjoining area to establish a valid district.
f. Portion of S 1/2 of Sect~,on 8-,29-16 from RPD to
RM-16 (AE Realty Partners) (To be continued).
Commission questioned this continuance and it was reported a
conflict of dates had developed. Recommendation is to continue
until March 15, 1979 with the City to initiate rezoning if the
applicant does not proceed, at that time.
Commission questioned the time frame for several area rezonings.
The Planning Director advised the work on South Greenwood would be
completed this week, the North Beach will be the next area.
City Attorney Reports
First Reading,
Ordinance *1888 - Amending Chapter 13 re Licenses, to regulate
Topless Dancing, Etc.
The City Manager reported there is a County ordinance relating
to this subject now in effect, and this ordinance was prepared under
the direction of the Chief of Police.
First Reading,
Ordinance 11890 - Amending Section 2-35 of Code Specifyin~ Printing
Requirements for Notices
Commissioner DeBlaker questioned whether different size print
could be used for different type ads, with Public I~aring ads in
larger type. The City Manager advised the ordinance sets minimum
size only. Advertising with the Clearwater Sun is less expensive
than with the St. Petersburg Times.
Other Commission Action
Commissioner Martin questioned procedures used for obtaining gasoline
for police cars. The City Manager advised gasoline is purchased

through' a bidding process and is subjected to a very careful cost
analysis.
, Discussion ensued concerning cost of car wash for City
vehicles.

" Considerable discussion ensued concerning the mailing made
prior to the February 13, 1979 election, and it is the Commission
consensus the activity should be investigated.

,j Commissioner Tenney advised he is going to be, in Washington
D.C. in March and would like Commission support for him to approach
Senator Dole requesting an investigation of cults in the ,Clearwater
area.
