WHEREAS, it has been determined by the City Commisaion
of the City of Clearwater, Florida, through the enactment of Chapter
95 of the Code of Ordinances that for the purpose of promoting the
health, safety and general welfare of the citizens and residents of
the City or Clearwater lots, parcels or traoto of land within the
oorporate limits of the City of Clearwater, Pinellas County, Florida,
suoh as desoribed below should be oleared of weeds, rubbisht debris
nod other noxious material; and
WHEREAS, notioe pursuant to Seotion 95.07 of the Code of
Ordinanoes was provided to the owner of eaoh of the lots listed below
that suoh lot was in violation of Cnapter 95, the Lot Clearing Codej
and
WHEREAS, pursuant to Seotion 95.07 of the Code of Ordinanoest
following the determination that a violation exists, the property
was posted requesting oomplianoe within fifteen (15) daysj and
WHEREAS, notifioation was given to each property owner advising
of the right to appear at a hearing before the Lot Clearing Board
to oontest the findings of violation and present evidenoe relating
to why suoh lot should not be oleared or mowed by the Cityj and
WHEREAS, the Lot Clearing Board, pursuant to Seotion 95.09 of
the Code of Ordinanoes, has authorized each of the lots listed below
to be cleared by the City and the aotual oosts of olearing or mowing,
'plus adminiStrative costa, to be assessed against each property owner;

1. Tha~ pursuant ~o Seotion 95.08 of the Code of Ordinances
the properties listed on Exhibit A, attaohed to this Resolution and
made a part hereof; after notice to each property owner, were
oonsidered by the Lot Clearing Board at a pUblic hearing hold

with the question being should eaoh lot be oleared or mowed by the
City and the oosts, inoluding administrative costs, assessed against
eaoh property owner on the list and following the hearing of the Lot
Clearing Board, pursuant to Section 95.09 of the Code of Ordinances,
authorized the City to olear or mow each lot.
2. That pursuant to Section 95.13 of the Code of Ordinances
the owner of eaoh lot listed on Exhibit A has been provided with a
notioe and opportunity, thirty (30) days, within whioh to pay the
costs and administrative oharg~s set forth on Exhibit A, but no
payments have been reoeived.
3. That eaoh lot listed on Exhibit A, having been oleared or
mowed by the City pursuant to authorization by its Lot Clearing Board,
the City Commission pursuant to Seotion 95.11 of the Code of
Ordinanoes hereby assesses a 11en on behalf of the City of Clearwater
againat eaoh parcel shown on Exhibit A for the aotual oosts of mowing
or Clearing, plus administrative oosts, as shown on Exhibit A.
4. That the City Clerk is hereby directed to prepare a notice
of lien against each property listed on Exhibit A and to fl1e the
same 1n the office of the Clerk of the Cirouit Court of Pin31las
County, Florida.
5. That this Resolution shall beoome effeotive immediately upon
its adoption.
