A RESOLUTION OF THE CITY OF CLEARWATER, FLORIDA,
ASSESSING CERTAIN REAL PROPERTY CONSISTING OF
LOT 7, JANIE DANIELlS SUBDIVISION, FOR THE COSTS
OF DEMOLITION OF A SUBSTANDARD STRUCTURE, IN THE
AMOUNT OF $3,250.00.
WHEREAS, pursuant to Chapter 138 of the Code of Ordinances, City of
Clearwater, and the Standard Building Code, the Building Official has
determined that certain real property hereinafter described and the structure
situated thereon was unsafe, unsanitary, unfit for human habitation, and
dangerous and detrimental to the health, safety, morals and the general
welfare of the community, and did not properly comply with the requirements of
said Code; and
WHEREAS, the owner of said real property wished to dispense with formal
notice and hearing prior to the structure peing demolished and has executed
a Waiver of Notice and Hearing, requesting the City to demoli.sh the structure
utilizing its normal procedure; and
WHEREAS, the City of Clearwater has caused the demolition of said structure,
and the cost of such work should now be assessed as a lien on behalf of the
City of Clearwater against said property;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY
COMMISSION OF THE CITY OF CLEARWATER, FLORIDA,
IN SESSION DULY AND REGULARLY ASSEMBLED, AS
FOLLOWS:
1. Pursuant to Chapter 138 of the Code of Ordinances, City of
Clearwater, and a properly executed Waiver of Notice and Hearing, the owner
of the real property described as:
Lot 7, less the following described portion: Begin at the Southwest
corner of said Lot 7. run thence Northerly along the Westerly line of
said Lot 7, 1.26 feet, thence Easterly 34.98 feet to the Southerly line
of said Lot 7, said point being 35 feet from the Southwest corner of
said lot 7, thence Westerly along the Southerly line of said Lot 7,
35 feet to the Point of Beginning, JANIE DANIELlS SUBDIVISION, according
to the plat thereof as recorded in Plat Book 5, Page 23, Public Records
of Pinel1as County, Florida.
The record title holder to said property is Joe A. Martinson, Jr.,
P. O. Box 8192, Madeira Beach, Florida, according to the Public Records
and the current tax roll of Pine1las County, Florida;
having vOluntari,lY requested the City of Clearwater to demo1 ish the structure
thereon, and the City of Clearwater, having now completed said work, does
hereby assess and charge a lien on behalf of the City of Clearwater, against
said real property for the necessary cost incurred as follows:

2. As soon as practicable. a Certificate of Indebtedness against the
described real property for the amount of the assessment shali' be prepared,
which Certificate shall constitute and be a prior lien to all other liens
"
ex.cept the lien for taxes. Said Certificate, when issued, shall be payable to
bearer in not exceeding ten (10) equal installments with interest at a rate not
greater than eight per cent (8%) per annum, payable annually.
3. The City Clerk is hereby directed to prepare a Notice of Lien in the
amount of the assessment against said property, and to record the same in the
Pu~lic Records of Pinellas County, Florida.
4. This Resolution shall take effect immediately upon adoption.

WAIVER OF NOTICE AND HEARING
WHEREAS, a one-story structure located at 1149 Pierce Street. legally
described as Lot 7. less the following described portion: Begin at the Southwest
corner of said Lot 7. run thence Northerly along the Westerly line of said Lot 7,
1.26 feet. thence Easterly 34.98 f~et to the Southerly line of said lot 7, said
point being 35 feet from the Southwest corner of said Lot 7, thence W~sterly
along the Southerly line of said Lot 7. 35 feet to the Point of Beginning,
JANIE DANIEL'S SUBDIVISION. according to the plat thereof as recorded in Plat
Book 5, Page 23, Public Records of Pinellas County. Florida, is in a state of
dtsrepair to such a degree as to constitute a public nuisance; and
WHEREAS, such structure ~hould be demolished; and
WHEREAS, prior to taking such action, 'the property owner is entitled to
notice and a public hearing before the Ci~y Commission; and
WHEREAS, such property is presently owned by Joe A. Martinson, Jr.,
pursuant to an instrument dated January'21. 1986, recorded in O. R. 6155,
page 650, of the Public Records of Pinellas County, Florida; and
WHEREAS. the owner of such property wishes to dispense with formal notice
and hearing prior to the structure being demolished; and
WHEREAS, the owner understands that the City will demolish such structure
and that the costs of such, demolition will be assessed against the property;
NOW, THEREFORE, the owner agrees as follows:
1. Joe A. Martinson, Jr., being the ownel' of property located at
1149 Pierce Street, Cleatwater, Florida, including a one-story building located
on th~ property. acknowledges that such structure is in'such a state of disrepair
that it shOUld be demolished.
