WHEREAS, it has been determined by the City Commission
of the City of Clearwater, Florida, through the enaotment of Chapter
95 of the Code of Ordinanoes that for the purpose of promoting the
health, safety and general welfare of the oitizens and residents of
the City of Clearwater lots, parcels or tracts of land within the
corporate limits of the City of Clearwater, Pinellas County, Florida,
suoh as desoribed below should be cleared of weeds, rubbish, debris
and other noxious material; and
WHEREAS, notice pursuant to Seotion 95.07 of the Code of
Ordinanoes was prOVided to the owner of eaoh of the lots listed below
that such lot was in violation of Chapter 95, the Lot Clearing Code;
and
WHEREAS, pursuant to Seotion 95.07 of the Code of Ordinanoes,
fOllowing the determination that a violation exists, the property
was posted requesting complianoe within fifteen (15) days; and
WHEREA~, notification was given to each property owner advising
of the right to appear at a hearing before the Lot Clearing Board
to contest the findings of violation and present evidence relating
to why such lot should not be oleared or mowed by the City; and
WHERE~S, the 'Lot Clearing Board, pursuant to Seotion 95.09 of
the Code of Ordinances, has authorized each of the lots listed below
to be'oleared by the City and the actual coata of olearing or mowing,
plus administrative oosta, to be assessed against each property owner;

1. That pursuant to Seotion 95.08 of the Code of Ordinanoes
the properties listed on Exhibit A, attaohed to this He$olution and
made a part hereof; after notioe to eaoh property owner, were
oonsidorad by the Lot Clearing Board at a publio hearing held August
13. 1985. Oatober 9. 1985. October 22. 1985 and HOY-oor 12. 1985
with the question being should eaoh lot be oleared or mowed by the
City and the oosts, inoluding administrative o~stsJ assessed against
eaoh property own~r on the list and follOWing the hearing of the Lot
Clearing Board, pursuant to Seotion 95.09 of the Code of Ordinanoes,
authorized the City to olear or mow eaoh lot.
2. That pursuant to Seotion 95.13 of the Code of Ordinances
the owner of eaoh lot listed on Exhibit A has been provided with a
nvtioe and opportunity, thirty (30) days, within whioh to pay the
oosts and administrative oharges set forth on Exhibit A, but no
payments have been reoeived.
3. That eaoh lo~ listed on Exhibit A, having been oleared or
mowed by the City pursuant to authorization by its Lot Clearing Board,
the City Commission pursuant to Section 95.11 of the Code of
Ordinances hereby assesses a lien on behalf of the City of Clearwater
against eaoh paroel shown on Exhibit A for the aotual oosts of mowing
or olearing, plUS administrative costs, as shown on Exhibit A.
4. That the City Clerk 1s hereby direoted to prepare a notioe
of lien against eaoh property listed on Exhibit A and to file the
same in the offioe of the Clerk of the Circuit Court of Pinellas
County, Florida.
5. That this Resolution shall beoolDe effective immediately upon
its adoption.
