A RESOLUTION OF THE CITY COMMISSION OF THE
CITY OF CLEARATER, FLORIDA, ENDORSING PASSAGE
OF HOUSE BILL 42.

WHEREAS, the local human relations ordinances of local gpvern-
ments are presently only enforceable in County Court, which is most
restrictive in the amount of damages that can be awarded with
$500.00 as the maximum, which means any order for more then
$500.00 is invalid; and
WHEREAS, the Circuit Court has the authority to award higher
amounts for damages;. and
WHEREAS, House Bill 42 has been introduced to gave local
enforcement agencies such as the Clearwater Office of Community
Relations, through the approval of the city Commission, authority
to have the City Attorney file in Circuit Court those cases requir-
ing such actions by the City;
NOW, THEREFORE, BE IT RESOLVED-BY THE CITY
COMMISSION OF THE CITY OF CLEARWATER, FLORIDA,
IN SESSION DULY AND REGULARLY ASSEMBLED, AS
FOLLOWS:
1. That the City Commission of the City of Clearwater, Florida,
wishes to indicate that it endorses house Bill 42 and requests
that such Bill be passed during this current session of the
Legislature,
2. That a copy of this Resolution be provided to each member
of the Pinellas County Legislative Delegation and to the Florida
League of Cities.
3. That this Resolution shall become effective immediately
upon its adoption.

1'. SUMMARY
-A. Present Situation
The Human Relations Act (Chapter 760, Florida Statutes)
' specifies a variety of discri.minatcry employment '
i practices which are unlawful. Generally, discrimination'
in employment on the basic of race, color, rel:gicn, :J
! sex, national origin, age, handicap, or marital'status i
is prohibited.
The primary enforcement agency for such actions filed
under Chapter 760 is the Florida Commission on H=3n
Relations. The specific procedures are set forth is s. s
760.10(10), and provide that any person alleging an i
unlawful employment practice may file a complaint with
the Commission. If no action is taken by the Commission
within 180 days after the filing o! a complaint, the
aggreivea person may file a civil action in circuit
court seeking relief from the alleged unlawful practice.
Is. ?60.10(12)1 It any other state or local agency has
concurrent jurisdiction over a complaint ;fled with the
Commission, the Commission may refer the complaint to
that agency for investigation or action.
The Commission procedures are governed by the provisions
of Chapter 120, the Administrative Procedures Act, and
orders of the Commission are subject to review by the ?f
District Courts of Appeal (s. 120.Gf,) and enforcement by
the circuit courts (s. 120.59). No vrcvision is made in
Chapter 760 for the enforcement or review of orders
issued by referral agencies. g
Local versions of the Human Relations Act and the
referral agencies are typically met up by ordinance. As
such, the provisions of these ordinarcea, and the orders i
of the local agencies, are enforceable only in county
court IArtscle V. Section 20(4), State Constitution]. "
However, county courts are not er=overed under current
law to issue'injunctions, the enfcrcement mechanism most
` erec{uently appropriate in these typea of cases. Aopeais
from county court actions may be taken to the circuit
courts.

9. Probable Effect of Proposed Changes
The intent of-ED 42 is to provide a viable enforcement
and review mechanism for orders prohibiting unfair
employment practices which are issued by local referral
agencies, under the bill, the orders of such agencies
would be enforceable in the circuit courts as per s.
120.69 (the circuit courts do have the authority to
issue injunctions), and waul3 be rvviewable (and subject
to modification) by the circuit courts.
B8 42 also imposes a requirement that the membership of
each local agency include at least one attorrrmy and than
all hearings conducted 'ay such agencies conform to the
provisions of the Administrative Procedures Act (Chapter
120, Florida Statutes).

A. It seems somewhat anomolow, that HB 42 requires that
each local agency include ,n attorney within its
membership when a s;[milar eauirement has not been
Imposed on the Human Relations Commission.
S. E$ 42 is similar to;last ?ear's gB 938 (Clark and
Lippman) which was repott:6 favorably (with amendment)
by the Committee onrRetir:ment, Personnel and Collective.
Bargaining and the Judiciary Committee. Last year's
amendments by both Retirement, Personnel and Collective
Bargaining and Judic:iar•1 have been incorporated into Fib
42. (;he Judiciary amendment added the provisions
relating to the membership and procedures of local
agencies.) EB 938 eventually died an the Rouse Calendar
at the close of the session.
