Subiect / Recommendation:
Declare as surplus for the purpose of granting a perpetual Utility Distribution Easement to
Progress Energy Corporation ("Grantee"), being a 10-foot wide Easement Area defined as lying 5
feet each side of Grantee's facilities to be installed at mutually agreed upon locations over,
across and through a portion of the Southwest 1/4 of the Southeast 1/4 of Section 3, Township
29 South, Range 15 East, as more specifically described in said Utility Distribution Easement.
Summarv:
City Fire & Rescue is presently constructing its new Northwest Fire & Rescue Station Number 51
on Overbrook Drive just west of North Betty Lane. Completion is anticipated in June 2004.
Progress Energy will deliver electrical service for the facility and its electical equipment.
The subject Utility Distribution Easement grants Progress Energy easement and authority 5 feet
each side of all of its distribution lines throughout the project in order to facilitate installation,
maintenance, and, if necessary, future relocation and replacement of such facilities as may be
mutually agreed upon between the City and Progress Energy.
A copy of the easement documentation is available for review in the Office of Official Records
and Legislative Services.

located. constructed, excavated or created within the Easement Area. If tile fences are installed, they shall be placed so
as to allow ready access to GRANTEE'. facilities and provide a working space of not less than six feet (6') on the
opening side and one foot (I') on the other three sides of any pad mounted transformer. If GRANTOR'. future
orderly development of the premises is in physical conflict with GItk'iTEE'. facilities, GRANTEE shall, within 60
days after receipt of written request from GRANTOR. relocate said facilities to another mutually agreed upon
Easement Area in GRANTOR'. premises. provided that prior to the relocation of said facilities (a) GRANTOR shall l-
pay to GRANTEE the full expected cost of the relocation as estimated by GRANTEE, and (b) GRANTOR shall a

To serve in an advisory capacity with respect to the condition, maintenance.
improvement and beautification of the City's public parks, playgrounds, beaches,
and athletic fields.
2. Have you ever observed a board meeting either in person or on C-View, the
City's TV station?
Not this particular board. I have attended meetings of a variety of municipal
boards and I am familiar with the proper conduct of business before such
boards. I would bring no "agenda" to this Board.
3. What background and/or qualifications do you have that you feel would qualify
you to serve on this Board?
I am the father of four active young people who made good use of the City's
soccer, tennis, and softball and baseball fields. I am a long-time resident of the
City who enjoyed using City parks and recreation facilities years ago. Also, I am
or have been an employee of four Florida cities in two counties during my career.
I believe I have a good insight into the proper maintenance and improvement of
parks and recreation facilities, which provide some of the most important
services any city can provide its residents.

A RESOLUTION OF THE CITY OF CLEARWATER,
FLORIDA, APPROVING A MEMBERSHIP
APPORTIONMENT PLAN FOR THE PINELLAS COUNTY
METROPOLITAN PLANNING ORGANIZATION (MPO);
PROVIDING AN EFFECTIVE DATE.
WHEREAS, the Pinellas County Metropolitan Planning Organization (MPO) was
created and established by an Interlocal Agreement in August, 1977, to perform
transportation functions identified in Federal Laws Title 23 U.S.C.; and
WHEREAS, the State Legislature enacted Section 334.215, Florida Statutes, to
define the Metropolitan Planning Organizations under state law; and
WHEREAS, the referenced Interlocal Agreement was modified in 1979 pursuant
to the provisions of Chapter 334.215, Florida Statutes; and
WHEREAS, the MPO is comprised of eleven voting members, one each from the
cities of Clearwater, Dunedin, Largo, and Pine lias Park; two from the City of St.
Petersburg; three County Commissioners; one from the Pinellas Suncoast Transit
Authority; and a rotating member from the cities of Oldsmar, Tarpon Springs, and
Safety Harbor; and
WHEREAS, Chapter 339.175, Florida Statutes, requires the Governor to review
the composition of each MPO in conjunction with the decennial census and to apportion
it as necessary to comply with these requirements; and
WHEREAS, no changes to the current membership of the MPO are proposed;
and
WHEREAS, the MPO is required to submit a membership apportionment plan
that includes resolutions of support from the applicable local governments by
November 30,2003; now, therefore,
BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF CLEARWATER, FLORIDA:
Section 1. The City of Clearwater does agree to be a member of the MPO in
conformance with the Plan and Statutory requirements and to approve the MPO
Membership Reapportionment Plan as follows:

City Manager and City Attorney Pay and Benefits
Human Resources conducted an analysis of the salaries and vacation/sick days cap for the City
Manager and City Attorney in comparison to our benchmark agencies.
Vacation:
A direct comparison is difficult since no comparative system is similar to ours. The results of
our research was similar to last years analysis and found:
1) Agencies that offer both vacation and sick leave provide the following:
· City of Lakeland: accrues 150 hours a year in vacation, allowed to carry over and
have a maximum balance which caps at 160 hours. Sick leave is accrued at 96
hours a year, there is no maximum cap on hours, but the maximum monetary
payout is S8,000.
· Hillsborough County: accrues 90 hours a year in vacation, allowed to carry over
and have a maximum balance which caps at 320 hours. Sick Leave accrues at 90
hours a year; there is no maximum cap, no payout.
· City of St Petersburg: accrues 180 hours a year in vacation, allowed to carry over
and have a maximum balance of 480 hours. Sick Leave accrues at 128 hours a
year and there is no maximum cap. Payout is 1A balance.
2) Agencies that offer Uni-Leave:
· City of Orlando: accrues 165 hours a year, allowed to carry over and have a
maximum balance which caps at 800 hours.
· Pinellas County: accrual and cap limits are based on the number of years of
service. The accrual rate range is from 144 - 256 hours a year; allowed to carry
over and have a maximum balance, maximum cap balance ranges from 432 -768
hours.
The current general leave for both the City Manager and the City Attorney (combined vacation
and sick leave) accrual is 35 days per year (262.5 hours) with a 106.day (800 hours) cap.

Recommendation: Current combined vacation/sick accruals are considered to be competitive
and should remain unchanged.
Salary:
We compared with our benchmark agencies a simple averaging (which is the conventional
means we use for salary comparisons), as well as a comparison using the salaries of
organizations similar in population, budget, and total FTE's (the five agencies directly above
and the five agencies directly below Clearwater were compared in these categories).
1) The City Manager's salary is $15,875 below the simple average, $15,024 below the
population average, $10,101 below the budget average, and $20,057 below the FTE
average.
2) The City Attorney's salary is $13,355 below the simple average, $12,479 below the
population average, $13,283 below the budget average, and $12,856 below the FTE
average.
The following proposed increases would be necessary to bring the City Manager and City
Attorney to the average of the benchmark agencies surveyed by Human Resources:

SAMP employees will receive a 4% general wage increase effective on October r" 2003.
A 4% increase would result in a salary of $135,200 for the City Managers and a salary of 124,800

Recommendation: Provide 4% salary increases to both the City Manager and the City
Attorney. This will be comparable with the SAMP increase but will still leave these positions
below the average of the benchmark agencies surveyed.
