Section 2.393 (p) provides for normal retirement eligibility when a participant has reached age 55 and completed twenty years of credited service or has completed 30 years of credited service. Mr. Powell qualifies under the age 55 and 20 years of service criteria. BACKGROUND: Joseph Egger, Police Officer, Police Department, was employed by the City of Clearwater as a Police Officer from August 20, 1979, to May 1, 1992. At such time as he resigned from his employment, Mr. Egger formally requested to vest his pension. Such action was approved by the Pension Advisory Committee and the Pension Trustees. On April 29, 1996, he was reemployed by the City of Clearwater as a Police Officer. Upon the recommendation of the Legal Department and with a precedent set by another employee, Mr. Egger has requested that his previous vested pension right be waived. This request was approved by the Pension Advisory Committee on April 10, 1997. Upon approval of this request, Mr. Egger's previous period of employment will be added to his current period of employment and he will be eligible for retirement upon completion of twenty years of creditable service as a hazardous duty employee.
