BACKGROUND:
Nancy L. Tobin, Staff Assistant II, Gas Systern, was employed by the City on May 19, 1976,
and began participating in the Employees' Pension Plan on May 19, 1976. She suffered an injury
to her knee and shoulder while off duty which is the basis for her request for a disability pension.
Ms. Tobin has submitted letters from Dr. H. Gerard Sick, Jr., dated April 23, 1993, and Dr. J Sudler
Hood, dated April 29, 1993, in support of. her request for a non-job-connected disability pension.
The letter from Dr. Sick states "patient has generalized weakness and cannot maintain her arm in
a forward flexed position... difficulty climbing stairs because of pain in the knee-It is my opinion
these are per manent injuries, for which the patient has reached maximu m medical
improvement ...I would recommend that this patient be retired on disability...." The let ter from Dr.
Hood states "At this point in time I think the patient would . warrant disability retirement.
Describing her abilities and . her job requirements I don't know that they are really compatible
without causing the patient ongoing pain.."
Based on an average salary of approximately $25,210 over the past five years and file formula for
computing rion-job-connected disability pensions, Ms. Tobin's pension will approximate $10,714
annually. Charts. from Finance which take into consideration mortality rates and age reflect t h e
"present value cost of financing" this pension will be approximately $97,157.

The Pension Advisory Committee (PAC) received 'an application for disability pension from
Nancy L. Tobin on May 10, 1993.
Ms. Tobin has been determiner) by the Pension Advisory Committee to meet tits
requirements of the Pension Plan for a non-job-connected disability pension. She was
employed by the City on May 19, 1976, and began participating in the pension plan on May
19, 1976. Further, she has submitted medical documentation, copies of which are attached,
relative to her disability which has been reviewed and approved by the PAC.
By motion made and duly carried at its meeting of June 16, 1993, the Pension Advisory
Committee approved/recommended the granting of a tion-job-connected disability pension

Re: Disability Pension for Nanc Tobin
Dear Sir or Madam:
This 60 year-old white female sustained a comminuted displaced -
fracture of the neck of the (L) humerus on 9/25/92, plus an oblique
fracture through the midportion of the (R) patella with slight
separation of the fragments, as a result of a fall on that same
date.
She, was admitted to Morton Plant Hospital, and underwent open
reduction internal fixation of the (L) humerus, with an
intermedullay Seidel nail with one lateral transfixion screw, plus
insertion of two cannulated lag screws through the (R) patella.
Both•fractures have gone on to heal. Patient underwent removal of
the Seidel intermedullary nail on February 18th, because of
irritation of the glenoid from a small protruding portion of the
nail into the joint.
Patient has been getting physical therapy since then to increase
her range of motion and strength. Although she has made some
improvement, she has reached a point where the therapist feels that
she cannot expect any further improvement with continuing therapy.
She has maximum flexion to 100', with normal being 180`; extension
30", with normal being 50"; abductionoto 650, with normal being 180";
adduction. 40 , with normal being 50 a; internal rotation 450, with
normal. 90 ; and external rotation 45, with normal being 900.
Patient has generalized weakness and cannot maintain her arm in a
forward flexed position for very long before tiring. She has
difficulty climbing stairs because of pain in, the knee due to
chondromalacia of the patella, and beginning degenerative arthritic
changes, due to a mild irregularity of the joint surface.
It is my opinion that these are permanent injuries, for which the
patient has reached maximum medical improvement.
It is my opinion that the patient will have great difficulty in
performing her duties. She has to kneel in order to do some of her
filing. This is a problem -for her (R) knee. She has -:also
difficulty lifting heavy files, putting them in files that are in
an elevated position, because of the limitation of motion, and
weakness of her (L) shoulder.

Patient comes in for 2nd opinion from the City of Clearwater for a disability retirement
that is Job-connected. We have medical records from Cyr. Siek's office going from 10-21-
92 until 3-4-93 so I am not going to repeat everything in detail. The patient turned to
tap on'a window, was standing off the step. She fell, tried to get back up and fell into
the wall winding up fracturing her left shoulder and right knee. She has been treated by
Dr. Siek. She had open reduction and internal fimation of both injuries. The rod in the
shoulder has been removed, she is due to get the screws out from the patella next week.
The patient does bring in a job description which is attached. In addition however, her
job involves some of the following. The patient does work on the 2nd floor, has to go up
stairs to get to the 2nd floor. Normally, she is supposed to leave the floor several
times a day to go elsewhere but is no longer able to do this and has to delegate somebody
else to do it. She has to order supplies which means she has to inventory what is present
and'reaching up onto overhead shelves and'down into lower storage drawers and things of
this sort are difficult. Once the supplies are received she has to muscle the bo;:es
around, unpack them and store the supplies in the appropriate area, again this means
stooping, bending and reaching which she finds difficult. She has to get things out of
the bottom-drawers of file cabinets which is difficult.' She has to lift budget books,
ledgers, stacks of computer print--out paper which are difficult. The FAX machine, the
copy machine are elsewhere on the floor and she has to get up and walk to them. She-noted
that transfers every time she get up or sits down is painful. She notes when she goes to
work she has to walk up one step at a time and go down one step at a time. In the past
when she has had to put things away on an upper shelf she has stood on a chair but she is
no longer able to do this.
PHYSICAL EXAMINATION: Of the patient's left shoulder shows old anterior scarring which
is maturing. ROM shows flexion is 90, abduction 90, internal
rotation is to mid buttock, external rotation is about 5 degrees. Within the limited
motion she has there is no marked crepitus' or ratcheting. There is discomfort at the
extremes of movement, some mild discomfort to palpation over the proximal shoulder area
along with some anterior deltoid atrophy. E;:amination of her right knee shows old,
maturing anterior incision. There is full e,-.tension of the knee but there is a fair bit
of patellofemoral crepitus in the last 20 degrees in the arc of extension. Further
flexion is 124. There is no marked synovitis or effusion, there is no ligamentous
instability x 6. There is some mild parapatellar tenderness to palpation perhaps a little
more inferolaterally where the screw treads are but this is not dramatic.
X-RAY EXAMINATION: From Dr. Siek's have been reviewed and these.show the rodded
fracture with subsequent rod removal and the fracture patella with
fination screws. Everything has healed up nicely with respect to the fractures.
IMPRESSION: 1. POST-FRACTURE RESIDUAL, LEFT SHOULDER WITH RESTRICTION OF
MOVEMENT AND ATROPHY.
.2. CHOHDROMALACIA,. RIGHT PATELLA FOLLOWING PATELLAR FRACTURE WITH
RESIDUAL HARDWARE.
TREATMENT,PLAN: At this point in time I think the patient would warrant disability
retirement. Describing her abilities and her job requirements I don't
know that they are really compatible without causing the patient ongoing pain. I do have
the information from the Disability Pension request folks. Per page .7, 112, the specific
nature of the injury is as noted above. I think the difficulty she is having is going to

be permanent with, the expect perhaps of sortie mild tenderness aro"hd the patella which
might relieved when she has-the screws removed next week. ' I don't think this is going to
influence this chondromalacia however, which I think is the principle, cause of her
problems.. What the patient described as. her job,?esponsibilities and from my findings on'
physical examination I don't think she can do what.she'is required to do. My copy of this
:letter to the Patient Advisory Committee, we will advise them of our opinion. We will see
the patient back as needed.

BACKGROUND:
Donald D. Wicker, Police Lieutenant, Police Department, . was employed by' the City on
July 15; 1968, and began participating in the Employees' Pension Plan on July 15, 1968. He suffers
from hypertension, cirrhosis, diabetes and elevaied cholesterol which are the basis for his request
for a disability pension.
Mr. Wicker has submitted letters from Dr. H. Jerome Koser, dated May 12, 1993, and Dr. Donald D.
Patterson, dated April 5, 1993, in support of his request for a non-job-connected disability pension.
The letter from Dr. Patterson states "Mr. Wicker has had moderately severe high blood pressure
for ten years... moderately 'severe peripheral neuropathy which causes pain and altered feeling in
both legs and feet... cirrhosis of the liver, a condition contributed to by job stress...high cholesterol
in spite of a low fat diet ...It is my opinion that Mr. Wicker is too ill to continue to serve as a police
officer because . of these multiple conditions." The letter from Dr. Koser states "He has
diabetes mellitus with peripheral neuropathy... In addition he has hypertension, cirrhosis, and
elevated cholesterol... In my opinion, due to the above multiple medical conditions, Mr. Wicker is
incapacitated from continuing to work as a policeman."
Based on an average salary of approximately $51,259 over the past five years and the formula for
computing non-job-connected disability pensions, Mr. Wicker's pension' will approximate $32,037
annually. Charts from Finance which take into consideration mortality rates and age reflect t h e

The Pension Advisory Committee (PAC) received an application for disability pension from
Donald D. Wicker on May 12, 1993.
Mr. Wicker's has been determined by the Pension Advisory Committee to meet the
requirements. of the Pension Plan for a non-job-connected disability pension. He was
employed by the City on July 15, 1968, and began participating in the pension plan an July
15, 1968. Further, he has submitted medical documentation, copies of which are att ached,
relative to his disability which has been reviewed and approved by the PAC.
By motion made and duly carried at its meeting of June 16, 1993, the Pension Advisory
Committee approved/recommended the granting of a non-job-connected disability pension
to Mr. Wicker in accordance with provisions of Section 2.396 of the City Code. This pension
is to be effective on July 12, 1993, at 4.5 hours into the day.
The amount of Mr. Wicker's pension will be calculated by the Finance Department
according to the formula in the Pension Plan for non-job-connnectcd disability pension tit
such time as his last five years or service and salary can be computed.
I hereby certify that the Pension Advisory Committee has approved the granting of a
non-job-connected disability pension for Donald D. Wicker and that the above dates are
correct.

Mr. Wicker isa 55 year.old police executive.who is'now'dis-
abled as•he can no longer perform the functions of a.police
officer.'
I have been Mr. Wicker's family physician for'over 20.years.
He has had moderately severe high blood pressure for ten years
now controlled by a strong antihypertensive drug, Procardia.XL
60 mgs.,.and by weight reduction.
Mr. Wicker has had'a moderately severe.peripheral neuropathy
which causes pain.and altered feeling in both legs and feet.
This problem has'been present since 1986 and is due to maturity
onset diabetes.
in 1987, Dr. Kimber.Ward, a-local surgeon performed an abdom-
inal operation'on Mr. Wicker and found he had cirrhosis of the
liver, a condition contributed to by job stress.
Mr.•Wicker has high cholesterol in spite of a low fat diet.
The patient also suffers from chronic insomnia and takes medi-
cation for this nightly.
It.is my opinion that Mr. Wicker is too ill to continue to
serve as ,a police officer because of these multiple conditions.

To Whom It Mav Concern:
Mr. Donald D. Wicker, a 55 year old police officer, is
incapacitated from work because of a number of reasons'and medical
conditions. He has diabetes mellitus with peripheral neuropathy.
This impairs the sensory-motor coordination of his hands, feet,
and legs.
-In addition he has hypertension, cirrhosis,' and elevated
cholesterol. The stress of his work is deleterious to his
hypertension and hypercholesterol conditions. The cirrhosis
decreases his stamina to perform the functions and demands of his
occupation.
In my opinion, due to the above multiple medical conditions, Mr.
Wicker is incapacitated from continuing to work as a policeman.
