BACKGROUND:
Name
Josephine M. Robinson, Systems Analyst/Programmer, Department of
Administrative Services/Computer Information Services, was employed by the City on
November 13, 1967, and began participating in the Pension Plan on that date. She suffers from
ulcerative colitis which resulted in her application for a job-connected disability pension.
Ms. Robinson had submitted letters from Dr. F. Byron Smitherman (dated January 30, 1992) and
Dr. Yael Y Ellis (dated May 12, 1992) in support of her request for a job-connected disability
pension.
Ms. Robinson's disability pension was approved by the Pension Advisory Committee at its meeting
of June 24, 1992, This matter came before the Trustees of the Employee's Pension Fund on
July 13, 1992. Upon consideration of this request, the Trustees determined that the issue of
job-relatedness was not sufficiently documented with a reasonable degree of medical certainty.
Therefore, they remanded this to the Pension Advisory Committee for consideration of a
non-job-connected disability.
At its meeting held on July 15, 1992, the Pension Advisory Committee reconsidered the request of
Ms. Robinson. Upon review of the medical documentation, the Committee unanimously moved to
grant Ms. Robinson a non-job-eonnnected disability pension with the provision that she may
come back at a later time with additional information to support her claim that her condition is
job-connected.
This matter now comes before the Trustees for their approval of a non-job-connected disability
pension for Josephine M. Robinson. Based on an average salary of approximately $36,969 over the
past five years and using the formula for co mputing a non-job-connected disability pension,
Ms. Robinson's pension will approximate $22,875 annually, Charts from Finance which take into
consideration mortality rates and age reflect the "present value cost of financing" this pension
will be approximately $214,354.

The Pension Advisory Committee (PAC) received an application for disability pension from
Josephine Robinson on February 24, 1992.
Ms. Robinson has been determined by the Pension Advisory Committee to meet the
requirements of the Pension Plan for a non-job-connected disability pension. She was
employed by the City on November 13, 1967, and began participating in the pension plan on
November 13,1967 Further, she has submitted medical documentation, copies of which are
attached, relative to her disability which has been reviewed and approved by the PAC.
By motion made and duly carried at its meeting of July 15, 1992, the Pension Advisory
Committee approved/recommended the granting of a non-job-connected disability pension
to Ms. Robinson in accordance with provisions of . Section 26.34 of the City Code. This
pension is to be effective on a date to be determined.
The amount of Ms. Robinson's pension will be calculated by the Finance Department
according to the formula in the Pension Plan for non-job-connnected disability pension at
such time as her last five years of service and salary can be computed.

OPTION #1: Employees' can receive . a lump sum payment for
vacation and holiday pay and 112 of accrued sick leave

I have evaluated Josephine Robinson for multiple medical
problems.' -She has suffered from severe ulcerative
colitis which has been quiescent for many years and then
flared related to. multiple stressors in her job. She
also was recently found to have a renal calculus and
underwent a nephrectomy for tumor of the kidney. As well
she suffers from retinitis pigmentosa with partial
blindness.
As 'a result of many factors, I have recommended that she
take an early medical retirement on disability as she is
unable to continue to work with all of her 'medical
problems. Her ulcerative colitis to be sure would be
expected to worsen should she go back-into a stressful
situation.

RE: Mrs. Josephine'Robinson
Dear Sir:
Mrs. Josephine Robinson is troubled at this time with a
flare-up of chronic ulcerative colitis. It'is my impression
this has flared because of.stress.-which'is incurred in her
occupation. There apparently is no way to-change the stress
involved in her job and I have recommended, therefore, that
because of the serious nature of her-difficulty that she
plan on medical retirement.
I do not anticipate the condition will improve unless-she
makes that change. She is unable to work in a full time
capacity'in the ordinary way because of the disease above-
mentioned. I do not think her job will improve or her dis-
ease will improve unless she terminates her employment. In
addition to the above-mentioned problem, she has a kidney
stone which has to be removed, probable carcinoma of the
right kidney which will require removal of the right kidney,
and the well known problem of partial blindness associated
with chronic retinal difficulties.
It is important to add though, that for many years she got
along very well with her colitis and seemed to be very
effective in her work as best I could tell. She certainly
did like her work very much and had no intention of stopping
her work. Only recently has she developed this exacerbation
of chronic ulcerative colitis and she needed special con-
sideration and the above are my recommendations.

BACKGROUND:
Warren H. Scott was employed by the City on January 15, 1973, and has been a participant in the
Employees' Pension Plan since his ' date of hire: Mr. Scott has resigned from City employment
effective July 19, 1992. As of his resignation in July, Mr. Scott will have 19 years and 6 months of
service and pension participation.
The Employees' Pension Plan provides that should an employee cease to be an employee of the City
of Clearwater after completing ten (10) . or more years of creditable service, then such employee
shall acquire a vested interest in the retirement benefits. Vested pension payments commence at
the' time the employee normally would have been eligible for retirement. Mr. Scott would have
completed 20 years of hazardous duty service on January 15, . 1993. Mr. Scott's vested pension
benefits will be scheduled to begin on that date. Pension will be paid based on 19 years and 6
months of service, utilizing the following formula; years of service times average salary for last
five years of service times 2.5 percent.

BACKGROUND:
Lori Metzner was employed by the City on October 25, 1982, and has been a participant in the
Employees' Pension Plan since her date of hire. Ms. Metzner will resign from City employment
effective October 30, 1992. As of. her resignation in October, Ms. Metzner will have 10 years of
service and pension participation.
The Employees' Pension Plan provides that should an employee cease to be an employee of the City
of Clearwater 'after completing ten (10) or more years of creditable service, then such employee
shall acquire ' a vested interest in the retirement benefits, Vested pension payments commence at
the time the 'employee normally would have been eligible for retirement, Ms. Metzner would have
completed 27 years and 2 month's of service and be fifty-five (55) years of age on January 1, 2010.
Ms. Mctznees vested pension benefits will be scheduled to begin on that date. Pension will be paid
based on 10 years of service, utilizing the following formula: years of service times average
salary for last five years of service times 2.5 percent.

The Pension Advisory Committee received an application for vested pension from
Lori Metzner on July 9, 1992..
Ms. Metzner was employed by the City on October 25, 1982, and has been a participant in the
Pension Plan since October 25, 1982. The amount of Ms. Metzner's pension will be computed
by the Finance Department at a later date.
By motion made and duly carried at its meeting of July 15, 1992, the Pension Advisory
Committee' approved/recommended a vested pension for Lori Metzner in accordance with
Section 26.49 of the City Code. This pension is effective January 1, 2010, at the end of the

BACKGROUND:
The Pension Advisory Committee (PAC) consists of three employees who are elected by a majority of the City
employees covered by City pension.
The Pension Advisory Committee Policies and Procedures Manual contains a provision In the policy for
"Processing Disability Pension Requests" (No. 9, page 8 of the Manual) which states that all three members of
the Committee must be present when the Committee votes on disability pension requests.
The PAC Policies and Procedures Manual was approved by the PAC and the Trustees. The pension ordinance
Itself does not contain any language relating to a requirement that all PAC members be present when they vote
on a disability pension request.
Due to the - incapacity of Mr. John Nicholson, Chairman of the PAC, from active participation with the PAC, on
May 4, 1992, the Trustees approved a temporary amendment to the policy to allow a quorum to vote on
disability pensions. This change was effective for 90 days and expired on August 4, 1992.
This medical situation continues to incapacitate Mr. Nicholson from active participation with the PAC; and the
Committee passed a motion at its meeting of July 15, 1992, to ask the Trustees to extend this temporary
amendment until the first meeting in September (September 2, 1992).
