Comm.ission at their Agenda r:�eecing of March 20th. It is m� un�erstanding that Cammissinners
5ee1 and Hooper req�ested additio�al infarnlation on this issue.
I am at�aching additional 'uiformatian on this bili provided by our Florida Municipal Natural Gas
Assaciation (FMNGA} counselllpbbyist, Bill Peebles. He points out that this is a bill jointiy
oppased by the Florida League af Cicies, the Flc�rida Mua�cipal Ele�tnc Association (FMEAj,
and the FMNGA, amang others. However, Haus� Bill 3�3 has already passed, and Senator
Latva�a's Bill 21a is on a fa�t tr�rk untess the City of Clea�rwater and others take an
ag�ressive and �trong position agau�st this. �
Bill Pcebles Qoints aut that this bill trcads on Ehe issue oF Municipal t�ax exemption, as �t wou�d
impase ad valorem, imtangible� and sa�es t.�xes u�on any municipa�ity which chaoses to offer its
citizens a municipal te�ephonelfiber utility. The togical extension af this concept undex the
theoretical banner of "Ie�elizing the playing feld" is municipal �as and electric uti�ities, water

I trust that our Cammissian wo�ld agree with Bij� Pee�les' assertian in the attached memo, that
it would be abjectionabl� far the City ta be required to transfer City earn�angs on the Clearwater
Gas Syst�em (or any oth�r enterprise far that matter) ta another governmental cntiry. This would
direeciy impact the availabiliry of these funds to ofFset our own C'sty ad valorem taxes.
We need the Cleanvater City Cammissian to take a stand again5t this legislation with the
FLC, F14�A, and Fh1NGA and instre�ct Peter Dunbar tfl actively, and quickly Iabby against
this bill. Additionally, I w�ould hope that the Mayor and/or Commissioners wou[d quickly
contact Senator Latvaia and let him knaw that the City opposes this attempt to limit municipai
rights, for telecommunications ar, any .other enterprisa aciivity which the City Commission
�etcrmines is in the best �nterest af our citizens.

Bayview Association and the many ci�tizens of ClearwA#er who have
supparted us in o�r eftorts ta preserve Ehis site as a public park.
In order to �ove fro� #he discussion stage ta the lirst of the many
steps requfred to purchase, improve, end preserve this site, we
need to move forward in a deliberate fashion as requested above.
These two initiak steps are designed to produce the following:
<*> Conaept Plan -- to identify the general ch�►racter and type of
improvements that would be apPropriate. This will be the
basis for re�ching consensus on how the park would be used,
identifying preliminary impro�ement costs and the conceptual
management plan. This is a necessary firsi ste� irrespective
of how and when the property might be acquired.
<*> P-2fl00 Grant Applfcation -- to apply under L�115 Florida
Communities Trust program �or a grant af fifty percer�t {50�)
of the cost af aequisitian oi the praperty. The remaining
tilty peraent (5t1�} would be the obXigation o[ the Ci#y upon
appcoval at the grant, the amount of which wouid be based upon

We estimate the direct or outside cast of tf�e conc�pt plan and
related information to accompany the P-2000 grant apAlicatian wauld
not exceed Ten Thousand Dollars (S1U,U00) and ask tha# this amount
be apprapriated to undertake these two tasks.
As outlined in previous ca�respondence ta yau, we believe there is
an excellen# opportunity ta combine this site with the adjac�nt
caunty-owr�ed property to create a significant entryway feature,
passive park and environme�tal preserve. We have attempted throug�h
m�etings with the City �nd Pinellas Plans�ing Council stafi to
identify the most eftiaient and systema#ic approach ta initiating
this effo�t. �
The Pinellas Planning Council staff has committed #o assist the
City in this process (in particular with the P-ZQ00 grant
application, wiEh which tiiey have experience) as we�l as to
coordinate with the County relative to the adjoining County
praperty.

The Commission on Locai Government II was created dvring the I99b i.egislative Session for
the pu�posE of recomme,nc�ing appropriate reforms to the orga�ization, struc4ure, powers,
cr�atian, duties� financing and service delivery cagacity of Fiorida local governments, In
addition, t�e commissian was directed to explare ways to eliminate overlapping jurisdictianai
responsibiIity and duplication af costs among governments.
Since October 1996 the Commission h�.s been meeting monthly to expIore legislative azid
constitutional reforms. FI.0 has been intensrvely invoived wit�h this effort �y having sta�f
representativcs at a�i Commission meetings, making presentadons to Commission members,
assisdng in Iogistics and planning for meeting agendas, and providing inpuE to Commission staff
with rcgards to draft policy opt�ons prepared for Comnlission delibcrations.
Whi2e Commissian membership is represented wcll by city and county officials, five members
from e�ch respecdve jocal govemment, the present ga�l is to get input from all elected officials.
